mdforgc and other PERM gurus,
Please help.
I am in the process of filing PERM. Ads have been placed etc and all the
formalities completed. Now, we are at a stage where the forms have to be prepared, signed and submitted. However, i am very unhappy with my attorney. He is unethical and i am afraid he will screw me up. So here are the questions
1) At this stage ( not yet filed PERM) but on the verge of filing, is it possible to change attorney or is the job order etc specific to the Attorney.
2) In form ETA -9089, in the Alien Work Experince section, it says to give the name of the aliens supervisor and the employers phone number.
MY attorney says this is not required. Any thought on this. Did your forms mention this ?
3) I am afraid my Attorney will deliberately mess up the form. What should I watch out for in the form before signing on it ?
4) IS there any redressal system at all in this country for Attorney Malpractice ? Anyone taken this route before ?
Guys, please help me as I have to take a qucik decision.

The first step you should get your employer to do is to file a job order in the state job bank or americas job bank. You have to keep this ad for 30 days and then wait another 30 days to file PERM. This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Please contribute and incrase the membership of IV for the good of all of us.

I talked to NSC (using POJ method) and got hold of IO (I am pretty sure it was not the call center representative). He told me that my file is pre-adjudicated and it is on the way to Agent's office for final review. I think that many files are stored at off-site location and are brought back as needed / pd becomes current etc.
He said that all he can do is to wish good luck. I asked him if I will get GC this month or no? He replied that it all depends on how many visa number will be given to them by state department.
It's only day 2 but I feel that they are approving what ever file they have on their hands on. Feels like I will miss this boat too.

Well, If people can also add a post, if they are current due to upgrade, will be helpful to get an idea on the impact of porting, as mentioned in VB, it seems to have a greater impact on dates movement.

My AP was approved today. My PD is current. I am not sure whether AP approval according to USCIS means, I would not be getting my GC.

Now a general question : for kids of 5 or 8 year old, the application should have their 'thumb print', right? It does say "thumb print of applicant or legal guardian", but I see no value in signing for them - there's no way to identify the child if I sign there... Or am I missing something why it's better for me to sign? (There's two places for signature/thumb-print : to sign for the application, and also at the 'specimen signature' spot).
If they write thumb print then you can always provide it. Infact, it is there so that even the old people who cannot write can give their thumb print. So it won't hurt. Also, it looked to me that they are not too picky(like USCIS).

I am happy that this thread is live again after 2 years (I started this in 2008).
Thanks for starting this thread. The next 2 years should be the right time to pursue this I feel. With EB2 approvals picking up at a good rate and the good predictions by qeshmk, TeddyKochu etc in other threads, it gives hope to many of us. Hopefully our fellow EB3 friends also get their approvals by mid 2011. Given the recession in '07, '08, we don't see too many new apps files for ROW in that period, so hopefully we'll have some spillover again in FY'11. That should help both EB2 and EB3 categories.
Having said that, this will be the right time to purse this agenda...Many of the folks suggested, counting date for citizenship from I-485 receipt date or I-140 receipt date. If you google 'Backdate GC', we can see that many other folks in murthy, rajiv khanna forums are also talking about this. So, we might have enough members to pursue this further. Many of us have been here close to 10 years (Me from 2000 on F1, OPT, H1B etc). Its only fair to have some of those years counted towards citizenship.

As every one here knows, the visa movements based on how many LC approvals in a perticular period but not based on the previous analasis. After PERM is introduced, most people started applying in EB2 than EB3 because of many reasons.

I think those who are eligible to change to Eb2 should start immediately. In any case Eb2 was much better in past and it will be in future also as all the other country quota EB1 and Eb2 will automatically come to EB2 India and China every year. All the Eb3 should wait 10 years or hope for some law change.

I agree, a phone call or meeting in person will be much more effective if we can do that. And this situation definitely needs such attention. If one can't get time for this effort, he/she has no right to complain about it.
I think we need a good strategy to fix this and I believe any problem, with a good strategy, can be solved in reasonable time.
To press right buttons we need following
- Separate legal employment based immigration delays issue from other issues like (family based, J1, H1 etc.) Not that other issues are less important but diluted efforts won't we won't achieve results. SO concentrate on just one issue and press for it. For now let's just talk about those who are waiting for over 5-7 years for their green cards.
- Don't ask for CIR, increase/decrease quota or any change in existing laws but a swift one time executive order or a temporary introduction of a new law or something like that. Totally separate from current immigration law one time fix to existing problem.
- Immigration reform - you can do what ever with it whenever. We have a problem here we need a fix.
- Try to communicate this issue with your local media. Letters, phone calls, meetings can help up to certain extent but media can put issues on fast track. Long waits, restrictions in making life & family decisions and personal freedom are issues well understood by this country and these are the reasons why we are here. If you communicate these issues correctly everyone will understand. Put your story out on local news paper / radio. Get a local group set-up and get with your local cultural/ethnic group leaders who are enjoying their citizenship and freedom and ask them to get involved.
Let's get results, one step at a time.

I wish this goes forward .. Plan B, I think SKILL BILL (?) must be put in to thought.
