Wanted to ask if the sporadic reports one hears of unexpected delays in H1B stamping at US consulates in India due to "security checks" (link to NPR story) are becoming more the norm rather than the exception. Any ideas?
Should then one consider using their AP instead?

No disrespect to any programmers here but IT is unlike any other engineering sciences. Logic is what drives programming and syntaxes and stuff can be learnt pretty quick. Engineering on the other hand required good bit of understanding about the principle/theory especially if you are in designing or even manufacturing. It is lot easier for someone with B.A (Bachelor of Arts) to start programming than engineer. But ofcourse a car mechanic can come up with a cool invention after years of work but then he was understanding the principle of engineering and design in the process and has become a self-taught engineer. I bet no one here would like to drive a car whose power-train is designed by a professional from a non-engineering back ground who got on job claiming to be a engineer, would you?

IT has moved from mainframe to desk top to client server to three tier to web based to SOA to cloud computing and god knows what in the future...All these in the past few decades...The tremendous amount of change that one needs to keep abreast of, is what makes IT, in my opinion, a challenging field.

when you apply for H1 ext beyond 6yrs you should send them proof like I-140 approval copy. Did you do that?

The drawback with online petition method is that its not reliable enough to make an impact on lawmakers. You only have names of people.

Marlabs is not really bad; I think it is far better than many other desi companies. But it is also possible that they may not provide labor or i-140 documents. But if you have good relation with account manager/recruiter then the issue can be resolved.
One point needs to be accepted here that everybody(employer and employee) is playing survival game here. Try to talk it out to resolve it, it will surely work. I have seen and heard about companies which are much worse. Marlabs doesn't fall into that category, its my personal experience.

I had a very unfortunate incident recenty. I relocated to a new city after I-485 filing. I banked on postal department mail forwarding service to forward all letters from USCIS to my new address. I was unfortunately proven wrong.
My I-485 receipt and FP notices were sent back to USCIS by the postal department as undeliverable. Then I went ahead and changed my address on the USCIS website. So these two notices were sent again to my current address by USCIS. But in this mess up I missed my FP appointment.
On the FP notice it is clearly written:- "If you fail to appear as scheduled, your application will be considered abandoned." Is it checkmate for me? Or do I still have hope?
I tried to call USCIS, but getting blocked by answering machine. I want to speak to someone from USCIS offices. What is the quickest way to reach a representative?

My wife got an RFE last week too saying that they do not have the Medicals. Quite obviously we had done the medicals and sent it during the July 2007 fiasco. At first I thought her lawyer may have screwed up, but seems like many people are getting RFEs for medical even though they had sent them in.
Looks like USCIS in their hurry to meet their numbers prior to some deadline wants to atleast send out RFEs so that they can officially claim that the cases are on hold pending eveidence from the applicant. Sounds like we all have to suck it up and do the medicals again.

Still 575,417 I-485 applications[includes all the category] to adjust status are pending as of March 2009. With this huge back log, EB-3 won't become current with in this year is almost not possible; even it's applicable to EB2 also. However let's hope for the best!

No sir! Been there, done that and my wife was not out of status. If a dependent's H4 visa obtained while you are working with a previous employer has not expired, there is no need to obtain a new H4 when you change employer.
Just curious, no offence intended.
How do you know your wife was not out of status if you were in a similar situation?

Another Brilliant Idea:
If we all start farting a lot, it should definitely increase the level of Green house gases like Methane and Carbon-Di-Oxide in atmosphere. This would cause America to warm up at much more higher pace than Al-Gore predicted. I-485 applicants from colder countries won't be able to tolerate the heat caused by South Asian farts and subsequently withdraw I-485 making all EB categories current.
So all, lets get a can of black beans tonight and fart all weekend. Alternately lets eat at Taco Bell.

This is a follow up to the thread I started in October: "I-140 approved, I-485 denied...Please Help!!!"
I have to start with this: the Nebraska Service Center's director is known to be a "MEAN" one. In 2006 I sent my 8 pounder first I-140 RFE response on time. Someone in Nebraska lost/misplaced my file. It is only in 2008 that we found out the case was denied since 2006! That is when I had a FedEx receipt faxed to them as a proof. Once they caught their mistake, the liaison was embarrassed...The NSC director refused to reopen my case, all I had left was to to file an appeal to AAO.
In 2009, as you know, the decision to deny my husband's and mine I-485 could not be appealed. I have also never stated the uscis denial reason, as I did not have it when I posted my question. They have stated that we had traveled abroad without Advance Parole, so they were considering that we have abandoned our GC petition. We came back to the country with my O-1 visa and my husband O-3.
The first problem raised by a friend of mine lawyer (I did not have a lawyer retained anymore) was that uscis violated my constitutional rights. They SHOULD have sent me an official letter back in August stating that they were reopening or intended to reopen my 485 case! Nothing was sent. Beside my I-140 and my RFE on the I485 I did not receive anything else. So even if legally they were "right" to deny my 485, uscis has commited SO many mistakes on my case that I have been told they could let it slide on this one.
From that moment on I have decided that I will fight them till the end and that I would not pay them one more cent! Because at the end of the day, it is all about money and more money in their "crooks" pocket. I contacted my Congresswoman, my Senator, and a Congressman from another state than mine. I gathered all the proofs and all documentations for the last 3 years and posted them on a server, so everyone involved could review them. Those three elected officials called them and spoke to uscis congressional liaison.That is when uscis said that they had reopened my 485 back in May 2009 (No mail was sent to me). And I was on tour in Europe and Japan on my O1 visa! Fort this reason they will approve my 485 because I had no way to know it was reopened. They also said that my husband would have to file again!
This went on for two weeks. The Senator's office argued that this was unreasonable she spoke to them for one hour.
Friday November 13th 2009 we received our green cards!
I want to say this to people out there going through "immigration hell" Please do NOT give up!

but i would like to state it for the record.. people will shed a lot more money if there is any gaurantee here..people will shell atleast 10-20K minimum if there is a guarantee that it would happen..

Now you doubt the genuineness of my profile and myself, when I was singing along, I was given the green dots and also the kudos. I even donated. Go and dig thru the threads.
Ab jab mujhe laga ki gaadi sahi raaste nahi jaa rahi hai, to instead clearing that fact you are pointing on my genuineness.. nice I like it. About the person I am talking about who got the Green Card before his priority date, dig in track-it and also this forum, there are couple of other friend of his, who posted the same thing, and also got the reasoning of why possibly that happened.
As long as someone(here someone is ME) is singing along everyone is happy but the moment someone feels something is wrong and tries to raise a voice he is ignored or abused. Why does not anyone stood up asking , why do I feel so, why am I saying so? this would have helped in looking at the cracks and would get a corrective action for that, except for one. You guys are talking about educating and convince Americans who are so racist and cannot even empathize, when I myself sitting on the same boat as yours, who was supporting IV before, now and will keep doing , got some doubts and everyone started to vent out their frustration on this thread.

I understand your concern. Many of IV members know there are some threads not related but H1 is related to GC. As I noticed, you already donated money to IV. Join as Donor and see how the donor threads are going. Admins are really involved in those threads and serious people (about GC) are in better discussions than normal threads.
