But each person can modify their version based on what they think.

I belong to an organization called Immigration Voice, a small group (and to my knowledge the only one of its kind) that is attempting to help legal tax-paying highly skilled immigration applicants who have been in waiting in limbo for many years.
We are all highly skilled immigration applicants who are stuck in limbo, some for more than 8 years, despite being fully legal, tax paying and highly skilled.
Since the number of highly skilled legal immigrants is so small (less than a million) compared to the number of illegal immigrants (12 million) it is very difficult to get our voices heard about the problems caused by waiting in a seemingly endless queue. The issues, unlike those of illegals, are largely non-controversial, some as simple as asking USCIS to reduce our waiting time from 8+ years to a year.
Since we are all highly skilled in areas where there is a shortage of US available labor and provide a disproportionately large benefit to the US economy, we believe that approving our already filed applications on an expedited basis could be helpful to all of us.
Currently, a bill that is under consideration by Congress called the SKIL bill will solve almost all of these non-controversial issues.
I and my fellow members would much appreciate it if you could run a story on us, and/or direct us to a source that helps publicize our organization.

This is called waste of brain power ... cramming as much as you can from the dictionary and god knows what. It would have been much better if a child learns some skill or diverts the mind towards exploring a problem or invention . What use is cramming the dictionary when it is available right on your phone now . If you have the internet all the world's knowledge is searchable.
There are much better uses for the brain power.
People can have different opinion about this ---cramming or not cramming but matter of the fact is that is still a great achievement .
Proves that we indian rock in whatever we decide to do in life and that can be medicine/IT/Law/ working to do some invention / spelling or whatever. People can have different intrests in life but matter of fact stays same that we indians are one of the most hard working race.

I think your company HR should get convinced for filing in EB2. The lawyer will hear what your company HR says. Yes its salary and designation that matters. I think a Senior with Masters and good salary can ask for filing in EB2. But if your HR by rule has decided that your position does not require Masters then you cannot file in EB2.
Most of the big companies have this rule. If you are with a small company and your access link to HR is not hard then you can convince them to consider for EB2.

For upper middle class, OBC shouldn't matter much since you can afford to enroll your children in private schools and have them work in private sector once they reach an appropriate age. If they are US citizens, they can come back to the US anytime for education and/or employment.
Talking of reservation and discrimination, what legal immigrants are facing in this country is not much different in my opinion. You can't even get your driver's license easily, let alone permanent residence. Most of us are here by choice even though we face all these issues in our daily life.

This is what happens after 485 receipts.
1. If one has not applied for EAD and TD , one applies for them and wait anxiously for their receipts.
2. Meanwhile some people start getting FP notices and one does not receive them he or she gets anxious. Finally one gets FP.
3. Meanwhile one gets the receipts for EAD, TD. One keeps checking the status online.
4. One goes and gives finger prints for INS.
5. Finally one gets his or her EAD and TD after 5 to 6 months , One enjoys the moment briefly.
6. Its almost a month since one received EAD and AP , Its time to apply for renewal.
7. Repeat step 1
8. Its almost 15 months since the first FP and one receives the second one because "Finger prints expire" ,
One has to repeat these steps in a cycle for almost 6 to 10 years depending on PD and "Nationality"
Meanwhile if USCIS changes any processes anywhere in the pipeline expect further delays.
I think best thing is to do participate in IV activities.

Ladies & Gentlemen
I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.
But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.
Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.
There are many others issues we can lobby for such as
1) Starting H1B stamping inside the US again( Which was stopped in 2005)
2) Allow H1B spouses to work. etc etc
But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

Hi Gurus,
I am in a unique situation and your valuable advice is highly appreciated. I worked for company A for 3 years and filed my 140 and 485(july 2007). I quit the company in may this year and joined another company. My 140 was approved on 06/16/2006. recently my previous employer revoked my I-140. I got a notice from USCIS that my I-140 and I-485 has been withdrawn. As per my new attorney since i meet all the conditions for job porting (180 days, 140 approved, and same job profile), no one else other than me can withdraw my I-485 application. my attorney filed an MTR today. Can i work while my MTR is pending. Is Withdrawal acknowledgement notice is same as denial notice ? please help

Here is what people forget in this debate. They point out disadvantages of Canada over US. Fewer jobs, High taxes, extreme cold etc.
No doubt US is better than Canada for most people. That is why US is our first choice and Canada is backup - not the other way around.
We arent talking about people who have a choice here. If you had choice between US GC and Canadian PR we would always choose US blind folded.
But we are people without much choice. Yes we have choice to go back to India, and it may be a good choice for thoise who have come recently and have work exp in India. But some of us have spent 10 plus yrs in the US, have US degrees, never worked in India etc. For us it is extremely difficult to move back to India when we dont have a days work exp there. Ofcourse if you are SC/ST or OBC o reserved category your kids have great future there but not for other "normal" people.
So what other choice do we have. Well English speaking countries you can migrate to and who are taking people as PR's are:
1) CANADA
2) AUSTRALIA
3) NEW ZEALAND
4) SINGAPORE
5) UK.
UK is very difficult to go to as PR. The points required are extremely high. Unless you have MBA from top 10 school or make over 100 K it is difficult.
Singapore is a good option also, but cost of living is high and you can only apply for PR after working in Singapore for 3 plus yrs. Also Singapore is not a democracy.

What is your EB category?
When i checked my status online, i saw that there was a LUD on my pending case on 10/7 and 10/8. Wondering there is a LUD, I called the NSC and the person on the phone told me that the case is being reviewed by an officer.
My question is that if there are no numbers available, then why would there be a LUD on the case status. So has anyone else seen a LUD on their cases as recently as after Oct 1, 2008????

I do not think they told us the lies, I think we raised our expecations too much, we did not do our homework. its one of those advertisement gimmicks,
where they say everthying is free and at the bottom of the page there are all kinds of restrictions written in small fonts.

how many of you realize that the queue gets longer every year by _seven_ years? how many people applying for h1 know this?
its not that i didn't read the fine print. _they_ kept the fine print. i was never even allowed to see it.
and when i asked for the promotions etc due to me for my work, they said, you're free to leave.
the intimidation is clear.
in hindsight, yes, i should have paid a US lawyer consulation before coming here. but before coming here i've worked in 4 countries and the experience was always nice.
