Wait a minute here, if I was a cop, I would definitely judge this as DV. Unless, you absolutely had shut up to begin with. No chair, no drag, no nothing. which now has to be proved as misinterpretation.
And any offer that your lawyer brings you is trying to resolve the case, You are the one who should decide whether this case goes to trial or not.
Past peeing incidences, where the neighbours heard screams should be kept in mind.
And finally, take English lessons, dude, your written English too is very poor.
You can actually submit this as a proof that you were misinterpreted, if this goes to a Jury trial.
Also, please Delete any proof of the incidence, including the one posted here. No one shold be seeing the 100% truth, your 100% truth is scary.

Guys,
Is this really bad news for those with pending I-140? Does it mean they expect 140 processing to be so overloaded that they can't commit to premium?
My 140/485 was filed in mid-Feb 07. Any ideas what to expect as far as 140 processing is concerned? I am pretty sure 485 processing will slow down as they will get busy with so many new applications and working on new EAD/AP applications.

IV community, do you think there is anything we can learn from the Wisconsin gatherings??????????? They are able to mobilize 50,000 people or more in a matter of hours and days. IV campaign for 200 people is running for over a month! And as per the core team, we are yet to reach that number...............
BTW, before anyone takes up arguments over WI issues, you are focusing on the wrong issue. I am only interested in the number of people that are mobilized, and why is it that we cannot do the same.
Why is it a letter/FB/twitter can generate thousands of people to come out and protest, while the same newsletter/FB/twitter has had such a poor response for us. Are we not motivated enough? Or do we not actually care for the GC? Or do we get pleasure in just complaining? :confused: :mad:

I don't know how to open a thread to run a poll to track the number of people ready to send flowers to white house/president to highlight our case to buy houses if there is a a provision to approve GCs on a fast-track basis. With a substantial fast track fee (>4000 dollars) and 20% down payment toward house payment, we have a strong case. If we get hundreds of people ready to send to flowers, may be IV can make it an action item.
In overall picture of the country for housing and financial fix, number of EB's waiting for GC is miniscule. Giving every EB waiting a GC is not going to instantly change the mindset of the rest of the US people. People are not buying homes, because those who would have bought homes in 2008, 09, 10...bought in 2005 and 2006, as they didn't want to be left out, moving demand forward. Now we have a lot more homes and demand for years to come. Home prices will stay soft for at least 5 years.

Applicants have to wait for their green cards for as many as 4-7 years, depending on the country where they were born. With retrogression, applicants are unable to complete their final phase of green card even if they have cleared all the previous hurdles. We, a group of volunteers at www.immigrationvoice.org (http://www.immigrationvoice.org) . We have set up a non profit organization to work towards resolution of these problems.
In the past we have seen that due to a lack of professional representation, employment based immigration issues have been ignored by the lawmakers. The latest example has been dropping of section 8001 & 8002 from the Budget Reconciliation Bill passed by the congress in December 2005. With comprehensive immigration reforms on the anvil in the early part of 2006, the time to act is now. However, with the current political scenario and the overpowering debate about illegal immigration, this is going to be an uphill battle. We have already initiated talks with professional strategists who have in the past been able to achieve goals similar to the ones we are working for. We feel that these are the following ways a professional strategist can help:
1. Identify feasible goals that can be achieved and are representative of the people in this forum. We should not have to piggy back on H1s or illegal immigration - we need an identity of our own
2. Identify the champions amongst the lawmakers, alliances, organizations who are willing to shoulder some or all of the responsibility in passing provisions to solve retrogression & address labor backlogs centers.
3. Identify opportunities to meet/interact with those mentioned in point no 2.
4. Help us in putting our points across cohesively and in a way relevant to the political situations
5. Keep a close monitor on the progress and the situation so as to identify the opportunities as they arrive.
Hiring professional strategists requires several thousands of dollars. If we hope to counter some of the anti immigration propaganda, we have to accumulate funds to the tune of atleast about $100k. Keeping this and the short deadline in mind, we would urge you to contribute at http://www.immigrationvoice.org . To lead by example, the volunteers have themselves come forward with contributions - in one night we had a collection of around $5000 from 20 contributors. This is a tiny fraction of what we as an organization need.

