    Dear Senator
    I am a highly-skilled professional who entered this country legally. I’ve been waiting for my US permanent resident visa -also known as "Green Card" for the past several years along with 500,000 other educated, highly skilled employment based (EB) immigrants. Many of us have been waiting for our turn to get Green Cards for 5-10 years while consistently abiding by all the laws of this country. Such long delays are due to tortuous and confusing paper work, backlogs due to various quotas and processing delays at US Citizenship and Immigration Service (USCIS), other allied state and federal agencies.

    Several categories of EB immigrant visa (Green Card) numbers were unavailable (“retrogressed”) since the fall of 2005. Because our immigrant petitions are tied to the sponsoring employer.

    For the past several decades, the US Department of State (DOS) has been publishing advisories known as visa bulletins once a month to announce the availability of immigrant visa numbers. On June 13, 2007, after a gap of nearly two years, DOS announced that all EB visa numbers would be “current” for the month of July. This meant, irrespective of our “priority date” (date assigned to us for our turn in the line for Green Cards), all of us were made eligible to apply for some interim immigration benefits. This “priority date” refers to the date when our labor certification (documentation verifying no US citizen worker was available for a given job) had been filed.

    Please note that 6/13 DOS announcement would not have led to immediate green card for most of us; but at least it would have ensured us interim benefits such as the right to travel and right to work for any employer- this was still a welcome change. Especially, for dependent spouses who are otherwise unable to work, this would have translated into right to travel and work without restriction and thus channel their energies positively. Several dependent spouses are also highly-skilled.

    Tens of thousands of applicants spent thousands of dollars in legal fees, immigration medical exams & vaccinations & getting various supporting documents ready to file our immigrant petitions to USCIS, at times inconveniencing our old parents in our home countries as well. It has been an agonizing two weeks for us. Some of us to had to fly in our spouses from our home countries or have had to cut short business trips. Hundreds of millions of dollars were spent by thousands of immigrants in preparation of their application. To our shock and dismay, on the morning of July 2nd 2007, USCIS announced that EB visa numbers were not available and all petitions filed in July would be rejected.

    For the legal skilled immigrants this has been a rather traumatizing and disheartening experience. These are people that are in the country legally, paid taxes and followed all the rules.

    We sincerely seek immediate congressional/ legislative remedial measures which would
    (1)Reduce the enormous backlogs of green card petitions of legal skilled immigrants
    (2)Ensure and request USCIS not to reject our immigrant visa petitions filed in July and provide us interim benefits of a pending immigrant visa petition. We make this sincere request with the hope that people who played by the rules will be rewarded.

    The good thing is eliminating the country quota is always lumped with doubling the total quota and/or recapturing previous years waste, so hopefully the affect evens itself out.. Eliminating the coutry qouta by itself is a disaster.

    the elimination of country quotas alone only redistributes pain...where our goal is to end everyone's pain. we asked for all the measures on our agenda and we support the whole package together. we want a better immigration system for everyone.

    Minor correction, these are articulate idiots, just BUSY killing their valuable time arguing among themselves. Why bother them, let them be engaged in a very important discussion. Some of the posts are as idiotic and over-board as The Mad Show.

    Is USCIS doesn't give a damn about educational credentials why do they they have EB2 category for Aliens with Advanced Degree, EB1 category for Aliens with Ph.D, Uncapped H1 for Aliens with US degrees etc..

    Even Canadian point based Immigration system assigns more points for aliens with advanced degrees.

    First of all USCIS is nobody to decide whether or not education credentials mean anything or not. That decision is taken by lawmakers. We all know theer are two kind of lawmakers � Republican & Democrats.

    Republicans love the people with money i.e. large employers. Publicly, most Republicans hate everything under the sun. Privately, they would want to love you if you are a gay. These are bunch of idealogs to oppose abortion & gun control, unless you can show them some green and then they will be your best friends. Republicans think God is scared of Gun lobby so God is on their side.

    Democrats is the name of another group of idiots. They don�t know what they should do when in spite of all their efforts to not get elected; they are thrown into the Congress as the Majority party. One thing Democrats are good at, they know how to give up majority in the Congress. Publicly, Democrats would pretend that they care for the poor. Privately, they too would want to love you if you are a gay. These are another bunch of idealogs, who, privately, would work day-and-night for the very poor and under-privileged group of people, unless you can show them some green and then they will be your best friends. Democrats think God is scared of US Chamber of commerce, so they only support illegal immigration.

    Now, most people in EB backlogs are neither very rich company/big business owners nor the EB applicants are very poor. And to add to that, last time I checked, most EB applicants are not gay, unless the recent poll numbers would suggest otherwise. So how in the world do we expect to get our issues fixed if we are neither rich business owners, can�t pretend to be very poor nor are we gay? I think we are toast�.

