I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.

One simple suggestion which is less comlicated than all those above.
BTW you don't need rbi clearance.
You can send an overseas wire from india through your bank a/c where the cost would be minimal( only exchange rate diff and cost of wire($25-50).
Your parents can safely gift you $100,000 a year. Your bank only would need a letter from them saying its a gift.
I have tried this to repatriate my assets and it works all the time.
No need to open nre or nro a/c or anything.
ps. don;t entertain any solicitation on this site for reverse hawala or anyhthing as you don;t know who will cheat you!

Efiled @ TSC on may 29th.
FP on june 28th, still no approval.
My current EAD expires September 24th and i am working on EAD currently.
Called USCIS and opened a SR on August 4th. Got a letter on August 11th, saying, although my situation is serious, i have not provided enough proof. Called USCIS August 13th, asking where i can mail the proof. Was told there is no mailing address and no fax number.
Scheduled an Infoapss Appt. for August 18th, by then it will be around 82 days.
Around the 90th day planning to meet my Congressman/Senator and hoping they could help me.
If some one can help me in finding fax number to TSC to send in my Expedite request it will be great.
GO IV GO.

In most critical situations a person can file a lawsuit in federal court and ask court to 1) compel USCIS to process your EAD within 1-2 days and 2) enjoin DHS from going after the employer if person continues working with expired EAD. Part 2 is available only if employer wants to participate in a lawsuit. Otherwise, file it yourself, it requires the same amount of time as filing for EAD.

Knowing about future, or predicting what is to come, would help if we ought to do something in preparation; an advance action, such as nailing our windows shut if we are predicting a storm. That is not the case here. Therefore, sure shot 'prediction' is just to wait and see. It is only a few days away. If new cutoff date encompasses your PD, pray and check your email every day (or every hour or even minute), and hope for the best.
I agree with you. Next week we will see the bulletin and then some people will be elated if their predictions come right and some will be disapointed. Again in 20 days we will start a new thread for Oct bulletin and FY 2010. I guess it is just that we are keeping alive our hopes.

Did u visit PennDot office to inquire about the renewal of DL with receipt notice of H1b extension or AAA office can be of any help ?
I'm in the same boat. PA DoT wants to see visa stamp on the passport.. applied for 1st 3 year extn at VSC on 7/10, will up it to PP this week... anyone in PA got their DL renewed using RN... please specify how and where??

Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.
Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..

IV is doing a fabulous work. Hats off to the core team!!!;
I was active during efforts towards getting the immigration provisions into the S1932 bill and I can say that the efforts today are much more organized than those for S1932; I can imagine the scrambling and the mess that we would have been today, if not for IV.
Good luck, IV!!! Even if we do not succeed this time, we will have enough mileage to push our provisions within a separate bill in the near future. Keep up the good work.

I am surprised to this discussion and the heated debate. Tides and Ebbs are a part of what we do. I think we must all be satisfied that we have IV to represent us. Think about it guys, we would have no voice if it were not for IV. I sincerely hope something comes out of all this efforts that all of us have put in. We have a good thing going here and lets not stop.
Even if nothing happens, I will be content that we have made efforts. Not just a tiny efforts but a big ones. Kudos to everyone who is contributing ideas and money. Keep the good work going and let us know what we have to do to help you all.

Check/Bill-pay has been temporarily discontinued due to logistics reasons.
PayPal automates the payments. Checks/Billpay requires an IV volunteer (trusted by IV core) to take time off and physically collect these checks/echecks from the IV mailbox in NJ, and deposit them to the IV bank account. Someone has to spend time and effort into doing it !
Are you saying IV can't find anyone IV trust to do this, or nobody in IV core thinks it is woth it to do some extra leg work? I don't think IV has the luxury of not doing the leg work. Every peny counts.

Pal, don't try to be selfish and narrow minded here. Step into PBEC victim shoes and then we shall see what language you speak.
Opportunity to speak in front of congress won't come everyday. So we should highlight all the problems faced by us during the employment based immigration process -- whether it is rotting in the PBEC mess for labor certification for 3-5 years or for visa numbers. They all should be brought forward.
The deadlines don't mean any thing but the results in hand do. If it were resources issue, then DBEC would also have been also stuck somewhere with 2001-02 cases but no.. they are processing 2004-05 cases. There is something seriously wrong with PBEC and needs to be fixed.
Again with all due respect, I was trying to make sure we concentrate on whats on table in the next two weeks, which may never come to the table again in a long time. But if I sounded indifferent to the BEC issues, my apologies.
I am a BEC victim too from April 2001. I have been waiting to get my Labor Certification from April of 2001. Till date, I know it may be in one of the BECs if it wasn't lost in transit. I was not able to obtain a screen shot nor do I have a 45 day letter. Basically, if your 485 is pending for more than 180 days and you lose job, then technically you can start using EAD and move on using AC21.
Chandu, my question is not whether HR dept can handle it properly or not.
My intention/question here is if an applicant is on H1 (most of the cases 5th or 6th yr of H1) and then loose the job and until he finds other job (has EAD but never used it) the applicant does not have payroll running during the break. then technically is he ok or does he has to maintain h1 status or does EAD protect him.
Coz until he finds a job and files for AC21 an applicant does not do any thing.

As Diwali is national holiday in india... same is true for Eid and Christmas.

I filed my I485 in 08/05 and my labor date is 07/05 in perm. My I140 got approved in 2007.
I was in bench for around 6 months in 2008 starting from Jan 1st to 06/20th. I took full time position in last week of 06/08 and continuing in the same job. I got RFE on my I485 and asked for employment verification in 12/09. My attorney replied with presnt employment letter and applied for AC21 also at the same time. Now i got another RFE asking for last 5 years employment letter, w-2 forms and tax returns.
Can some one please let me know how i can handle the period that i was in bench in 2008.

Follow the advise of your lawyer.
Following is my take on this (I am not a lawyer):
- I dont think you need to have "continuous employment". (I am assuming that you were not any employement visa (H1) during the "bench period"
- You already have EVL letter that states that "a permanent job -same or similar- is ready for you once you get your GC"--that is your AC21
- Your 485 was filed way before "bench period".
- During the bench period if you were only with "pending 485 authorized period of stay" (ie. not on H visa), you were not "required" to maintain employment any way. (If you were on any employment visa, you are out of status during that period).
So my advise: Just submit all the documents related to your employment history. Do not lie or falsify any information. You will be just fine.
Again, this is just my opinion. Follow the lawyer's advise.
