By the way here is some info: may be helpful for some.
My officemate applied for 765/131/485 etc on 6/26/2007 to Nebraska.
He checked his online bank stmt.
His checks got cleared today 9/6/2007.
Check had SRC numbers on them
USCIS case status site, for that case said "your case is in texas!"
He is happy.
That gives me a hint that my case may move to Texas too, who knows and that if my submission was done on 7/19 I should expect my checks to get cashed by 9/30/2007 MAX....

if processing time dates are as per notice date, then i assume USCIS might have not entered all application during July 2007 before July 15 since they reversed the july 2007 bulletin. If they are processing by notice date , then how come they have processed earlier dates of July cases during last year for EB2 PD 2006 cases.
This is so confusing. Could it be they are processing cases by receipt date (not notice date) since it took almost 18 months to move processing times to Aug 15. If it had been processing by notice date, processing dates should have been showing Spet dates.

You are looking for a software type precision in this manual information system. For monthly processing dates publications, perhaps boss asks IO's to provide info on where they are. I humbly feel that the days of prayer and petition ALONE may not work . I agree with the suggestion for a rally. I would also like to know if we can mobilize about 100,000 people and stage a 24 hour hunger strike in support of visa recapture. If it is legal and permitted, we can. In case anyone feels it is not correct, please tell me. Advance apologies!!!
Can we also suggest a $5000.00 fee for every visa recaptured and given to us with a ceiling of say $12000.00 per family? Does this sound ridiculous? I am sorry again. May be this will have some impact. What do you all feel please?

btw..Multiple Visa to Canada = Single entry visa to Canada (if you are traveling from the US). Just that single entry is max 6 months and costs less! I have made some 15 entries to Canada on a few single entry visas.

I think they are processing concurrent I-140's and I-485's but only for people whose PD is current. I have seen lot of approvals for EB2 folks both for I140's and I485's here on IV and on . I guess only us EB-3 folks are not getting processed ( maybe some EB2 also ). But mostly its EB-3 which are in cold storage.:(

As you are all aware the immigration environment in congress has been very hostile. DREAM could not be passed and AgJobs appears to have been withdrawn. This is despite the fact that these bills like skilled immigration reform have the support of a majority of senators and HR members. The Nurses provisions have also been dropped from the HHS bill despite having passed unanimously in the senate.
With this in mind IV is continuing to pursue every possible way to get relief this year.There are yet several appropriation measures to pass and an omnibus bill is likely in December. Even though the chances of a large bill like SKIL are very low, there remain opportunities to get various pieces of reform for skilled immigration in these bills. Our lobbyists are working on all these opportunities. We are also making efforts to get administrative relief in the meanwhile. Details of these activities remain sensitive at this time and cannot be posted on the open forum.
The IV leaders group would like to emphasize the importance of building our grassroots strength, which will prove critical if any measure were to come to the floor. For this we must have strong and functioning state chapters and motivated members who meet their lawmakers and apprise them of our difficulties and of the possible solutions to this backlog quagmire.
Joining your chapters (not as anonymous members!) also allows you to gain access to more frequent updates from your leaders and creates a sense of community with other active volunteers in the same position as yourself. Knowing that others who are similarly stuck are working actively to solve the problem is an invaluable motivator.
The name check issue has also been pursued and several legislators are looking into this. Congresswoman Clark has introduced a bill that we will follow closely. Premium Processing remains an internal USCIS issue, at this point based on their statements the only reason for it's suspension is lack of available resources. We continue to engage with USCIS and will offer you all opportunities when available to ask questions of them.
Please join your state chapters and take part in local meetings and activities now being organized. If there is no state chapter where you live, start one...or join with a neighboring state. Remember always, there is no stone and brick "IV" and no IV "army" or "employees" waiting to fight for you. IV is nothing but you and me. If we fail to help ourselves, then we will sink deeper into this retrogression mess. Please volunteer actively, out of self interest and to better your own lives.

can you share the format of your client letter? I have been looking for one for my upcoming amendment. Thanks in advance
I got my h1 extended for 3 years(after 6 yrs) with approved 140. My employer->vendor->client is the hierarchy. Provided the client letter and vendor letter.I dont think they provided any contract details.Applied in PP, got approved in 4-5 days. A big relief. Dont worry about the Employer-Employee relationship memo too much. My client letter and vendor letter state that my employer is completely responsible for supervision etc etc.HTH

It really depends on the person's situation.
In my case, my husband will have his H1 invalidated once we travel outside the US because we won't do H1 stamping so my husband's EAD will have to be used upon our return to continue working for his company.
cheg please read subbu's post carefully. EAD has nothing to do with entering the US. To enter the US, you either need an H1B stamp or AP. Even if you enter on AP, you can still use your H1B to work in the US. However, once you use your EAD to work, your H1B becomes invalid and the next time you enter, you HAVE to use your AP.

I watched the entire webcast of the hearing...thank you very much for the link.
It clarified few very important issues:
1. Processing of I 140 is not happening FIFO, as mentioned by USCIS: it is happening based on whether priority date is current or not. So the cut off date mentioned in "processing time" is not valid as such, but may give some idea.
2. Visa recapture may provide some relief, but not very likely to provide "huge" relief. However, both USCIS and DOS appeared to be favoring the visa recapture policy.
3. Very interestingly, per country quota issue was brought up, and DOS thought that it would increase the workload too much. Looking at the current numbers, that may not be as bad as they think; but they are the experts!
With the spill of usused EB2 ROW to India and China, indirectly, per country limit sort of gets overcome to some extent any way.
Future of EB3 remains uncertain.
The most interesting fact that I did not know: More than a million GCs are approved each year and only < 140k are for EB immigration. In other words, > 86% of GCs are issued on family basis or "no limit" categories. I do believe that many of the US citizens, politicians and media would have no clue about this fact... Why is there so much of oppostion of EB immigration which brings talent to the country while it accounts for < 14% of all legal immigration!
Loo Dobbs must cry on non EB immigration!!
