Friends,
I just got a letter from USCIS that my I-140 has been withdrawn and got a NOID. I am seeking advise from people who have been in this situation. Please share your experience.

In most of the PP cases what they do is issuing an RFE ...
Response to RFE's received for PP cases should be processed by USCIS within 15 days.
So USCIS just cant delay the process by issueing RFE's as they need to meet the 15 day deadline anyway as soon as the evidence is received.

At the port of entry, you have the burden to prove that you will comply with the terms and conditions of your L-1. The short period of time remaining before expiration of your visa could reasonably trigger an inquiry into your plans to depart from the US prior to expiration of your L-1 status on June 15. These days, simply asserting that your employer will be filing to extend your status may not be enough to meet your burden of proof.
It would be far safer for your employer to file for the extension before you leave the US and then send you the rec't notice to carry with you when you return to the US.

I have talked with a IV Core member and am about 70-80% convinced with the answers. I'm meeting with my State Chapter this weekend and will discuss an effective way forward on this issue. "Doing Nothing" is not an option.Please do not waste your time and energy responding to the 'nayer's' comments.
If we can form a group with 'Real' people then with IV's direction we can move forward...without getting hurt and without hurting other's efforts. At the moment I see GetrDone,Abhijit,Leo07,ras and deer are the only people...for it.
That's my opinion feel free to butcher...

I have been trying to find information about this topic also, specially because I have to travel outside of US in about two weeks. My application was sent via private currier on Jun-28th/07 and received by USCIS at TX on Jun-29th/2007 so I'm expecting my "Received date" to be Jun-29th/2007 regardless of the "Notice date". I then should be safe to travel not having my receipt notice yet but using my H1-B current visa without risking my AOS process.. Am I rigth?
I mean.. USCIS cannot just expect everybody changing long planned trips just because they decided to rush the dates and get flooded with applications rigth? ;-)

You are correct. No problem, as long as the Visa stamp is valid you can come back on H1 status.

I did not find the web site very difficult to get the correct information.
Web site has wrong links and misinformation and lot of un necessary information to confuse you.
1) Has anybody done it recently? I can not find the documents to download?
2) For children, no documents found.
3) Do we need to apply online only? Can we not do it via mail?

That's true. Only citizens of USA can have political views and can express their views. H1B and H4 holders expressing views might not be legal.
As I understand H1B and H4 holders can not influence politics. Hope that USCIS is not monitoring this thread.

GM which is one of the biggest recepient of bail out money is going to export chinese cars to US market!! I am perfectly fine with that. Kudos to chinese car manufacterors. Now here is the problem...
1) companies which recieved TARP fund cannot hire H1bs!!!! but now it seems they can go and get work done elsewhere and then ship the product here??
2) Which is better for the economy?
a- skilled workers moving to the US and reviving the manufactoring base and this might involve reducing wages of course.
or
b- prevent skilled worker migration and instead import products from outside which will be effective on the short run due to the present capacity for borrowing heavily??
Consider these facts while answering;
but how long can you borrow?? dont you need to produce something here, in the US?? skilled worker reduces the wages? isnt that good to be competitive??

I will have to go for spending 1500 $ for premium processing ? what is your opinion . I have my wife and son involved with my GC process too. Do you think it worth those money above and beyond 10,000 I had already spent.

Registred and started a thread on the same day to ask one question....Join the team and contribute to make some difference.IV is lobbying for everyone not for individuals.
I have heard from a couple of folks that they have met some senior senetors like Bob Dole and have influnced INS to speed up their case of GC processing. Is this true ? .
If this is true is there a way to stop the influence by senetors so that these everyone gets a fair chance of getting their GC.

Please help with these questions on EAD/AP/H1. I have heard so many different versions that I am confused.
We are planning to travel to India in June/July and both of us have valid H1 extension (I-797) until Dec 2009. H1 visa stamp in PP expired two years ago.
We also have EAD, AP, all valid until next april.
a) is it necessary to go in for a visa stamping at the US consulate ?
b) if we use AP to re-enter what will happen to our H1 status ?
c) if we use AP to re-enter should we necessarily use EAD to revalidate I-9 ?
d) Assuming we use the AP to re-enter and get a "parolee" I-94 until Apr 2010, what will happen to our H1 approval which expires in Dec 2009 ?
e) if we get a new H1 stamp and use the H1 to re-enter what will happen to our AP, EAD and AOS filing ?
f) what will happen if priority dates becomes current (I know, I know, that sounds silly, but I still gotta ask) when we are out of the country ?

Unless you have any status violation (out of status) and criminal history, If 140 is approved, and 6 months passed after 485 filing, and if you and your spouse has EAD, there is absolutly no necesscity to file H1 & H4 extension. It is a waste of money.
However, one has to careful in timly renewing EAD and watchful for FP notices every 15 months.
There are actually some benefits of H1/H4 extension.
For one EAD/AP are only for 1 year, so they need extension too every year (not cheap by the way).
Also for renewal of driver license it is better to have a 3 year approval rather than EAD/AP (more money every year and the hassle of going to DMV).
For physicians the state license in some state is linked to your visa status (like in Washingon state they will give you a license valid only till your H1 expiry). Again more money to be spent every time you renew it.
Not to mention you get a 3 year I 94 you could get by simply going to Canada/Mexico!
Of course there is is the benefit of maintaining an alternative status in case there is a problem with your I 485.
You could still use EAD to work but if there is a problem (and you still have a relationship with the H1 sponsering employer) you could simply exit the country (go to Canada/Mexico) and reenter using valid visa stamp and thus being back in H1/H4 status.
Again just my 2 cents; not a legal opinion.

Since I do have my auto & renters' insurance with State farm, they offered me life insurance @ affordable price. for e.g, 16$ premium per month for 100K for a 10 year period. You may want to contact your local state farm agent.

The thing that I didn't understand is that if I-94 expiration does not matter in pending AOS status then why I-94 is issued with expiration of 1 year when you enter USA using Advance parole? What is the meaning of 1 year expiration in I-94 when somebody enter USA using advance parole? I was looking for any official note or memo explaining its valid to stay even if I-94 expired if you have pending AOS. Something like we have official memo for AC21 portability. I was looking for something official document saying I-94 expiration is not a problem for pending AOS.
