Thanks for the replies. What I meant by "not following process" is that new company declined to represent me for my pending I485 process or the attorney's didn't file a G28 on my behalf. They are only doing H1B which is great.
Yes I did change employers thinking AC21 but I haven't sent the AC21 papers to USCIS.

What about your current attorney? Since (s)he has been representing you, you can just stick with him/her, if possible. You don't have to send any communication to the USCIS at this point anyways, just in case of an RFE.

You will never know that. But that does not matter to you because if you got layed off, technically it means the job position is not there.
Using the copy of your 140 get a 3 year h1b transfer. You may have to start labor and 140 again but you can retain this priority date. Talk to a good lawyer.
one lsat question - is there a uscis page that has this information also so i can request my HR to not revoke 140 until transfer is complete?

All you guys who have had infopass appointments....I have a questions....do they ask you any questions on your case or is it just supplying information on what you want to ask...
I used AC21 earlier in the year and have not informed USCIS about it....I m afraid that they may ask me whether I was with the same employer and then I might have to submit AC21 papers.....and may delay my case....any thoughts?

Nov 11 - check credited (saw in bank a/c and got the receipt at back of the e-check)
Nov 17 - receipt notice received
Nov 18 - Soft LUD
Nov 21 - Approved (online status changed)
Nov 26 - Got the approved 2 AP copies in my postal box (wow usps is fast too).
I cannot believe it took just 11 days for it to approve.
Wow !!!!!! Go uscis go !!!!!! approve my GC too plz... :)
The lawyer asked 300$ to file this, i told get lost and did it myself, glad i saved 300 bucks.

My case details are as follows:
1) EB 2 India ,priority date November 2004
2) I -140 approved in 2007(employer A)
3) Filled 485 in August 2007, changed employer after 180 days of filing I-485.
4) Got RFE in 2008 august(for EVL),responded back with all the documents from the present employer.(employer B)
Received email from CIS "RFE recieved and case process resumed "
5)Renewed EAD for my spouse.
6) Approved I-140 status changed to pending in May 2009.
7) Later renewed my EAD in June 2009 with out any problems
8) Came to know that my 140 was revoked in May 2009 by employer A
9) Received I-485 denial notice in August 2009 stating the reason"485 denied due to revoke of underlying 140 by employer A."
So now iam filing MTR with the help of attorney .
iam depressed,last year when my PD was current i missed the window ,now iam afraid again i will miss the window.

Be careful about such return-of-premium policies mentioned here because some of them might not make financial sense. I did some research into this after posting my earlier link in post 10: http://www.usnews.com/usnews/biztech...5insurance.htm.
Here are MY calculations for the insurance premiums quoted in the article.
- "A 20-year return-of-premium policy might cost $1,175, or more than three times the cost of regular term." So a regular 20-year term life would be $392/yr.
Person A signs up for this return-of-premium policy. Person B signs up for regular term.
- After 20 years, A receives his/her own $23,500.
- After 20 years, B has paid out $7,833.
Wow! Awesome, eh? Not so fast....if you consider the financial savvyness of person B.
- For the first year, B saved $783 by paying $392 instead of $1,175.
- B invests this in the stock market (index mutual fund, ETF, etc.) which has typically returned 7% over extended periods of time. B's plan is to add $783 each year and not touch it for 20 years.
- Due to the power of compounding and investing $783 every year, at the end of 20 years, B's initial investment of $783 has become $34,346. I used the Compound Interest calculator available here: http://www.moneychimp.com/calculator/compound_interest_calculator.htm
So essentially, after 20 years, if both A and B are alive, A received $23,500 of his/her own money (which actually was an interest-free loan to the insurance company). On the other hand, B paid only $7833, but ended up making $34,346.00 because he/she puts the money to work for him/her-self. Even after assuming 28% tax on gains of $18,686 since $15,660 is the principal in the $34,346, B makes $29113.92.
Even, if B was conservative and did not want to invest in the stock market, B still comes up ahead if one assumes a uniform 4% rate of return over 20 years from bank CDs. B would still pay only $7833, but make $24,248.00.
So the bottom line is
1. Get quotes for return-of-premium policies as well as regular term.
2. Do the math before you sign up for either one.
3. If a policy sounds too good to be true, most probably, it is.

one other option you have is to serve a termination notice of the contract and join the firm on 1st and end your employment on March 16th. Legally this would mean that you are abiding by the contract but remember that any written or verbal agreement from here on might become binding in the court and would be concluded as extension of negotiations.
