    Is there any way we can initiate the FBI namecheck/background check right away, so that by the time we apply the 485 this is already moving ahead and hopefully will not be a blocker.... i am just thinking out loud about ways we can streamline this process....anyone? ideas?

    I don't have clear picture on what IV is planning to do now except that FOIA drive. I request the core team to inform all IV members explicitly about their plan. I guess there will be more donations than they expect.

    suggestion: while sending emails that there is a reply to your post, they should also add the actions they have been/ or planning to take.

    I did not write this bill. You should go to challenge Rep. Issa for that clause. In my previous post, I already said I am perfectly OK if the IV core want to modify the bill, so that the 55K can be applied to everyone. Is that very clear?

    Politics is all about compromise
    This kind od statements have been used time and again to justify actions taken by a section of people to skew things in their favor. How come there has been no compromise from EB2 folks or folks who hvae done MS here in US.

    This bill might do something good for some EB3 folks who have advanced degree but then again instead of a EB2 and EB3 difference we will now have an EB3 MS and EB3 Non MS difference and as i see it there is not much difference between those two. Same wine new bottle.

    Being at the bottom of the totem pole is not a good place my friend. Shit always flow up to down never down to up.

    In any case what is being discussed here wil have no impact on the outcome of the bill. If the bill goes through MS educated EB3 folks wil get GC and non US educated folks will still be stading in the line applying for AP and EAD.

    100% agree with confidence. My prediction based on statistical analysis (That is the only thing I have regulary done since 1999 and still doing .. no end to this tunnel...:eek:) is as under. Yopu would see +- 2 months here and there in every bulletin.

    So, I fail to understand as anybody else, the logic here, why they moved EB2 faster , and why they did not move EB3 ..

    As per above Unused EB2 Visas are to the tune 6000 and Unused Visas are to the tune of only 1500, by end of USCIS Fiscal year 2009-2010.

    And as per USCIS list there were only total of 1000 EB3 waiters till Dec 2001 (1997 + 1998 + 1999 + 2000 + 2001 )...

    Why this special treatment to EB2...

    I think spillover method has not been changed since years. The only puzzle is that whether it is horizontal or vertical or combination of both that USCIS works with we exactly do not know.

    Do you guys agree ?

    In my opinion equal share of spillover count to oversubscribed EB categories for a particular year would be the final and legitimate solution.

    I applied for a new passport from the Indian Embassy in Washington DC in Nov '06 as my old one was expiring. Got the new passport in 2 weeks from the day I mailed the application.

    Don't bother calling them . You will not get through to anyone. Just wait it out . It should come in 2 weeks.

    02/02/2007: What Did Senator Kerry Immigration Reform Bill Mean to EB Immigrants?

    In highsight, the failure of the Kerry Amendment to H.R.2 to pass the Senate could be considered a relief to the EB immigrants. Review of the immigration reform bill in the H.R. will establish that the bill proposed for the employment-based immigration system practically nothing other than increasing the annual quota to 290,000. None of the provisons in the SKIL bill was reflected in the bill, including exemption of the spouses and children from from the numerical limitations, exemption of certain EB groups from the annual numerical limits, opportunity for filing I-485/765/131 for the I-140 beneficiary during the visa number retrogression, etc. etc. etc.! Had this been enacted, it would have affected the upcoming CIR bill or special legislation for Employment-Based immigration system reform. This reporter was shocked to learn that this bill provided practically no relief for the employment-based imigrants other than farm workers and the children eligible for DREAM Act bill. The bill was extremely imbalanced legislation in a way from the perspectives of the "Comprehensive" Immigration Reform.
    We will see whether the Senate leaders will indeed complete and introduce the CIR proposal next month.

    Even illigal immigrants has more optimism,
    And they actually believe themselves they have every right to become a permanant citizens than legal immigrants waiting in line.

    Some folks can't even bear the thought if some one thinks they should try to influence the law makers.

    Illegals have nothing to lose. If CIR happens...they celebrate, now that they can all be legal and apply for their families to follow them
    If CIR does not happen...they still continue to live here, work their jobs, keep sending money home, and try and get their relatives over here by paying the "coyotes"...it makes no difference to them.

    Even if these guys are legalised, they will still NOT pay taxes, NOT learn english, NOT try and be upstanding residents.

    They have huge numers, both in population and political support.

    They represent a MASSIVE democratic vote bank.

    WE (EB) have none of the above and a lot to lose)

    Hence, the attitude.

    This H1B drama has really brought out the "indian" in each one of us (you). God Forbid, some of the anti-immigrant agencies see this, we will no face to fight.
    To say something like what logiclife has said only brings out the true face of the some people behind immigrationvoice.org. It all boils down to "who has a US degree and who hasnt"..well, Mr logiclife, You dont know the value of a US degree simply because you dont have one! I want my GC as much as some people here without a US degree, but to classify a US degree as being the same as "warm spit" is just plain "uneducated". Now, I really appreciate all that immigrationvoice.org is doing for our community, but some of the these stupid racist comments from the so-called administartors,with such an attitude,who happen to meet the US lawmakers scares me a lot.


