Youtube is a great tool to get our message across.
If any of you can think of creative ideas of producing 30 second videos that send a very very sharp message of how USA is squandering its innovative edge by ignoring the highly-skilled, and if its funny in any way, it would give Immigration Voice, the publicity that cannot be bought.
We will continue to put more videos on Youtube. Zazona and his friends can do whatever they want to do, we dont care.

From what I know, that is correct. Although, when the new employer files GC application, you can transfer the Priority Date from your current GC application, possibly making the whole GC cycle a little shorter than without the transfer. So a current approved I-140 will help in your next GC.

Guys,
Its not worth your health - physical or mental. So try to also live, while you wait for your 485 to process and dont hold your breath coz its going to be a long time and you dont want to suffocate yourself.

ever wondered why many of our indian folks rush to the boarding gate and jam it ,slowing down the whole boarding, even though the seat is assigned and the boarding will only happen in the order they call? :) ...

Its not 245(i) and its not anything else. I strongly feel something fishy going on in the background. Things just can't stop moving like this. This looks like a big conspiracy especially against professionals from India. This is really getting frustrating and who knows if this is just their entire purpose. To frustrate people. Do they really need us here or want us to return? For how long this 2nd grade treatment to honestly living and tax paying brainy people will continue? This is humiliation folks!!!

Hey guys,
My first post here. I hope to continue to post here.
I have approved I-140 with priority date in mid 2008. Looks like it will be more than a year before my priority date will be current. Recently I got my H1B renewed for 3 more years beyond 6 years because of approved I-140.
Question is I am really underpaid. I can easily find new job that will pay me about 30% more than what I get paid here. Should I consider changing the job? I mean I have spent 4+ years here with low salary so should I suck it up and stay here until priority date becomes current or I should think about moving to better paying job and hope to use the same priority date ?
I know these decisions depend on lot of things but please let me know your best opinion.

if you fill all detail in your profile, and check / calculate approx. date for your GC on IV;
you may get exact expected date, which might be in next 1-2 years.
If I were you, I would wait for 1-2 years, why? If I start GC process with new employer and try to port my this PD, that will also take min. 2 years. Whom would I join (new emp.)?
- desi company - you would get similar package and lot of promises
- End client - 30% hike but bit uncertainty of losing job and hang in mid of GC process.
I am not pessimistic, but would not take this risk when it is matter of up to two years.
On top of that your 6 yrs. are finished, so any bad action from end client emp. can spoil hard work done.
As a friend, stay calm and try to enjoy progress of EB2.
If my thoughts are too pessimistic, then I am sorry, can't help, I am married have kid and can take only calculated risk.

Is it possible to dig up all Tom's ranting on Immigration and put him the same fate as Allen Green and his racist comment of Macaca and sabotage his hopes for the nomination of Presidential Candidatature. Post it on youtube and show make the contributions slow down.
Even though the chances are low with his comments of Miami as third world country city, and against immigration which does not get him any fund contribution from Corporations or Immigrant Community. We make his hopes more hell by posting his rantings.

At DOL stage, there is no meaning for EB1/2/3 or some other EB..
It may only effect getting labor stage cleared. Not at INS stage i guess..as
DOL and INS are 2 different entities.
I believe that the Skill Level (Level I or II) has an implication on the category under which the I-140 will be filed. In addition I believe that as the labor certificate is a pre-ccondition to the I-140 the matching is done more carefully now.
Somebody pointed out the letter by one of IV member to the DOL. I've been hearing rumors that it along with several other letters submitted as a petition to the DOL has been the reason for a change. Of course DOL will oblige if it makes life tougher for applicants and "streamline" its work. :rolleyes:

The cancellation of your H1B will not affect your GC. If the job market is good, you can quickly transfer to another company within 1 to 2 weeks and this may "save" your H1B. Realisticly, I would give it up and use EAD to look for new job.
Now, you mentioned that your I-140 was approved long ago. So, did you use AC21 to port it to your current (the one laying you off) employer? If so, I would assume you'll have to port it back to your old employer (not 100% sure). Since, it is more than 180 days since you filed your I-485, there's nothing the current employer can do to jeopardize your GC.

EB3 is "U" (Unavailable) for worldwide. Does it mean the USCIS will not process a single EB3 I485 application even the receipt date is before July 28, 2007 which is now the EB catagory I485 processing date.

Thanks Papu for your suggestion - I think we should employ every strategy available to us and give our full support to any effort that helps our cause. Definitely the webfaxes is a good idea...but we should have more ideas. I am launching a program to call/email all lawmakers in the state of New York, explaining our plight and urging them to take action. Remember in American politics, timing is the essence. We should make our voice heard before the concerned legislation goes to the House for consideration.
