Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.
USCIS doesn't stop the application process just because your PD is no longer current
This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)
I think that they did it one time mainly to use all the unused visas. I do not know whether they will continue in the same fashion of such pre-processing in future too. If not, then that is going to be a bigger wait considering the number of applications received at their end after the July visa bulletin.

IV encourages members from every state to participate in the advocacy days - meeting with the legislators on both the Senate and House side on June 7th and 8th; with the training being on June 6th.
It is also possible for members who are unable to make it to DC on those days to still be a part of the effort. Please pledge your support by donating for air tickets or hotel stay. Few members have offered their miles to be used for air tickets, and many of our VA, DC, MD members have opened up their homes for out of town IV members. We need more offers to cover all the costs.
Some members are also driving from OH, PA, NJ, NY, NC.... If you could also post on this thread, we can get members to carpool and thereby share costs.

The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)

My understanding :
The current versiion of the bill says thus :
All illegals have to establish eligibility for adjustment of status..Now that could be done through a labor certification or some kind of review by the USCIS. The law does not say how.
It could mean that all of them submit some sort of form to USCIS immediately after the law comes into effect..Then after 6 years they would be eligible to adjust status..that is 485 filing...

I have seen it happening a lot of times. You would not believe, I have seen management floating dummy projects, just to burn left over money so that they can claim the same amount next year. If they do not burn the cash, it would be hard for management to secure the same amount of budget very next year. You know, Sanju is so true! I have even seen management "encouraging" consultants to do over time. That way, consulting companies get more cash and hiring managers get paid "vacation(s)" somewhere near South Africa or Peru or Rio! Sanju - Well said, felt like something that I have seen at my client's location.

Greetings! I have been watching the flower campaign after I got the email last night in IV news letter. While We are extremely happy getting the media coverage we needed, we are ignoring one thing. There is one more important issue that we are missing here. USINPAC is rapidly claiming that they are behind this whole thing. This is more than plaigarism. some of you might say that this is not some thing as we should be considered about media attention as our primary issue amidst of this whole thing, but this can come back hurting if USINPAC starts claiming the credit in more sites. If they go beyond the cliff, they will do their own press release to claim credit and it gets more messier at that point. If you look at their press releases, they clearly denied us any credit by refering to the org as Emigration voice. I am positive reporters across the worls know the difference between Immigration and Emigration and whether people from India immigrate to US or emigrate to US. I feel that this is deliberately denying any google search for IV

I am going to call them first thing tomorrow morning and explain them to clearly give credit to Immigration Voice (with clear spelling) for the flower campaign. Other wise, may be we should consider doing a press release on the same. We do not need to get impolite with them and use harsh words. We can convey one single message like we did today with the flower campaign. Hopefully some one like logiclife/pappu can come up with one consistent message to be delivered when we call USINPAC
I know Robinder Personally for a long time. He is Championing the cause of Ind0-US affairs with his headquarters in India. He is also the very senior columnist and well respected media person in Delhi. Being a Bachelor and previous personal assistant of Rajiv Gandhi, when he was a PM, he has never entered politics and very honest altruistic man. Calling him a fraud should be incorrect.
I have personally spoken to him in Last fortnight several times and create a campaign for immigration issue in Indian media. Personally on my request he has taken up this issue. He has very great regard for Immigration voice and told me to join as the volunteer of IV. He never misrepresents for any fame, and he has been quoted by Indian Media on any US affairs. Indian Media does not have a clue to diiffrentiate between USINPAC and IV. He never have any malicious intent against IV and does not require any personal credit. I have not spoken to him after reading this posting and I will again post my reply after talking to him.
Three years ago myself and Robinder met with US consulate general in India and requested for working on making E-1 and E-2 visas available to Indians by creating an envirnment to make India as the Treaty country. Eventhough we have a long way to go still periodically he is pushing this initiative out of India.

