Is there any requirement that how long one should wait before filing for parents GC when they are visiting. Or one can file 131 as soon as they arrive. Group's advise is greatly appreciated.

Hello Va_labor2002,
Thank for positing information about lame duck session from Mathew Oh's site. However, this is not yet a confirmed report yet. The current situation is that everybody is waiting for a decision on the length of lame duck session. If the leadership (in the congress) decides to do 6 weeks lame duck session, in that case we will get an appropriate vehicle for our provisions. But if the Senate/House leadership decides to do a 2 weeks lame duck session, in that case there would not be any bill.
We have a plan and we are on top of things. Also, please know that with your support, Immigration Voice is also growing stronger and we get more update info. But acting prematurely would not help in anyway. Webfax is a very important component of IV�s efforts. IV (and other like minded organizations) are all keeping our fingers crossed, hoping for a decision for a 6 weeks lame duck session.

Generally Lawsuit like this will succeed very rarely. But most lawyers sounds optimistic in current situation. May be lawyers will be optimistic in any lawsuit. It is not known the case is in this kind or it has real chance of success. Wait for a month if possible before taking decision

I distributed some flyers to some people. Most of the people attended the function were US citizens or GC holders and they were not interested in our issues. Some some young H1B guys were inetersted ! Atleast something done better than nothing !
It is a very disappointing fact that people who immigrated here either through EB or FB are not concerned about whats happening with the immigration system.

It is sad that these things happen despite doing everything by the book, and I do hope that the powers that be, do a better job in educating their people in the intricacies of immigration law.
That being said, as soon as I read this, I sent an email to my attorney (a large business immigration law firm), to make sure I was prepared, were I to ever find myself in such a situation.
I have included our email conversation here, if it helps anybody.

I live not too far from the XXXXXXn border, and I find myself travelling to XXXXX pretty often, and I have heard of Border Patrol checkpoints in the area (although I have never encountered one myself) stopping people to check for documents.
In such a situation, what document(s) would you recommend I keep with me? I always have my EAD and Driver’s license on me, I guess I could also keep my passport on me, but the I-94 on there has expired.
Will the officers understand the “pending AOS” situation? From what I have heard on the internet, I doubt that they will, and given that, do you know of any USCIS memo or document that I could carry with me, to provide to said officers as proof of my “authorized stay”?
Is there also a "Lawfirm XYZ" number I could reach in case of such an emergency?
I could definitely use some advice here.

Also, I (am not sure and) do not have I-797C for my I-485. The scanned copy that I have just says I-797. Should I ask my attorney for I-797C?

You should include your I-485 too along with Marriage Certificate.
When I filed for my wife AP, they asked for Marriage Certificate. Once i sent out marriage certificate got AP in a week.
Also, I (am not sure and) do not have I-797C for my I-485. The scanned copy that I have just says I-797. Should I ask my attorney for I-797C?

I went ahead with e-filing, for both me and my wife. The procedure went like a breeze, pretty much as described here (http://immigrationvoice.org/forum/showthread.php?t=18737) (credit card payment option was a plus). I figured because I did not get any FP notice on my I-485 application yet (it is 10 months and counting), this way I can at least "force" USCIS to send us for an FP. I don't care if it is same or different from I-485 FP (as long as they don't bill me twice).
Now comes the next step of mailing supporting documents. I am planning to send "enlarged" b/w photocopies of EAD card (f/b), DL (f/b) and passport pages, instead of color copies. What say you?

1. Form 765
2. Colored copy of EAD (front and back)
3. Copy of current I-94
4. Copy of my H1 approval notice (it has the new I-94)
5. Filing fee of 340 dollars
6. Colored copy of driver's license (front and back)

They couldn't approve enough AoS applications to use all available visa numbers before July 2nd, so they approved as many as they could and simply requested visa numbers in advance for -purportly- about to be approved applications.
As these applications are approved, you'll see approvals. Not saying whether it's legal or not, but this is what's happening.
If you want to raise your hopes based on your silly beliefs, it's totally your business.
Some people just want the information that'll keep their hopes alive and ignore all other.

When I check tracking its giving me info like ' OUT FOR DELIVERY MESQUITE, TX'
it was sitting in Dallas, then routed to KY and now in Mesquite.
Does anyone know what is going on, why Mesquite?

I think a lot of guys will agree with you. I don't see why anyone will disagree. Smaller desi consulting companies do nothing except taking a chunk out of your salary and cheat you in H1/GC process. There might be exceptions though.
As for desi companies going out of business... I think their business will be significantly impacted by this because essentially USCIS with Jul 06 bulletin said everyone who came until Jul ahs a shot at freedom. So very few unfortunate souls (stuck in BEC, Atlanta, bad employer) etc will be still stuck with desi companies.
Lot of guys might not agree with me , Desi consulting companies main thing they are doing is holding H1b , other than that nothing much they are doing. Because of all these EADs they will learn the best business practises and do the fair business. Otherwise they will be out of business. In long run it's good for country and for us also, only genuine companies will only survive.

Sometme back, DOS official indicated to IV that demand data is being released regularly to help us analyse the numbers. It is good that Department of State is releasing this information every month now before releasing the visa bulletin. Let us hope that this continues and we see improvements in transparency from both DOS and USCIS.

how did you find out if it was pre-adjudicated ?
Depends on luck. One IV member got his 485 denied by error duringthe preadjudication process. He filed for MTR and did a congressional enquiry through his Senator's office. He got a letter from USCIS in response to the Senator's enquiry that his 485 has been reopened and pre adjudicated and waiting for a visa number.

If you call USCIS today and they will tell you USCIS is process July 2 case now. the reason is they almost done receipting for applications filed after July 17.
Everybody talked about the wrong information on USCIS weekly frontlog receipting report. Actually it is true information if you filed your application after July 17.
USCIS has very long memory and they thought people filed application before July 17, especially July 2 filer, joined Aila to file class lawsuit against them.
The reason I like to refile my case, I do not want to be victim again when they process I-485.

EAD on an average is taking 2 to 3 weeks. In rare cases it is longer. However many people create horror stories and people unnecessarily worry on this.
I have been waiting since July 7. More than 80 days for an EAD renewal (Electronic). It is still pending. Your point about horror stories is baseless. I need to travel out of country shortly so if I do not get EAD and the subsequent AP approved, I will have to cancel my tickets and travel plan.
There are many others who work on EAD and whose EAD would expire soon. It becomes all the more important for them to get their EAD o/w they will not be able to work. These are real situations.
