If your spouse got EAD card (apply for SSN) and then can start working.nothing to do with I-140 approved or not..as long you have the valid EAD on hand.
Note:Once on EAD then H4 status will go invalidity)

Dream beneficiaries should ideally join the end of EB queues. As BimmerFan said 2-4 million kids would be eligible for college legally, but it shouldn't be at the cost of tax payers giving them free education. They are not going to get loans. Even I've been putting off my MBA for 2 years because as an I-140 I don't get loans to pay 50K/year.
Even if the govt decides to give them free education, it doesn't make them the brainiest.
A better way to increase graduates is a world wide SAT which is a better test than jumping fences and dehydration.
A school/college bill for a group that has more than 50% school drop out rate and 10% teen pregnancy rate. WTF? Is that why the graduation clause is removed. VERY CLEVER!!!
What happens with just enrolling for 2 years instead of completing the course? They could get a GC even without paying the entire fee and skipping all classes. But the bigger part is, they can sponsor their illegal parents, brother, sister, husband even in a foreign country. Their kids are already granted amnesty.
Also Dream should ideally allocate GCs to only graduates that the country is short of.
So you see its not even really about college or education, nobody cares, its just a smoke screen, deception.

I received the Notice of Action (140) and I sent to Nebraska the 140-485-765 July 30 and they received it July 2.
It was sent to Texas and I got the copy of the Notice of Action today from the lawyer, I guess they will cash the other checks since they change the visa bulletin on July 17...I don't think they will reject the 485 or 765, I am sure they will process at least my 765.

we are retrogressed, they tell us they need highly skilled people and then retrogress us. I cannot pursue an MBA because I have used 6 years on H1-B, I have made tons of money for my US employer, and still no greencard in sight and u tell em I am deceiving them.

I applied my labor through an XYZ company mid-last yr.Now we received a audit for the petetion sayin that the employers minimum req exceeded the SVP level assigned by O*Net to the SOC CODE assigned by occupation identified bin F-2 of ETA.
My problem is my employer is not that coopervative & laid back & their attorney is even worse.After continous bein after them, they r like y dont u get supporting docs urself.
I'am in a desperate situation as i cant even approach other attorneys as my employer would'nt agree.
I would greatly appreciate if someone could send me some write-up in this regards which would help my case.

Apahilaj, you may be right, it is straight forward in case of AP but with EAD it is spinning around. As per the instructions at page 9, it is leading to TSC address. I prefer you to call them to set this straight. Please accept my sincere apologies if I had given any incorrect info in this regard.
Update -- I called USCIS today and the rep told me that I should have sent this application to chicago lockbox address...She said that it depends on question 16 which I said I have mentioned C09 category. She said that it will most likely be rejected and sent back to you or Texas center may forward the application to the correct address..

I understand the issue. but the problem is I'll out in vacation from third week of sep to third week of oct 2010. Just wondering everything will be ifne or not? I know that the PD is not current and I just applied for the EAD renewal.

I called NSC IO to my surprise this time it was a nice IO , in few points what she said was
1)They have 200,000 employment based applications pending
2)The processing times says that they are processing cases as of July11 , 2007 but they have cases with RD 2003,2004 so a RD of june 2007 doesn't mean much older case
3)They have 45,000 cases ready to be adjudicated, but not all that cases are assigned to an office. Ready to be adjudicated meaning it cleared the NC and other requirements and has a VISA number available

Pl get an appointment with a qualified lawyer (someone different than your current company lawyer) and ask their advice for all possible scenarios.
Please post back the advice given to you.
Per my knowledge, unless your PERM clears and I-140 gets through Premium Processing before you complete 6th year, you will lose your status here.
One idea is - apply for PERM for another strong position, reclaim ALL your out of US days, take vacation for more than 2 months to give yourselves time for processing(to claim it back) and apply for I-140 (premium).
You have to act very carefully all with the help of your employer, your attorney.
All the best.

It is good news that finally Pres. Bush is putting his weight behind this thing, it is a pity his popularity rating is this low right now.
Lets all hope for a couple of good developments in Iraq over the next few weeks and for gas prices to cool down. Clearly this thing is not going to come off without his strong backing and bully pulpit.
He appears confident, This was a centerpiece of his 2nd term agenda and recently saying in mexico that one should not underestimate his ability to push legislation through congress and now resurrecting this almost dead issue, and making this his first live televised address on a domestic issue. He seems heavily behind this. This makes me cautiously optimistic.
How this will all affect us, if it passes is another story. I do worry about the huge volume of cases overwhelming the system and us all waiting many many years.
