Continuing this thread on a similar but not same issue. I efiled my AP renewal for myself and my spouse today. System told me to send the supporting docs to Nebraska even though I live in TX. ( Guess its because my 485 is rotting there). This is my 3rd AP renewal. The issue in my case is, I was able to print the confirmation receipt but I am not able to add them in my portfolio in the uscis website. its says receipt # not found. I have my travel dates confirmed for the beginning of november. Do you guys think that Nebraska will send my AP before that. Dont have a H1 or old AP to fall back. This is my only option.

No you do not have to maintain H1 status. Why don't you ask your lawyer, why in the world would you renew your EAD if the I485 would be denied if your H1 status went away.
Seriously man your company needs a more informed attorney.
PS: A lot of attorney's are trying to exploit the USCIS memo a few months back to create FUD amongst employers to force you to extend H1 instead of using EAD. Your lawyer is probably trying to get your company to file a new H1b for you. Please remember in such an event you will need to travel out of the country to get it stamped.

Again i am not supporting employers keeping a better rate, it is their business if you are not comfortable with them I suggest move on.

I had an AP when I left but it expired in November 2010 (about 6 months after I left). I wasn't in the US anymore so I didn't get to apply for a new one. Plus I was pretty much hopeless about my green card application and din't really expect to receive the card anytime soon.

Shusterman's latest newsletter talks about the chances of CIR happening this year (see quoted text below). From what I've seen so far, attorneys, other credible organizations usually refrain from making predictions. And when they do, they are pretty certain about them.
What do other IV members think of this?

All bills introduced in the 109th Congress, including those relating to comprehensive immigration reform and the SKIL Bill for highly-educated workers, expired in December and need to be reintroduced in the next Congress.
Leaders of both parties including Senators Edward Kennedy (D-Mass), the incoming Chairman of the Senate Immigration Subcommittee and Senator John McCain (R-Az) started plotting strategy for a comprehensive immigration reform law even before Congress adjourned in early December. See

I had the exact same situation - different dates but same essential thing - no stamp, no new I 94 at US - Canada border - have to travel for business.
My attorney has specifically instructed me to put the Canada trip as the last point of entry even though it doesnt match with the I-94.
She indicated that she would attach an addendum on plain sheet of paper explaining this. Try to get this from your attorney.

I am still exchanging emails with the university gentleman who is adamant that I am ineligible. :eek:
I wonder if calling the USCIS would help in this regard. Or if this decision is purely made by the authorities at the University.
Calling USCIS won't help. In my daughter's case I first called FAFSA. Initially the cust rep was not sure about eligibility, but when I directed him to their own website he said my daughter is certainly eligible, but it is ultimately the school who will approve the loan. I strongly suggest you talk to the school and give them the website address so that they themselves can verify. As I said earlier I had to fight for about two months. Remember, most of the school officials do not know anything about Immigration Rules. In case you need help, PM me with your contact number.

When they refer to "legal immigration" it doesn't necessarily mean that they support 'High Skilled Legal Immigration'.
This seems to be one of the very few balanced and sensible views I've heard so far from members of Congress.
My state house representative also responded with a similar message alluding only to "legals" versus the senators who seem to talk and think only about 'illegals'. I think the house of representatives has far more sensible and intelligent members than the senate. Let's hope they kill this shamnesty bill.

1. When I spoke to a well known lawyer, he mentioned that the salary USCIS looks at is the salary at the time of labor approval/I-140 time.... Now if you compare the new offer 77K with the labor/I-140 salary of 55K....that is a 40% jump and is I think dangerous territory!! Any thoughts on this issue??
-- ask the lawyer if there is even a single case he has come across so far where salary increase in AC-21 has caused an RFE or denial. I have seen cases (various online forums) where even doubling of salary has not resulted in problems...

The prevailing wage for the labor position today, when the new offer will be accepted, in 2008 as per the FLC data is $67K....now can we defend the salary up to $68K based on this increase in prevailing wage? Or will the USCIS still look at the prevailing wage in 2005 and say that the standard is 55K??

The lawyer asked me to get me an offer letter with language, "the compensation will be at a minimum $-----" so I got another offer letter from the new employer saying the salary will at minimum be $67K (Today's prevailing wage)........now the real salary will be 77K ....technically this is not wrong because the offer letter says minimum 67K....but if the USCIS looks at paystubs and W2 they will see that the rate is 77K and not 67K.....will this be considered as fraud as far as USCIS is considered???
4. Overall the salary goes up in our industry at about 5-7% a year.....Now the labor was done three years ago in 2005....at 7% annual increase.....can we not defend 67K as per industry norms.......or will USCIS look at the hard line 55K number as far as similar position is considered??
5. Just to avoid complications....I may also accept 67K as salary for a few months and then work out a deal to increase later.....any thoughts...

Take these things as they come. Dont live in future pain.
There a thousand reasons for triggering RFE, another thousand for trigger a NOID (notice of intent to deny).
On the other hand, there are nearly a thousand waivers for getting out of those problems should they arise.
Trying to predict all possibilities and also trying to prepare for those occurences will drive you mad. You will think yourself to death before your 485 is approved. There are people who have gotten GC even after being convicted of drunk driving. Yes, its difficult for them and the difficulties and amount of delays/pain varies from case to case.
And no, I am not saying that "Attend the rally, forget about your pending 485". I believe that at the end of the day, surrogate enthusiams about rally or any other such activity is not going to go very far. My enthusiams and desire for your presence in any action item doesnt translate into your indegenious desire to be active. You can only inspire so much.
Nonetheless, dont kill yourself over these possibilities. Because there are million possible permutations and combinations of things that could happen and studying the CFRs and INA to death wont make any difference. After spending days and days in worrying, you will still be there where you are now in your angst regarding immigration.
