You are right about the temporary license in that it is given during residency training.
But in my own experience i was given a temporary license (restricted privileges) after all the paperwork is submitted.This is because sometimes the board(state medical board) meets on one set date every month and you have to wait till the board gives the approval.
Now as far as USCIS goes as long as the application for H1B is filed i think one is ok because by the time they look into the application and then ask for the medical license it buys us time to get the licensure done.Now again this is a grey area but as per my attorney and my own experience USCIS is not worried about the 30 day rule as they know that the 'resident' was not out of status prior to the H1B application.
My own experience- the state of georgia does not issue license for IMG's (foreign med graduates) till the completion of 3 yrs of Graduate medical education.So i was in a similar situation. But the licesure application was applied 6 months prior to completion of residency in anticipation of this rule.
But the georgia state medical board knows this problem ( and one of the best state medical boards to work with) and issues temporary licensure for visa issues.
Again it is subject to individual state medical boards.....

I don't want to panic over an article like this. The media is ALWAYS on the case of immigration. However we do have all odds working against us these days. On a fair weather day, our only ally is the corporations and business who hire us. The society and media never likes the idea of immigration. In their eyes we come here to take their jobs, end of story. The government is not exactly on our side either. They make the immigration process incredibly tedious to a point that makes us wonder if it's there to facilitate immigration or to stop it. That's the old equilibrium we are used to until a year or two ago. Now with raging unemployment and our only ally seemingly becoming the "enemy of the state", it's no surprise that we are put on the chopping board.
If I'm under the spot light for negative attentions I'd like to say "folks, let's at least put things in perspective." U.S. has a population of 300 million, of which roughly half is within the range of working ages. USCIS granted about a million greencards last year, of which only 162,176 were employment based. That is 0.1% of America’s work force, and 0.05% of the entire U.S. population. And that’s less than 6% of the number of the American people injured in car accidents in 2005. Talking about something that hurts a lot of Americans badly, let’s give automobile safety the attention it deserves, which should be 20 times that paid to employment based immigration. On the other hand, if we look at the educational background of these immigrants compared to the same age group of all American workforce I would not be surprised that the earlier surpasses the later by a large margin. That is the whole idea of employment based immigration. Accept a small group of highly educated and skilled foreigners into the society to fuel and energize its workforce and economy. Now this mere 0.05% of people, who already have to pay and struggle to stay legal thanks to the current immigration system, somehow becomes a huge crowd of seagulls and snitches that descend upon the entire country and rob jobs from everyone and kicks Americans into unemployment. Is there any justice or intelligence in that perception? Trying to fix the right problem by focusing on the wrong issues doesn’t help. Hasn’t the country learned enough lessons on this in the past 8 years? To the media, fact skewed out of proportion is a lie. Misleading the people on key national issues is unethical and unpatriotic.
H-1B holders, who are the candidates for employment based immigration, are lawful residents. That means we are subject to all responsibilities such as taxation. We pay all taxes including those the benefits of which we aren’t even entitled to, such as social security and Medicare. We are subject to all laws and regulations as Americans and on top of that immigration law as well, which eliminates many forms of freedom enjoyed by an average citizen. To those sound advocates against immigration, who do you think you are to have the right to alienate us like we have no rights at all in this society? We aren’t robbing you, we are creating wealth for the country. We didn’t play through our earlier years, we worked hard in college and many in graduate schools as well. We aren’t sitting around collecting social benefit, we are paying for it.
I remember watching a movie where in the old times a few African American kids witnessed a black slave being set on fire. One kid later said “I saw fear in my friends’ eyes and at the same time, shame.” In some ways that’s our sentiment. We cave in when faced with unfair treatments and blames. When there is some news about a man killing his whole family after losing his job, some feel like it’s our fault. Has it occurred to anyone that his mental health was a bigger suspect for the crime than his employment status? Tough times create anger and division. In my opinion that’s the kind of ride this country has been taking until the 2008 election. This is a tough time no doubt, but it’s also the right time to restore sanity instead of injecting more biased, harmful and plainly wrong opinions into people’s mind. Immigration, although not written in the Constitution, has always been a foundation of this country. Employment based immigrants are the modern day elites of U.S. immigration. And there is nothing more American than equity and hard working. That's what we believe in and what we ask for. Immigrants are citizens by choice. That’s something to be proud of.

