EB1 is the brightest not in all ways. If you are a manger in outsourcing company and in one more country u still qualify for EB1. It does not take long to become a manager in outsourcing companys. So how u can break the law or tweak around it works. I know people who were on bench life long in consulting companies in EB2 got GCs.

Yes you can do it. But the best way is to go to your home country and apply for a new H4, using your spouses H1 and paystubbs...I just have a friend who did this.....Having to transfer from h1 to h4 here in the usa may be risky, since USCIS will ask for paystubs, but back in india or your home country it will not be a problem.

Some one in Kennedy's office is hell bent on getting rid of paragraph (5) in there....
paragraph (5) is the one that gave us the 'soft' country limits...

I got Card Production Ordered mail for my EAD yesterday (08/12/08). I e-filed on June, 1st and gave finger prints on June 26th. I hope I'll receive my card by Sep, 24th which is when my current EAD expires.
Hope you guys get approvals soon. Couple of my friends also got approved on 12th.

I think CITIZENShip years Credit or Reduction in the years is Make most sense for the highly skilled immigrant from India and China as those are the people who suffers most because of backlog and name check.
I also think we should stick to the "five year federal taxes paid" beacuse that is what they expect from normal family based GC holder. Also adding Masters and Higher degrees in the STEM fields attract possible more support.
We should not talk any where close to 10 /15 years waiting time as that is not what current system of citizesnship talks about.
Also marriage based GC already has 3 years after GC rule so it may beeasy to get it.

Bring the border control, and add in tough enforcement on business that hire illegals - and then you still will have to address the people who are still here illegally. It may not be 12 million, but millions will still remain. That issue has to be addressed. The current president has said that they are to be a given a "path to legality" - pay the fine (yes, it may be trivial in our standards, but not theirs) and get in line. It is not blanket amnesty either.
Yes tough border control and employer monitoring should be there. Progress on the second is improving , a bit slowly.
Yes I am ok for a path to legality, but from my previous post, only if all of them are accounted for and have background check, get all their finger prints, retina scan, and at least 1/2 would get deported with criminal backgrounds.
We cannot have 4 million legalized and 3 million criminals hiding in the background. Also as CIR says only after the border is 100% secure, else you will have 10s of 1000s jumping the border everyday when this bill is passed.
Well the illegals kids also already got citizenship/amnesty in the millions.

There are about 30 million Mexican immigrants, in the US, probably 15 million legally present. Most immigrant in EB3 from Europe and around the world are also affected.
There are probably about 30-40 million people or more Citizens/ GCs/immigrants , from retrogressed countries in the US..

After doing a conference call this weekend, we think we should close this thread. There are not enough people for us to consider a large public campaign. However this does not mean IV is not and will not be working on this fix. This fix has been a very important fix for IV for several years and we have it in our legislative and admin fixes agenda. Those that came for the recent advocacy day event know that it is a key provision that relates to our quality of life concern. Every other legislative fix we are trying is also tied to I485 filing. We advocated for this fix in our just concluded advocacy days and will continue to do so in every opportunity we get. The purpose of this thread was misunderstood and people thought IV will only work on this fix if there are 5000 votes.
We were at the time of starting this thread considering a possibility of launching a campaign like http://immigrationvoice.org/forum/forum16-iv-agenda-and-legislative-updates/17157-deadline-march-1st-target-25000-letters-can-we-make-it-happen.html when the timing was right.

It will be counter productive to your own cause and the overall effort we are trying to do. This also applies to people who have filed I485 and do not wish others to be able to file I485 because their own application might be delayed or some other reasons ( Here is one past example . We are going to adopt a zero tolerance policy to such people when we come across. If there are any such narrow minded people for or against this fix, they are free to cancel their recurring contributions and find their own ways to get their I485 fix done or oppose IV's I485 fix effort.
For people who have voted and want to work on this fix, please contact the leaders of this initiative ashwin_27 and starsun. There is a google group where most active members share their views. The entry to the google group is restricted and the leaders will have to speak to each interested person before permitting access. No one knows dick about PD movement. EB3 filers think that somehow EB2 PD gets stuck or even retrogress and EB3 PDs race forward to 2003/2004, through some delusional logic. Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.

1. You stopped worrying because you got your EAD at least.
2. USCIS is not asking to prove relationship with your great grandparents every time you go for H1B extension
3. You don�t need to worry about the VO at POE or consulate and not postponing your India trip for 3-4 years now.
4. Even though you are on project and pay roll is running, paying the tax...don�t lose your sleep over what memo comes next before the next H1B extension.
Our people are not worrying until it strikes them. Till then they will ask all sorts of questions and have attitude of why should I donate. You can see now and then a thread on IV - Help urgent, I-485 denied, H4- denied.

But what you understood from my post is entirely wrong, and I have to explain why, because if this is the misconception you are having, not about me in particular but everyone who is not involved, then it definitely needs answers.
As I already clarified, I had stopped worrying about GC, long time ago, not after getting EAD.
I bought a house when I didn't even start my current GC process.
I went to India (Chennai) in my 7th year for H1 extension stamping (after completing 6 yrs of H1 and before I even filed 485). I didn't postpone it till I got EAD.
I left my employer who had filed for my labor in 2004 because he started acting up at the end of my project and started GC process with new employer well into my 6th year.
I do understand some people run to IV only in time of need. But all I am saying is not to paint everyone with same brush. Even if you think about people who want anything to do with IV only when there is need, lets try winning them over rather than stating the obvious and ridiculing them.