One interesting point that came out of that recent hearing.
PD movement results in both 485 approvals + new 485 filings. CIS blames backlogs partly due to the policy that allows 485 filing whenever PDs are current. if PD movement results in 5 approvals, it also results in 10 new 485 filings and thus a backlog is built over which they have no control.
So in their opinion, PD movement should only control approvals & 485 filings should be controlled separately. If this happens, there would no backlogs and no one will ask them any questions or drag them to court for hearings!

Nothing is so simple.
Most clients have policies that require them to deal with only a preferred set of vendors. In some cases vendors are managed through a vendor management firm that classifies vendors into 3 categories. The highest level preferred vendors get the most billing rate per resource they provide. In addition, a vendor needs to satisfy a bunch of requirements like % of resources successfully placed vs the number sent for interview with the client, ability to have a certain $ amount of liability and workers comp insurance etc. Due to these factors, a client will not directly enter into a contract with an individual and that individual has to go through a preferred vendor. Now the individual (akak resource) could be tied to a lower level vendor who in turn sends him/her to the preferred vendor who then sends him/her to the client. One of the best ways to increase your hourly rate is to eliminate as many middle tiers as possible. Ideal situation is to work for the preferred vendor that places you onto the client. In most cases of preferred vendors this could only happen if you have a EAD/GC if they do not do H1s. A second best situation is to work for a Desi consultancy that works only with preferred vendors (aka only 1 level between Desi co. and Client). In these cases it might be possible to make almost as much hourly $ rate as you would make working for preferred vendor if say preferred vendor works 80-20 on Corp to Corp but works 70-30 on W2. e.g. Client pays vendor $100/hr, You work directly for Vendor on W-2 and Vendor pays you $70 (70-30 split on W-2). Now if you work for a decent Desi co. that works C2C with this Vendor and if the Vendor pays Desi co $80 (80-20 split on C2C) and Desi co takes out fixed $ (say $8-10) then you still get $70 in hand just like direct W-2 with Vendor. This is if you work on pure $ or % basis with a Big American Preferred Vendor like say Teksystems or TAC worldwide or Ciber or Keane or KForce or Sapphire vs salaried consulting with say Deloitte or Accenture or IBM consulting where the way it works is these big fish do not just provide resources (you) per position like a American Preferred Vendor does but usually take on a big project and then staff resources for completing those projects where they pay you peanuts (like $70-90k) but bill the client like an American Preferred Vendor.
In short, if you are someone who wants job security and doesn't want to look for new contracts on your own and like to travel, stick with Big American Salaried Consulting companies, but if you want to make more money and don't mind a little insecurity/tension/can interview often/ready to move then if on H1, stay with good Desi that works only with Preferred Vendors or if GC/EAD, work on W-2 (as pure $ or % split) with a Big American Vendor.

This is if you work on pure $ or % basis with a Big American Preferred Vendor like say Teksystems or TAC worldwide or Ciber or Keane or KForce or Sapphire vs salaried consulting with say Deloitte or Accenture or IBM consulting where the way it works is these big fish do not just provide resources (you) per position like a American Preferred Vendor does but usually take on a big project and then staff resources for completing those projects where they pay you peanuts (like $70-90k) but bill the client like an American Preferred Vendor.
In short, if you are someone who wants job security and doesn't want to look for new contracts on your own and like to travel, stick with Big American Salaried Consulting companies, but if you want to make more money and don't mind a little insecurity/tension/can interview often/ready to move then if on H1, stay with good Desi that works only with Preferred Vendors or if GC/EAD, work on W-2 (as pure $ or % split) with a Big American Vendor.

But to answer questions :
out of all useful land , I guess africa has lots of uninhabited land!, so someone would not mind selling! Its not to offend anyone. I have great respect for africans, being aware that we come from them!
Me being an indian upper class guy, and this OBC thing going on back home, I dont think I belong to that country that much, where me/my children will be discreminated against!!!
So dont you guys now think we need our OWN country???

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...
