After reading the post on this thread, I am sure I must have fumbled something. Please read and advice
1. My wife came here (USA) on H4 visa in Dec 2005, got 1 year.
2. Applied for H1b in May 2006
3. Applied for H4 visa renewal in June 2006
4. H1B got approved Sept 25th
5. H4 got approved Oct 21th 06
6. Applied for SSN Jan 1st 2007.
7. Since SSN#, she is working
Is there any gotcha or issues that we might have created in between?
Is it a good idea to get H1b stamped from Canada?

That brings up a good qn.....Is there going to be any "official" proclamation of the death of CIR, if and when that happens?
Or is that supposed to be implied when everyone stops talking about it.
GCKarma,
How do u know that CIR is dead..? I could not any information on the link provided.

Congratulations Mr and Mrs Gupta and thanks for sharing the details.
Just curious, did u got any emails ??
Hi guys, Just wanted to post an update here. Me and My wife got our GC's in mail today. Our PD was May 19th 2006. Interestingly there is no update on my case online. I was very anxious and refreshing the case status page every few mins for the past few days but to my surprise, my case was approved on 5th of May and i have the cards in hand now.
Keep your hopes high and have patience. It could just be that USCIS has stopped updating the online status and started working on our cases(Wishful thinking :))
Good luck to all who are still waiting and congratulations to all who got greened!

Thanks for trying to keep the focus on the solution.
I like pursuing option 3 and 2 at the same time. We don't know if option 3 requires a law change so need to clairfy that. While we prepare the slides/etc I think we should contact USCIS first and while working with them educate the law makers on EB3 category based on the points similar to below.
The fact that EB3 category requires less experience than EB2 shouldn't be looked at as EB3 applicant is less skilled. Infact I have applied EB2 twice and now in EB3 and I do have US masters and 10 + years US experience. It all depends on company's attorneys comfort level.
It shouldn't be viewed as we are taking visas away from EB2. Infact we are requesting realisitic approach to the skill sets. Instead of EB2 Current and EB3 at 2001, EB2 can be couple of years ahead of EB3.
We can come up with many ways to explain the injustice but it is time we ACT. I am with you on this.
Lets not get sidetracked by Mr Skillz with a Z.
Options for EB3I relief:
Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.
Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

Very true.
I think Americans have to decide.
Do they want to work with Indians/Chinese in America?
Or do they want to work with Indians/Chinese in India/China?
Their choice :)
Protect everything. Protect all the jobs. Drive all the high-tech jobs out of America.
And then either become a lawyer, or go look for a job in India/China.
What those laywers will do without people and cases? Remember that their jobs cannot be portable as the law of land is totally different in other countries :D

What USCIS did to the other worker category in June was clearly a violation of Federal regulation (8 CFR Section 245.1(g)) - however since the numbers were insignificant, the violation went unnoticed.
It goes without saying that AILA will file a federal law suit seeking immediate interim relief, if the USCIS does this again...
The repercussions of such a law suit will be worse for the USCIS and very good for the filers. If the judge grants interim relief, that will mean USCIS cannot close the doors until the law suit is settled...USCIS is probably already aware of this possible repercussion and will most certainly avoid this lawsuit situation...
There are an estimated 250,000 (primary) filers expected to take advantage of the July visa bulletin...a number that is hard to go unnoticed...

No. It was changed in the middle of 2008. The DOS consulted with the Congress on this and came to the conclusion that there should be horizontal spillover before vertical. I don't want to go into whether this was right or wrong, fair or not. This is the current policy.
You can see ample evidence in the annual visa allocation once you compare 2005/2006/2007/2008 allocations. EB3-ROW and EB3-ICMP benefited till 2007 because of vertical spillover and EB2-I & EB2-C have been the beneficiaries of the horizontal spillover policy since 2008.
Thanks. I also do not want to drag us into that direction. Just for the sake of my satisfaction, may I ask to you or anybody here to put any link/doc for any memo or other USCIS doc which states this?

