So for a position classifed as a jobzone 4 and an svp between 7 <8, which of the following job requirements would be a better option for EB-2 filing:
- MS+0 / No BS requirement
- MS+0 / BS+5
And by better I mean less chance of an audit or proof of business necessity requirements.
I am afraid I am missing something. According to the worst case interpretation you can't require more than 2 years even for BS for zone IV.
Can somebody remind me how BSs can still qualify for EB2? I heard this BS+5, but don't see how it can fit into zone IV and qualify for EB2

I applied for PIO card for my son and daughter and both was rejected as both me and my wife are Indian citizens. I was under the impression that kids who hold PIO card need not have to pay NRI fees during college. Is this something true?

chandrajp, many times it's not because of rules. It is common courtesy to go to a cafeteria if one is available. Smell of Indian food in general (it's a fact not criticism) may have a distracting effect in a work location so it should be eaten in a cafeteria (if available). Also, we need not emulate other people's lack of courtesy and do the same thing (like some people quoted Americans eating burgers in their cube). If we have the option, we should eat in the appropriate location.
In addition, with respect to discrimination, I do not condone it at all but we need to do a reality check for ourselves as well. I have never worked in India since I left the country 10 years ago but my friends working in India have told me how their managers have humiliated them by speaking in a regional language in meetings that they didn't know. So wherever there is a difference of culture, language etc., unfortunately human beings tend to behave the same i.e. discriminate against others who are different from them. For example, how do we explain the 'Fair & Lovely' ads? It's blatant discrimination based on skin colour.
Discrimination should be done away from every aspect of life.

Dude, I am telling you again. Expungement will not help him w.r.t immigration matters (which includes entering USA).
Even when he gets his criminal record expunged, for all immigration matters, he needs to provide information about his conviction and an explanation.
He need not to declrae at the POE unless he is asked for..

Figures suggest that there are over 800,000 pending applications. Recapture will get around approximately 215,000 green cards. We are shot of around 600,000 green cards, which will take around 4 years (@140k/yr EB green card) to address the current backlog, which contains your and mine application. This is a deep deep hole and EB3-I is at the bottom of this hole.

I just wrote an email to the editors with the email address provided by walking_dude. My email says this:
Dear Editor
You mention in an article dated today that "HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers". And in the same breath you say that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship." Do you know the difference between highly skilled legal immigrants and illegal immigrants?. Why do you have to imply that all highly skilled are illegal, infact 99.99% of highly skilled workers (Tech workers) came to the USA legally and continue to live legally. They are here at the behest of their employers.
So please correct your article to reflect that.

But in all seriousness, like people here have mentioned - RD technically is important after a range of PDs become current. This is why, for example:-
Someone with a EB3/ROW/PD 01/05/RD 06/05 (ie someone who got in right before retro hit) could well have received their GC in the last few months with the move in PD.
As opposed to my case, EB3/ROW/PD 04/04 RD 06/07 and havn't got my greencard :) Both cases became current in the last few months, but obviously the one with the earlier RD would get approved 1st.
There are ALWAYS exceptions to the case.
But back on topic. What to do now that your I485 is applied. Spare yourself the endless agony by obsessively looking at trackers, or figuring out how signed your application for Fedex.
I sound like a broken record, but if you are dissatisfied by this type of outlook - there really is only 1 thing you can do. I'll even buy you a drink in DC :)

Nurses are part of EB. This nill has many benefits. More nurses will be out of greencard queue leaving others more chance. US has acute nurses shortage. It is well documented. There is not much shortage of IT professionals . Unemployment is so high. But nurses are in demand and it is important for the healthcare of the nation. Supporting the bill is a win win for everyone in EB wait.

I really dont know,why did you sign a contract , when you were paying for the H1B transfer.
I was in such a contract when i came to the US, and i left the company when i wanted to.These types of contracts don't hold in the court of law (How can they say that the white collar slavery is legal).The only thing which holds is the Non Compete Clause (If you join the Client Directly, in case of a consultancy firm)...
I do not know the exact wording of your contract , and i am not a lawyer.These are my personal views, and do not constitute a legal advice.