2008 First Time Homebuyer Tax credit of $7500 still holds good. If you bought home in 2008, you still can claim for $7500 tax credit (repayable in 15 years)
In order to get benefit of tax credit of $7500 for last year, your tax liability does NOT have to be minimum $7500. In other words if your withheld taxes were $7000 and your actual taxes were $6000, then you would receive $1000 (refund) + $7500 tax credit = $8500. Also if someone had no tax liability, would get $7500.
Only thing not yet clear is about the repayment part after the new bill becomes law. i.e. it is still not clear if they have waived the repayment condition of tax credit only to 2009 first time buye

I went to the rally today. One person "looked drunk" was shouting at us to go back to our country, and a very old lady "90" in a tour bus, gave me a thump down. But never the less a lot of people cheered for us and honk thier horns to support us. I wished there was some clear and big sighn shows we are LEGAL here, not ILLEGAL. I bit a lot people didn't understand the diffrence including the senator who gave the speech.

My wife had the same issue 2 year ago. Couldnt start a project coz they needed SSN for background checks. I contacted the Congressman's office and they inturn called the DHS and SSN office and made the SSN office talk with DHS. That speeded up the process. Hope your brother will get it soon... I know the pain.

A friend of mine got the call the from NBC ( 2007 Filer) with PD as 2005 and he was given the Green Card. Make sure to carry all the documents with you. They won't ask anything but still better to safe than sorry.

Hello all:
My dearest friend died in January this year while waiting for his GC which was in final stages. His family had to pack up and return to India. They forwarded their mail to a friend's home.
Couple of weeks back, they received the I-485 approval and the GC by mail. They also got a AR-11 notification for change of address.
Does anyone know if the GC is valid given my friend's death?
Can his family return to US?
His wife has the new GC and kid is a citizen.
Any advise will be appreciated.

Why not have dedicated paid IV attorney instead of volunteer attorney who advises the members on issues. IV members could chip in to pay for the attorney(s) for this purpose. May be have one attorney for each region of west central and east. I could chip in too for this purpose.

Since they are ready to discriminate on the basis of nationality (err...place of birth), to ensure 'fair' GC distribution, they should do it on a region-wise basis for India and China, because, states in these two countries are as large as entire countries; its time the Shahs, Parikhs, Patels and Venkats were stopped for a few years to give other Indians a chance....
If quotas can't be eliminated perhaps they can be redefined......united we are failing...divided we can win.....two states shouldn't be allowed to capture all visa numbers for India....:mad:

I do not want to be in the same quota as certain two Indian states (its actually just one state, the other state is clogging FB more than EB...) responsible for this mess, and some one from Sikkim should be given preference over me by this logic.....

Applied on Jan 28 2011.......got it yesterday Apr 14 2011.
I think the USCIS online system has conked off or has a 10 day delay. So far there is no online update on my status and same had happened when I had renewed my EAD in Dec, they updated it 10 days after I had already received the card. Even the phone operative had no idea that they had already shipped the card and only kept parroting what was online.
FYI, I only got a 1 year renewal not the new supposed to be 2 year one.....:mad:

I think you need Carl Shusterman. That's because he trumps all immigration lawyers when it comes to intersection between criminal law and immigration law. He has gotten a lot of people off the hook in their GC and citizenship cases.
He will charge $400 for initial consultation. I never recommend one lawyer over another, but I think in cases where there may be a conviction in misdemeanor or felony, you need a lawyer who knows criminal law and immigration law BOTH.

Can some tell me the list of docs that shoudl be submitted for the 485 filing,.
I check the USCIS website and it say nothing about

Applied for an indian passport extension about 3 weeks ago. When I call to check status no one picks up the phone, when I send email no on replies to it, when I leave voice message no one replies to it or voice mail box is already filled up.
I am looking for suggestions how to contact them ?
