    For new members:

    The following are some of the items on the Agenda (someone correct me if anything is missing/incorrect):
    -Re-capture of unused visa numbers
    -Removing country specific limits
    -Not counting dependants in the visa number count
    -STEM exemption
    -Allowing people to file I-485 and get EAD even when their priority date is not current.

    April 4th and 5th, 2011: Advocacy days in Washington DC

    April 30th, 2011: Deadline for pushing forward with the Initiative to file I-485 even when PD is not current.

    One of the items in the agenda for the April 4th and 5th, 2011: Advocacy days in Washington DC is "-Allowing people to file I-485 and get EAD even when their priority date is not current." but the deadline for voting on this is April 30th, 2011.

    Am I reading incorrectly?

    I am in EB3 and PD is nov 2003. I am eligible for EB2 and I am feeling sick of EB3 and would like to port to EB2. Is it good idea or not?????

    Excellent Idea. Do it fast. My company(in top20 on Forbes list) wont do it.

    I may be completely wrong but this is what I see on thomas.loc.gov


    Appended to the Minimum wage bill was SA187 which amends SA112 sponsored by John Kerry and consponsored by Sununu, Snowe, Landrieu and Lieberman.

    Senate Amendment SA 187 seems to have passed with unanimous consent. This is what it apparently contains among a lot of other stuff... Please correct me if I am wrong.

    SEC. 1601. ELIMINATION OF EXISTING BACKLOGS.

    (b) Employment-Based Immigrants.--Section 201(d) of the Immigration and Nationality Act (8 U.S.C. 1151(d)) is amended to read as follows:

    ``(d) Worldwide Level of Employment-Based Immigrants.--The worldwide level of employment-based immigrants under this subsection for a fiscal year is equal to the sum of--

    ``(1) 290,000;

    ``(2) the difference between the maximum number of visas authorized to be issued under this subsection during the previous fiscal year and the number of visas issued during the previous fiscal year; and

    ``(3) the difference between--

    ``(A) the maximum number of visas authorized to be issued under this subsection during fiscal years 2001 through 2005 and the number of visa numbers issued under this subsection during those years; and

    ``(B) the number of visas described in subparagraph (A) that were issued after fiscal year 2005.''.

    SEC. 1602. COUNTRY LIMITS.

    Section 202(a) of the Immigration and Nationality Act (8 U.S.C. 1152(a)) is amended--

    (1) in paragraph (2)--

    (A) by striking ``, (4), and (5)'' and inserting ``and (4)''; and

    (B) by striking ``7 percent (in the case of a single foreign state) or 2 percent'' and inserting ``10 percent (in the case of a single foreign state) or 5 percent''; and

    (2) by striking paragraph (5).

    (b) Preference Allocation for Employment-Based Immigrants.--Section 203(b) of the Immigration and Nationality Act (8 U.S.C. 1153(b)) is amended--

    (2) in paragraph (2)(A), by striking ``28.6 percent'' and inserting ``20 percent'';

    (3) in paragraph (3)(A)--

    (A) by striking ``28.6 percent'' and inserting ``35 percent''; and

    (B) by striking clause (iii);

    (4) by striking paragraph (4);

    (5) by redesignating paragraph (5) as paragraph (4);

    (6) in paragraph (4)(A), as redesignated, by striking ``7.1 percent'' and inserting ``5 percent'';

    (7) by inserting after paragraph (4), as redesignated, the following:

    If you read closely, it appears like the 290,000 immigrant visas would be true for years from now on and for years 2001-2005 (the diffrence between current limit and this section). If that's the case and if that becomes a law, there is possibility there will be no backlog after that for some time...short time probably. Please correct me if I am wrongly reading this section. But for me, it appears it applies retroactively and will add the diffrence (150k a year) between years 2001-2005. If my calculation and understanding is correct, once this act becomes a law, the first year there would be 290k + 600k from years 2001-2005 ......I am not sure if my understanding is correct. I prey it is..

    why dont you enlighten us all here with your english knowledge. i am pretty sure you are one cockroach who grew up in dirty gutter in some part of the world. You are here in IV just to create controversies between the IV members. Trust me, EB2 or EB3, we are smart enough to recognize tunnel rats like you and keep you where you belong - in the gutter...got it?

