I do not have a GC which means my entry in US is not guaranteed the next time I visit my home country. Period. The risk is simply not worth taking. Congrats to those for whom it worked out. You are far and few people.
I recently had the taste of this experience when my wife got 221(g) at Mumbai Consulate and had to enter using AP. Imagine if she did not have an AP and if we had a home what would we do?
Today in this scenario we can atleast sell everything we have and cash out of US. The stakes and dependency gets higher if we own a house. I would advise anyone against "investing" money in US when you dont have a GC.
I bought a property in India in the meantime and the value has doubled and I am pretty happy about it.

There is no harm in adding this also as the fifth item along with the existing 4 items. :D
I think CITIZENShip years Credit or Reduction in the years is Make most sense for the highly skilled immigrant from India and China as those are the people who suffers most because of backlog and name check.
I also think we should stick to the "five year federal taxes paid" beacuse that is what they expect from normal family based GC holder. Also adding Masters and Higher degrees in the STEM fields attract possible more support.
We should not talk any where close to 10 /15 years waiting time as that is not what current system of citizesnship talks about.
Also marriage based GC already has 3 years after GC rule so it may beeasy to get it.
Making it more complicated like Percent credit for before GC filing, after GC filing, after getting GC May become hard and complicated to convenince politicains who might be amending those rules.

I entered US on H4 in Sep 2005 and changed my status to H1 in Oct 2006.
I started working from February and have paystubs till July.
Planning to go India in August and get stamped for H1 in chennai consulate.
My husband has to renew his H1.
My questions are
1.)If incase my H1 gets rejected, I am planning to come on H4. Do i need to pay the fee again in HDFC for H4 and book an appointment or I can just walk-in some other day for H4 stamping with my husbands valid H1-B petition and other other required documents.
2.)We both are working for different employers. Can we take H1-B interview together?
Your inputs are appreciated..

This has become a ranting thread of EB3 folks. One simple question:
How many of you EB3 India folks who are complaining actually went to Washingtno DC last month for IV Advocacy event?
I hear it was not even 250 people. If you take out all EB2 people, so few EB3 people. This means EB3 people do not really want to do anything but after every visa bulletin come to the site and rant.
We in EB2 do not have much to worry. Our dates will move fast. But you EB3 had a chance last month and you blew it by not doing anything. So stop complaining.
I dont think we all are complaining...We are just thinking out loud hopefully some solution / direction comes out of it. But one thing is sure people certainly did not like your attitude.. It could be that you are deliberately trying to instigate something just for fun or maybe you are having a bad moment or may be none of these, I was just trying to think the rationale behind your comments ...(could be even u just stated something and people didn't understand whatever u really meant and applied thier own interpretation)...only u or god knows the truth...I dont have anything against u and know for sure that even u dont have anything against us.

If this is true then it looks like this came as a surprise to everyone (including core members). But, I am glad that this is happening and hope its true and successful.

Called the offices of Rep. Hinojosa, Rep. Gonzalez, Rep Hilda Solis and Rep. Ciro Rodriguez. Left voice messages with the offices of Rep. Hinojosa and Rep. Gonzalez. The office staff at Rep. Solis and Rep Rodriguez asked if I was from IV and said that they've been receiving a lot of calls. Rep Ciro Rodriguez's office would prefer to give priority to calls from their constituents as opposed to other callers. This is to urge all IV members who are constituents of Rep. Priority Date :- December 26th, 2001.. you should be camping outside the USCIS Service Center doesn't matter what category you are..
On serious note, you should call your senator's office right away before you waste anymore time..
With the senator's office, I have a very bad experience though.:confused:
I called them once in the past (my date was current then) and they returned the call saying that the administration has certain policies on immigration and there is nothing much they can do at the given point of time.
Hence i refrained from it. Does it really help? They might have already forgotten my name by now.

And to add if this continues, Congressman will not take these requests seriously going forward as every other day they will be getting such requests. So please have patience and wait for few days before you approach your local Congressman.
I haven't open any SR with USCIS , but some folks mention that when they open SR they get standard reply to wait for 30 days. With visa dates going back and forth, customer should open SR as early as month start so if dates remain current for atleast two month they can get some reply. If you wait till end of month and then open SR and if USCIS ask for 30 days and date retrogress , I bet you next reply will be No visa available.

I e-filed on May 22... FP done. No LUDs
One of the service reps was kind enough to send an expedite request on my behalf. No updates yet on that.
Planning to contact local congressman this week.
This is all so frustrating.. We were waiting for GC now wait for EAD too!! :mad:
My EAD is expiring on Sep 22... and to top all this, my DL is based on EAD.. so from Sep 22 I'll be sitting home doing nothing... :eek:

that the years for Citzenship count the day you apply for I-485...not actually recieving the GC..that was his lawyers opinion..
So does this mean that all the July filers will be eligible for Naturalization come July 2012 ( provided they get the GC by then)
Gurus please comment - any one has spoken to the lawyers on this topic?

So far, there is no provision of 485 filing without priority date becoming current. Has this failed too? Just two weeks before Feb. 15th. I guess the fate of this provision is determined now.
It seems that nothing can happen before Feb. 15th. Even the H1 increase has not happened yet. Democrats do not seem to be immigration-friendly as many expected before. No hope for CIR this year. No hope for SKIL this year. What a miserable situation!

I am in the same boat. I wish you are true. Its so frustrating to see 2006 folks getting approved (I am happy for them that at least they are getting approved but it is unfair that we are still waiting) and we are still waiting. Ridiculous....

Did you apply for your 485? Your profile does not show that it has.
The date on which your 485 is filed is the order on which the applications are processed.
your PD is only used to say whether an application is eligible for processing. Once it is eligible, it is the 485 application date that states your position in the queue.