I am going to call them first thing tomorrow morning and explain them to clearly give credit to Immigration Voice (with clear spelling) for the flower campaign. Other wise, may be we should consider doing a press release on the same. We do not need to get impolite with them and use harsh words. We can convey one single message like we did today with the flower campaign. Hopefully some one like logiclife/pappu can come up with one consistent message to be delivered when we call USINPAC
I know Robinder Personally for a long time. He is Championing the cause of Ind0-US affairs with his headquarters in India. He is also the very senior columnist and well respected media person in Delhi. Being a Bachelor and previous personal assistant of Rajiv Gandhi, when he was a PM, he has never entered politics and very honest altruistic man. Calling him a fraud should be incorrect.
I have personally spoken to him in Last fortnight several times and create a campaign for immigration issue in Indian media. Personally on my request he has taken up this issue. He has very great regard for Immigration voice and told me to join as the volunteer of IV. He never misrepresents for any fame, and he has been quoted by Indian Media on any US affairs. Indian Media does not have a clue to diiffrentiate between USINPAC and IV. He never have any malicious intent against IV and does not require any personal credit. I have not spoken to him after reading this posting and I will again post my reply after talking to him.
Three years ago myself and Robinder met with US consulate general in India and requested for working on making E-1 and E-2 visas available to Indians by creating an envirnment to make India as the Treaty country. Eventhough we have a long way to go still periodically he is pushing this initiative out of India.

You will not have any problems since you already submitted AC21 documents (keep certified mail receipt with you).....so whatever your attorney said, it is correct....you don't need to worry.....even your employer withdraws your I-140 it won't be having any problem.....it happened in my case....I have sent AC21 docs....after that employer withdraws I-140.....but nothing happened to I-140
"Ability to pay issue" is right in employer's view.....he can able show the ability for one more application if he withdraws your application.....
How did you find your file was not updated AC21 docs..... better way is go to local USCIS and asked your attorney name whether it is the changed one or previous one if you have changed them.....call I800 and asked them few details like attorney name and company name etc..... see some times they won't reveal any info....you have to find out the way to get right answer (like tell them old attorney's name and say didn't get any updated information about your case etc)....
I am in the same boat and my employer has decided that they will revoke I-140 no matter what. Can you tell me how did you find out that your employer revoked your I-140. Maybe he/they did not. But my firm is really big and they go by the rules. So I just want to know whenever employer sends the revocation, does USCIS always revoke or it is upto their discretion whether or not to revoke. Problem is I do not have a job yet so I cannot even file for AC21.

As long as you had an I-140 approved earlier and 180 days crossed after the RD of I-485, you are safe to move on to a new job using AC21 portability. Even if your ex-employer withdraws the support for the approved I-140, your I-485 would not denied and it would be considered on its own merits.

I work for Fortune 100 company and we are celebrating Diwali on Friday. There are flyers on all the corners and are expecting more than 500 co-workers for pot-luck lunch. And the best part, organizer and main activists are non-Indian. So its just another festival in the mix that everybody is looking to enjoy. As per 2006 and 2007 CIR, only illegal immigrants get green card easy. Legals like us - it will become even more difficult. read the text of previous CIRs and new CIR will not be different. Below is the text, it clearly excludes legals from legalization. Hope I would have been daring enough to be illegal. Definately, illegals are the vote banks and they get all the attention.

`(a) Adjustment of Status-
`(1) PRINCIPAL ALIENS- Notwithstanding any other provision of law, including section 244(h) of this Act, the Secretary of Homeland Security shall adjust to the status of an alien lawfully admitted for permanent residence, an alien who satisfies the following requirements:
`(A) APPLICATION- The alien shall file an application establishing eligibility for adjustment of status and pay the fine required under subsection (m) and any additional amounts owed under that subsection.
`(B) CONTINUOUS PHYSICAL PRESENCE-
`(i) IN GENERAL- The alien shall establish that the alien--

Not that you know , you should have bought it before or you should have done through research before wasting others time.
I have 7 polices with LIC in India, One 700k term life with prudential and 300k whole life for my wife, but whole life in US Prudential is bad experience with one of well known company then done research on this topic. Whole life insurance policy all over the world has surrender charges(including LIC in India). you would not get full benefit if you do not complete 10/20/30 years term on your policy,you would get part of your money and loosing a lot.