    We know for sure nothing is going to happen with EB3 unless EB2 also moves. USCIS will never skip EB2 to help EB3. The law does not allow that. So, the interviewee must talk about the topic as a whole not EB2 or EB3 - no one in America knows what those mean.

    The bigger issue is that not many can speak/write English well and so cannot be sent on TV....unless the interview is on Namaste India or something.

    You have to start all over if you find a EB2 qualified job and also if you qualify for that job,and your prospective employer couldn't find a qualified US Citizen or permanent resident for that job, you may port your current PD at the time of new I-140.

    Hi All,
    what is the procedure to move from EB3 to EB2....My PD is April 2004.
    Can I move to EB2 with the same PD?

    I just called all the offices mentioned.
    Almost all of them seemed to know what I'm talking about and I left voice msgs for couple of the offices and some of them took the msg and mentioned will pass them on...

    Hello All,
    I e-Filed my EAD at the Nebraska Service Center (NSC).

    E-Filed on 04/15/10
    Documents received by NSC on 04/16/10 and had a LUD.
    Additional LUDs on 04/19/10 and 04/20/10

    But after that no news.

    Is anybody in the same boat who has e-filed around the same date or have recievd their EAD cards.

    What is the duration of your EAD ? (I mean for 1 yr/2yr ?) and Is it effective from the date of approval or from the date on expiration of your current EAD ?. Hopefully, this is your last ead as GC should be on your way soon.

    I have told them that Im the only bread earner of the family and the cost of living in the area that i live is very high and that I have bills to pay. But they have denied my request. i dont know what other financial hardship should I show them. Maybe I should declare bankruptcy and then send that over to USCIS to show that I really have financial hardship.
    I have infopass appointment on 14th I will try to raise the same issue again and see what they will say

    Have requested the same thing, lets see hoe it goes. How long did u wait before u opened the SR. I hope u wont mind sharing.

    We started the recurring contributions system Monday night and we sent out emails to 8400 individuals in addition to posting on this site.

    Out of 8400, we have nearly a whopping 35 people signed up for recurring contributions. This is below the lowest of low expectations.

    There is such a thing as Timing.

    We all know that contributions reach peak time when Immigration debate is on CSPAN.

    But what most people must realize is that when the bills are debated on the committees and floors, its too difficult at that later stage to make difference.
    At that stage first of all you need a sponsor for your amendment, then you need the majority/minority leader to allow floor time for debate on that amendment and then you need votes to get the amendment passed.

    Getting things done before committee level, in the original text requires action now, NOW IS THE TIME, when you dont hear about immigration in the news, but behind the scenes, things are happening.

    So if you are holding on to your contributions until you start seeing debate and action on the hill, chances are that it will be late at the time and then those funds cannot be translated into usable resources.

    Things take time and planning ahead of time and working ahead of time is something that highly skilled professionals must value.

    If we start hearing rumours of layoff, we start looking for jobs...right? Or do we wait until we are actually laid off and on the streets? Why cant we be working ahead of time when it comes to this organization's efforts??????

    What is your message to core group?

    Its the call of overall 8400 membership. Perhaps the membership, with its slow response, is sending a message that core group is wasting its time doing all this and we should shut down and go on with our lives. If that is the case, then that is fine too. All these efforts of maintaing the website, travelling to DC, maintaining the relationship with our lobbyist and a half a dozen allies....all this takes time and energy. If we dont have support then I guess the core group is the most idiot group of half a million highly skilled immigrants wasting its time.

    One way or the other...I guess we will know in the next month or so.

    Yes you are absolutely true..... We must have the luck factor also...

    As in my case, my PD, RD, ND and BD (BD aka Birth Day also :) ) all are well with in the current processing time frame and still waiting for the mercy of Lord USCIS.

    I am also in the same boat ...If they put up a notification ( assume on Monday ) will they accept the petitions which came on monday ...any idea how they handled the "Otherworker" before 6 june date ?

    Actually I saw an improvement for 03/20. 6 approvals for that day then it's back to no approvals.

    Looks like approvals has slowed down further.
    This is why at the end of the year there are unused visas. All due to inefficiencies of USCIS.
    We are doomed.
