Had a talk with the HR of the new company. They are willing to support my GC case and agreed to take tab of all expenses related to it - their law firm will handle my case. I am planning to have a tele-conf with their lawyer before taking a decision.
I am currently on H1B... will a H1B transfer be better in this case instead of using EAD?
I used AC 21. I moved from my GC sponsoring company in a southeastern state to a company in midwestern state middle of this year. Reason: layoff. I was on EAD in my new job. Moreover, I was unemployed for about 2.5 months. Job description were matching about 50%.
My previous employer did cancel my H1 but did not revoke I-140. When I talked to my old employer's HR, they mentioned that cancelling I-140 takes time, money and is not good for the company's reputation with USCIS.....there must be a good reason for that.
What happened to me now? I got my GC this month and am happy. I consider myself very lucky. You may research and find all pros and cons of switching employers. But, there are things that are beyond our control called luck.
I suggest you understand the risks and if you feel comfortable make the move. If you get into trouble, that is beyond your control.......good luck.

Man this is good news for you and me also.I am also same or similar situation like you.
My original I-140 and 485 denied due to 3 year degree issue.after that we applied eb3 labor from same employer and got approved and we filed new EB3 I-140 in texas center.
We posted the docs on 05/26/2009 it will reach by 06/01/2009 and lets see what will happen after my second I-140 approval.
Guys please help us..if any body in this situation please share your thoughts...
it will help us to get back out 485 status.

I feel sorry for some of members who still don't understand what IV is for.
IV is not a private lawyer company who is offering some kind of services..
Pepole don't have fear when they spend $$$ for any small service from any lawyer but will fear to spend $100 here.
IV strength's is his members. If no member then no IV.. Like I said before

Its too late for congress to increase the quota for this year. USCIS has to start to accept the new applications from April. Even then I see a tough time for all those desi consultants to hold on to employees. I see a trend now , many of my friends have already in the process of converting to perm positions or getting enrolled with the main vendor by cutting the middle layers in the workplace where they are already contracting.
It would be interesting in the next 6 or 12 months to see how every thing will come together.

Thanks for the update. All the core members deserve a breather (a long one). Congratulations to the core member (my guess is Shiva a.k.a. admin) who had a baby. All your healths and personal lives are more important than the Green Cards. Also, we cannot afford you guys falling sick at crucial junctures in this process.
Don't worry about the comments made by some members. As you can well imagine everyone is losing patience in this process. But we all know that IV is there for us.

I need to raise about $250,000 to qualify for the lower limit of $500,000. I'd be interested to know if anyone can improve on the plan below. Also, all of the below seems surprisingly feasible and I wonder if there's a catch somewhere.

Take a 125% LTV loan against this house. Total available funds as a result of this loan : 750,000-480,000 = $270,000
Add $100,000 in savings. $270,000+$100,000=$370,000.
Take 1 personal loan for $50,000.
Borrow $80,000 against existing credit card lines.
Total interest expense for all of this is approx. $70,000 per year.

$40,000 savings from corporate salary
$25,000 EB-5 business income

You mentioned that you went to canada for stamping twice post 9/11, I heard from a reputable lawyers site that US embassies in canada look for US education ..and you can get H1B stamped easily without issues , but if you dont have US education they may ask you go back to your home country..Just checking what was your experience like.

What is printed on your receipt is the "legal" RD in case you have to apply AC21 etc. However, real RD by a center is the date they entered your data in the system (date you see online as ...your case was received on....). For monthly reporting on where each center is, they prefer to use the real (later) RD as per above.
Further, monthly status reportings do not recognize country quotas of visa unavailability. Therefore, for retrogressed countries they don't make much sense other than that if you case falls within the dates, it may have been reviewed (if ok, preadjudicated). Nothing more than that.

First, if you fail to extend your H-1B in August or you fail to file a change of employer in August before your I-94 runs out, you will no longer be in status (despite the fact that you are authorized to stay in the US pursuant to your I-485 GC application. This means your change of employer with a start date of September will be denied as a change of employer and will only be approved for processing at the US consulate abroad. Any work with company B on EAd will be a violation of the H causing you to fall out of status.
Your employment based immigrant petition should follow you to the new employer if:
1) 180 days have passed since you filed the I-485
2) The I-140 is approved or was approvable on the day that the Form I-485 had been pending for 180 days
3) Your job at Company B is the same or significantly similar to the position you had at Company A.
Your salary at Company B is only relevent if it is so different that your previous salary that it calls into question whether you will actually be performing the same or similar position.

While reading the net, I discovered that Democrats have won by fielding a lot of untested conservative candidates. We don't even know their voting histories. 140 applied earlier and approved before takeover. Applied for 485 in July.

Any employer can file for the 3 year extension. When you get your H1b trasnferd, inform the new employer of approved i-140. They will take care of it.
