Hi..
my H1 got approved on dec 2006 for 2007 cap.It is 3 years valid.
Because of some problems between me and my employer,
i just transfered my h1 to h4 to maintain my case status on jan 2007.
He didn't give my H1 paper to me and gave me a copy of it.
Now,Can I reuse my H1 again?
and
If it is posible , can transfer the same h1 with other company without paystubs.Please help me out.

When I see EB3-China data in USCIS's work sheet I am getting shocked. How come EB3-China has a such a low pending number particularly comparing with Eb3-India?
That is the first point for me to generate doubts about the accuracy of the data.
Because! Most of the Chinese come to US to do MS and mostly apply in EB2. Not many come to US from China to work after Bachelors. Where as a lot of Indians come to work after bachelors and working in Indian companies for some time and so there is huge number of EB3 applications for India. Hope this makes sense???????

Pasadena congressman Adam Schiff from CA supports legal immigration. I received an email from him recently stating the same.
"In considering immigration reform, Rep. Schiff has repeatedly stated that he does not believe in amnesty for undocumented aliens, but he does believe that those who have been living in this country -- working and paying taxes -- should be given an opportunity to embark on a lengthy and hard-earned path to citizenship. However, he has made it clear that he does not support immigrants who are here illegally being rewarded for breaking our laws by jumping ahead of those who have sought to enter this country legally."

While IV has not lobbied for any particular EB category but I think that is what they should be doing. Isn't one of IV's goals is to end retrogression ... so shouldn't EB3 be at least lobbied for since they are in such a mess ... I don't believe it sometimes that we are still in 2001.. that is 10 years back.
In a couple of years EB2 will be more or less current. So that means a guy who came two years back will file in EB2 and get his GC and I who has been working here for 12 years would still be waiting in line.
Some people say EB1 are brighter than EB2 and EB2 are brighter than EB3 . I find that funny because no one Eb1 or EB2 or EB3 is brighter than anyone unless someone has an extraordinary PHd or is a scientist . Its the lawyers who are brighter and how co-operative your company is.
Besides when we filed in EB3 categories there was no retrogression and hence no one cared or else we also would have filed in Eb2 and got our GC.

Hi!
My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).
I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:
1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?
2) I noticed that the fee is:
- 190 for application
- 500 for fraud security
- 750 or 1500 depending on whether there are 25 or more employees
- $1000 premium processsing
- $$$ for the lawyer to prepare and file the petition
Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.
3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?
4) Can the entire process by done online?
I will really appreciate it someone could help with answers to these questions.

Guys,
Let's not assume that visas wasted by USCIS would have been allocated to India or China. This would not have happened as these countries can not get more visa numbers than the numerical cap of 7% of the world-wide EB quota.
I'm sorry, anyone who thinks that the Priority Dates were shifted so visas would not be wasted are deluded.
Come on - the visas were going to go to waste because there was not enough manpower at UCSIS to process the applications. In what way WHATSOEVER, has this changed because there are more applications?!

No one knows dick about PD movement. EB3 filers think that somehow EB2 PD gets stuck or even retrogress and EB3 PDs race forward to 2003/2004, through some delusional logic. Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.
My two cents...

This is true. I heared the same from my attorney too. If you look at the history, there are two times they have discontinued the VB in the middle of the month. So let us hope the best and we will prepare for the worst.
I am not sure how far it is true, but this is the content of the email I got from my attorney when I pressed him to file at the earlierst.
"As soon as we have these forms back, all of the evidence for filing remaining from you, and I review the completed filing, we will file it. We appreciate your interest in filing on the first day the filing allows. We will endeavor to do that. I should point out that the current bulletin allows for filings throughout July. It is possible that the filings could be discontinued later in July. We are in touch with officials in Washington about this issue and will file your application in a timely fashion for obtaining the benefit when the filing is properly prepared."

Unintentional, might be, but you did ruffle this topic of US Master's vs US Non-Master's with this rather sad comment (warm spit!). I dont want to go much further into this either but talking about something that you obviously dont know (useless subjects 'assembly language programming'), you havent added any valule addition here either. (Just FYI, even during peak recession, ppl with ALP skills were really very few because most of the direct recruits from '6 month NIIT courses' werent upto system level programming).
And btw, if think that a 6 month course in NIIT with a degree in tier 3 university is going to help get a job during times of recession, then i dont know what to tell you.
Yes, i do have an MS degree from the US and i did suffer lay-off during recession - bounce back, i did really quickly while i saw few ppl that only had '6 month courses from NIIT' suffer for long times without a job because all they had to offer was that...their six month experience at NIIT!!