    As far as EB-1, 2 & 3 is concerned, these categories are created so that some people, as seen on this forum, could just stroke their egos thinking that they are better than others around them. In essence, this is another form of discrimination so that people like you and others could fight on forum like these ;-).

    9 years oh my god... I read on one of these threads(May be threads for US students), a person is waiting since 2002. He has done his PHD from here and has children in colleges.
    He went to extend his visa stamp to india, and they refused becuase the consulate asked him to wait till a decision on his case is made, then upon that decision they will give him a visa or not.

    As per Pappu this is the only year... We have to do it this time by hook or my crook. All our provision should be met.

    1) People waiting with I-485 get more visas to get GC.
    2) People waiting to apply for I-485 should be allowed.
    3) People should have the AC21 portability available so that they can leave their desi companies that torture them.
    4) People with Master's Degree should also get priveledge.
    5) Let their dream be fullfilled too (Increase in H1-B :D )

    Hi, Can somebody let me know, what would happen if first labor was approved from BPC (Not from PERM) and 2nd Labor is being filed in PERM (both from same employer)? Would DOL automatically deny the first labor or do some audit?

    For that one of these two should happen. Eb3 should move forward and Eb2 should retrogress.

    Or EB2 stays and EB3 alone moves forward.

    Or EB3 stays and EB2 has to retrogress so much (to 2001)!

    I guess chance for 1st and 2nd option are high. And, this would answer Ramba's question how EB3 for India would get approval for PD 2003. There are very few 2001 PDs left (per me). Relatively more 2002 and most of 2001 and 2002 are pending due to name check else they would have got their GC during July and USCIS would not have returned VISA numbers back to DOS nor some numbers would have finally got wasted (FY2007).

    So next PD would be 2003 (and there are very few 2003 filings that were filed before June 2007).

    why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...

    I heard some friends saying using L2 charts, ( I am new to this and Plan to do trading from now as I think it is good to enter now or it is right time to get in .. )

    Have not seen approvals today :) Is this the height of efficiency? all visa #s consumed on day 1

    The dreaded question! On everyone's mind, but we dare not ask. As you must know, the whole process is in an extremely delicate balance - please don't rock (read jinx) the boat by asking such questions! :)

    Anyways, good luck to all eagerly awaiting their GC - and let's continue making our efforts at longer term relief (ala advocacy efforts, etc.).

    If you are saying that EB3 would move from 2001 to 2004 this year, then that is what BharatPremi and I were saying. We should be OK with 3 years movement for EB3.

    And, guys don't jump on me, if we accept that 3-4 years for GC is acceptable (though I agree that GC in 6 months would be the vision, dream...), then guys who have filed in 2004 should be patient till 2008 and guys who filed in 2006 should wait till 2010.

    The only guys who should worry is those with PDs 2001 and 2002. Again, most of them got cleared in Jun, July this year except those who are stuck in name check and LC in BEC.

    Well, I was saying "at least". So if goes for 2 years to clear pre-PERM backlogs, I would not be surprised. ;)

    macaca it does make sense. This si what they are doing...opening up the flood gates and allow for a flood. from this flood they will be able to easily approve 40k cases.

    once that is done they will shut the flood gates so that the level starts moving towards equilibirium...with labor substitution ending on july 16th ...the 70k backlog elimination labor aps will be done quick enough.. since many will have redone their LC in PERM..and uscis will have an accurate headcount of people in line from this floodgate opening process.

    i dont think we ll see retrogression back to 99... but maybe more mangeable levels

    I understand that. However, apart from canvassing the support for CIR by writing to senators, lawmakers, in what capacity can IV influence USCIS to take up EB-3 cause?

    Even if IV has intentions to ameliorate our pain, is it truly capable to influence the agency to do something for only one specific category ? At a micro-level, we EB-3 need to do something about changing our situation ourselves, lest we stand in the filthy excreta for eons. :mad:

    i'm all for this. This is very close to my heart. I probably care more about this than i do, my 485 approval.(can't have one without the other, i know i know. But still.).

    I don't know when i'll get my 485 approved, hopefully within the next year. But i'm willing to work on this, whatever it takes - contributions, lawmaker meetings, dc.

    I'm in.

    This has got to be simple too. When the citizenship law was first drafted, immigrants got their green cards within months of entering the country. Start to end of the greencard process took under a year, if not less.

    The intention of the law was to have them learn the language, the ways of the country, and assimilate, which was expected to take about 5 years, before applying for citizenship.

    These days the green card process itself take over 5 years for a lot of people. Most indians and chinese in the eb2 category, and pretty much the entire eb3 category have lived here longer than 5 years. In those 5 years they have gone to school here, paid income taxes, bought homes, and learned the language (well they had to, in order to qualify for an employment based green card!). What more "assimilation" do they need to do?

    I definitely think that the following should be the criteria for eligibility to apply for citizenship,

    - an approved green card
    - 5 years of continuous u.s. Residence starting from the date the 485 application was received.

    Let's do this.