Susie, I can say quite strongly that IV's agenda is quite officially
"H1B quota is not an issue that we wish to take any sides on".
We are trying to reduce the backlogs as a primary goal.
The main aim is to reduce the backlogs which will also reduce the age out problem, but not fix for those already aged out. Believe me, even if this was the only issue on the agenda, it is hard enough to get this done.
If we don't fix the backlogs then age out will be irrelevant. Let's imagine that H1B quota is increased, and EB3 ROW never becomes current because of more H1B ROW newbies. Then EB3 India will never get any spill over. In this case new India EB3 applications could easily have a 25 year wait, by which time the primary petitioner will have retired invalidating the whole application. Thus you can see that increasing H1B quota works against us (although the official position is no position).
I am considering computer modeling this, because I think that the a 25 year wait is very possible with the current scheme (making age out easier to push maybe).
If there is an opportunity to provide ago out protection without risking the main aim then I think that it will be taken. First we need a seat at the negotiating table.
Until we get a seat at the table we have the trade off between raising age out complicates things, and raising age out keeps it personal. There has been some debate over the, I think that the professionals recommend "keep it simple".
My position on this is to raise the age out and other family issues like US citizen children being forced to leave because their parents are. But only raise it with those law makers it will clearly be received well with, and not be a distraction.
There are other issues worthy of targeting, but they too complicate things, and risk us not getting a seat at the table. For example banning consulting. This could force many to leave, including their children, through not fault of their own. I think that consulting should at very least be grandfathered, and have some other exceptions. But again pushing that would be a distraction.
As I said, if we get a seat at the table, this issue has a chance.
We are currently working on getting that seat.

2) Remove the country limit
3) Capture the unused Visa
Thank you, Totoro for leading this effort. My suggestions are same as gc_dream07, but I would like to reword the suggestion
2) Remove the country cap for employment based immigration (the argument we should put forward is that when it comes to employment based immigration the deciding criteria should be individuals skills now where the individual was born).
3) Capture the unused Visa (Green Cards)

Can't pick stocks in this Volatile market, but one thing is certain the markets will be volaile for some time now. So I suggest be long Vega. Pick a stock where the implied vol is higher than historical vol (you will find plenty. Eg C) and put on an option straddle. Sure to make money.
This is not a day trading strategy but a derivatives trade.
I can post a few breakout runners in the AM but would like IV core's consent to do so. I can post runners in the chat so its faster and easier
Once I get a go ahead I will post some
I strongly suggest to WATCH WATCH WATCH the trades and not jump without knowledge of the trades.
Again make a portfolio on google /yahoo or any other portal and watch the plays . Keep an eye on the volume / News of the trades.
Just a side note :
SAY - Satyam went into the dumps from 12 to .01 IN 2 WEEKS . NYSE dint trade it for 3 days . Today it opened again at 1.10 ---hit bottom of 0.78 and high of 1.77 .
So a PDT watches for these breakout . If any one entered this stock at AROUND 1.00 earned anywhere from 50-75% on it.
Why did it rise ?? Market plays on humna sentiments ...early morning news broke out that there "MAYBE" a govt bailout. sending SAY skyrocketing.
Traditional investors may differ from my opinion....but then This is not for traditional investors sorry!!!!
If you ask me ....I suggest just use your disposable income ONLY STRICTLY to play to learn . Start with as low as maybe even 500 bucks .
Initially just play on the portfolio without money to see how you fare. As you learn you will be more confident

1. After Green card, how long do i MUST live in the same state where Labor was originally issued?
2. What are the advantages of AC21 after 180 days for Green Card move prespective?
3. What are question expected in Green Card interview?
4. How long does the EAD typically takes these days after I-485 filing?
Please search for forums on this website on EAD, AC21. There you will find a lot of dicussions and answers to all of your question. People would appreciate if you search rather then starting a new thread

Ok now back to the basics
I have noticed that a lot of stocks that are worthless are pumped and picked by phony sites ....You might even be recieving spam emails asking you to watch certain trades.
Put them on a separate watch list since most of them usually spike for a bit and settle down ...What a DT does intelligently is to watch the spike and "Short" it when it starts sliding back again
This needs a lot of patience to learn and experience...so I suggest you not to trade in them for now and watch the plays.
Day Trading is like riding a bicycle , I believe , When you dont know how to ride it , even a straight road looks like a uphill task but as you learn and have more control over yourself....You start riding and with experience also know how to avoid the pot holes but most importantly how to get out and balance your self if you ever do land on it.
And then there are the ones who do Stunt tricks like Wheelies and back riding .......Thats what attracts novice to riding but you cant do that the first day Can You ???