    There are people who have done Masters in computer science in USA, graduated in 2002 and 2003 from top 50 universities and ended up getting training from desi bodyshops who we all love to hate. That training made them capable of gettting H1 and paycheck, not the books they read in US masters courses.

    If US universities were up to the job of teaching people what was demanded by market, these folks wouldnt have had to go to desi bodyshops do get training.

    I dont have US masters. I had enrolled in US masters degree in fall 2000. I left after 1 semester. During my brief stint as a student of Masters in Computer Science, I did get an opportunity to see what the courses are and what they really teach.

    The reason I am lashing at some folks here is that some people are thinking that the Durbin-Grassley bill will benefit them because it will end consulting. Some people dont realize that most US masters degree holders, both MBA and MS (Computer science) find out that in order to get an H1, consulting is THE ONLY OPTION, especially when INTEL, Oracle and Cisco arent recruiting, they do go and stand in queue in front of consutling companies (Desi or otherwise). Also, people doing full-time jobs in silicon valley (what some people call "real jobs") also do fall back to consulting when they are laid off.

    When employees of chipmaking and software development companies are laid off en masse, (and many of whom have masters degree from USA) where do they do to fall back and file H1 before the grace period expires?

    CONSULTING.

    To say that US masters degree holders dont need "Consulting" is the most stupid comment I have ever heard. Also, how important you are to this country or tech industry is to be decided by your boss and your employer. Not by what degrees you have in your resume. So by saying that "We have masters, we deserve better" isnt really going to jive with reality. People get masters degree mostly because its a stepping stone to H1B, just like H1B is the stepping stone to GC. Very few people do masters because they want to learn hi-tech stuff or to get better education.

    My comment that you are criticizing was response to such post that said "Durbin Grassley bill is good for US degree holders because we really dont need consulting". Well, you very much do need consulting.

    Also, I am seeing lots of grad students and masters degree holders happy about Durbin-Grassley bill. Some of them are under the impression that since they dont do consulting, its good for them since people doing consulting will be out of the queue and that loss will be their gain.

    Its really pathetic. This elitist attitude gets organizations in trouble.

    This whole attitude of "I dont care as long as its the other guy taking the hit" will cause failure.

    I and manish flew monday morning sept 17th on a short notice to attend 11:30AM appointment and then again at 3:30 PM with nagaraj.
    We had 2 more appointments on 18th with NH senators.
    All the meetings were great and one them exceeded 30 minute schedule to 50 minutes.

    It was great to meet all the members like aman, jay, paskal, kanika, meenal, nagaraj, pappu, gopal etc.

    Paskal: Where is my beer?
    Gopal: "Don't shoot the messenger" in the situation room.
    jay: Speech pointing fingure to capitol hill behind him. "We are here on offence".
    Mike: Step1 to step 5 entertainment

    These are some, but not all, of the memorable things in DC.

    I really had to mention pappu seperately.
    He is a dedicated person to this cause and needs special mention. I really enjoyed his company in the bus on our return journey to NH. We shooted all possible questions and got convincing answers.

    Thanks again for the wonderful experience.

    OK I'm from RAW EB3. PD Apr 2003. 140 and 485 were filed concurrently in June 2004. I 140 was approved in 1 week (I guess because my son was aging out) and I-485 for all family were approved in June 2007.

    Lets look at Rep. Smith - Reclaim American Jobs Caucus | Congressman Lamar Smith (http://lamarsmith.house.gov/Issues/Issue/?IssueID=14781)
    he is against amnesty and for border control.
    --> the cir menendez bill has all the border control provisions that the republicans want (in fact, it is entirely what they want) - so one issue is addressed.
    --> illegal immigrants who are already in the country - record number of them have been deported in the 2 years under this administration (more than the republican presidents in the past!), trying to deport them all will take billions of dollars (which the govt does not have - or will it be charged on the legal immigrants?). Yes, one should not support lawbreakers, but just saying that does not solve the problems......what proposals are there that will address the illegal immigrants? nothing.
    the talking points are:
    border control, we are against amnesty. NOT GOOD ENOUGH. Provide solutions, if not a path towards legalization with due fines, what alternative do you suggest?

    Frankly, I have not yet heard any noise being created regarding H4s converting to H1s and joining the workforce, legally.

    If someone who came here on an H4/F2, upgrades their skillset via formal education (no issues in this case!) or via professional training and the ability to fake experience and sell it to land a "project" (no legal issues here, only moral issues and hats off to their guts.. How do they do that??) then they absolutely deserve to be in the workforce.

    There is a lot of noise about H1Bs but most of it was focussed on Indian IT giants locking up the H1Bs by the 1000s and (in the anti-immigrant lobby's words) "bring in cheap labor from India". Another blemish brought about on H1B is "gross exploitation of systemic loopholes by IT consulting companies (mostly owned by Indians) ". These issues are being addressed by USCIS by increasing scruitny before issuing new H1B approvals.

    If your company has played by the rules, your credentials are not flawed, there is very little to worry about.
