So then we are DEFINITELY sure that we can invoke AC-21 based on the receipt date of July 2nd and NOT the actual notice date of August for most of us?

Thanks for the quick response...
What are the downpayment requirements on a short sale or a foreclosure property?
Is a bigger downpayment required to buy a foreclosure or a short sale property?
The downpayment required for buying a house depends on the loan that you apply for and get approved. It can be anywhere from 3.5 % to as high as downpayment you want to make. If your downpayment is less than 22%, then you have to pay mortgage insurance per month. If its a regular traditional loan with less than 22% down, you have to pay PMI (private mortage insurance). If its an FHA loan (Federal housing authority), then you have to pay MI (Mortage insurance). FHA means that you are buying mortgage insurance from Federal govt. and the rate would be slightly lower. Also, with FHA, the minimum downpayment is 3.5%.
For making an offer on the house, whether its for sale under normal circumstances or under distress (foreclosure, short-sale), you have to put money in escrow (also known as earnest money). That money is kind of deposit that you put down so that if you suddenly change your mind at last minute, then they can take that money away from you. It basically ensures the sellers that you are serious about buying the house and its worth going thru trouble of selling process and the closing process. The Earnest money is escrow is variable. It could be as low as 2000 dollars or as high as 3% of the value of house. Depends on the seller. If the seller is stubborn or worried, they may ask for high earnest money. IN case of short-sale, the bank may ask for higher amount of earnest money so that they get offers only from serious buyers and not just trolls.

Here is the analysis of Employment Based Green Cards (EB GC) related clauses in Specter's markup of the Comprehensive Immigration Bill. This is not definitive. Only our opinion and subject to errors in judgement.
:) Remove applicants with certain Advanced degrees from the EB quota
Those with advanced degrees in Science, Technology, Engineering and Math are taken out of the quota. But note the applicant must have worked in a related field in the US for 3 years prior to their application. So if you started working in Jan 2001 and applied for GC in Dec 2003, you are still in the quota and not outside of it. Could take out 20-50% of EB-2 applicants from quota.
:) Many of EB1 applicants and all of EB-2 National Interest Waiver are removed from the quota
Applicants with extraordinary ability or outstanding researchers are removed from the quota. This leaves only the Multinational executives in the EB-1 quota.
:D Remove all direct dependents from the Quota
Direct dependents of all EB GC applicants removed from the quota. The best clause for us. All positive.
 Direct adjustment of status for those with certain PhDs
Those with PhDs in Mathematics, Engineering, Technology and Physical Sciences and are currently working can directly apply for Adjustment of Status. I am not able to find any rationale as to why they specifically mentioned Physical Sciences here. Every where else they have just mentioned "Sciences".
:) Above changes applicable to existing applications and new applications
Good again.
:) Special labor certification processing for those with certain advanced degrees from the US
If you have an advanced degree in sciences, technology, engineering or mathematics from a US university, there will be a special labor approval process for you. Not sure of the details of this.
Increase in H1-B
Increase H1-B quota to 115,000 from the fiscal year following the enactment of this law. Also removes those with advanced degree in science, technology, engineering and math from the quota. Allow for increase of the quota by 120% if the quota is reached in the previous year.
:D Increase in EB quota
Increase the quota to 290,000. Recapture the previous year's quota if it is not filled up. Recapture those EB Green Cards lost from 2001 to 2005. All positive
:) Immigrant visas given to spouses and children after Oct 1 2004 to be recaptured.
Great again. Likely to give an one time boost of more than 150,000 to the quota
Change of allocation of the quotas
Reduce EB-1 and EB-2 from 28.6% to 15% each. So despite the increase in overall quota from 140,000 to 290,000, the quota for each of these categories then increases only marginally from 40,000 to 43,500. Increase EB-3 to 35% from 28%. This increases EB-3 quota from 40,040 to 101,500. Create a new class for other workers with a max limit of 30%.
:o Increase in per country quota to 10 percent from 7 percent
Good but only marginally so. See below.
 Strikes out the section about removing per country restriction if EB GCs are not used by the end of the quarter.
This is very bad news for those from the heavily retrogressed countries like India and China. In the previous years, applicants from India and China got the remainder of those visas that were not consumed by the rest of the world. This strike drastically reduces the actual number of GCs given to people from these countries.
 No mention of filing for I-485 when Priority dates are retrogressed.

This is not necessarily true. Gold will go down in price and that is for sure, but its not going to happen soon. Bull markets when they begin tend to stay on until the public gets a smell of it and drive the prices higher; once that happens ; thats the peak of that cycle. You will recognize the peak when you see it and you would know it.
Demand / Supply fundamentals are out of whack for Gold, Silver and other commodities.
Overall Investment Demand for Gold is high and supply has remained the same for the last few years. Commodities Investing is the trend for next few years until excess supply overcomes demand.
you got some facts wrong dude.
1.) " Bull markets when they begin tend to stay on until the public gets a smell of it " - Demand starts bull market. The demand is driven by investor's fleeing equities (pulling out their money from equities) and re-investing in safer places - like Gold.
2.) "You will recognize the peak when you see it and you would know it. " - nobody can predict peak or bottom. If you are an investor, you'd probably know this by now :)
Demand for Gold has increased and this is mainly due to investor looking for safer haven's. Once the equities hit trough, investor's are going to take more risk and re-balance their portfolio withdrawing from Gold and re-investing in equities.

My wife was having ITIN # and after she got EAD I sent a letter to IRS Phili office regarding my wife's new SSN number.
After about one month got a response like "We haven't resolved this matter because we haven't completed all the research necessary for a complete response. We will contact you again within 45 days to let you know what action we are taking....."
Wondering why it is taking months to update SSN number in the records. In the past we filed returns in timely manner and there were no issues. Anybody got this kind of response from IRS?

No this statement is not valid for AFTER applying for i-485. It is for those that have not yet filed.
Thanks for your response , do think lawyers will be able to suggest me some thing to resolve this issue? any other options?

o.k someone enlighten me...Am I reading it wrong...Everywhere in the amendment it says spouse and children shouldn't be counted towards numberical limit. Why are we opposing that?
``(2) VISAS FOR SPOUSES AND CHILDREN.--
``(A) IN GENERAL.--Except as provided in subparagraph (B), immigrant visas issued on or after October 1, 2004, to spouses and children of employment-based immigrants shall not be counted against
the numerical limitation set forth in paragraph (1).

My in-laws got their visa at new delhi consulate on friday. first, they had a VO who asked them qs in english with accent. they were not able to understand a thing, so they requested him to ask qs in hindi after which he asked them to go to another counter where a young guy asked them qs in hindi. he was very polite and smiling all the time.
VO: Show me ur daughter's visa
we did not send them my wife's visa since i was sponsoring them.
Dad: We do not have daughter's visa. Here is son-in-law's visa
VO looked at the visa (I-797 and visa stamp copy), checked in computer for 4-5 mins and then asked
VO: Was it an arranged marriage?
Dad: Yes
VO: Tell me more about the process.
Dad: It was arranged marriage. My son-in-law's parents contacted us and then the girl and boy met each other and .....he described the process of arranged marriage.
VO smiled and asked: What do you do?
Dad: I am a businessman.
VO: What kind of business you do?
Dad told about his business
VO: Aapka Visa Manzoor ho gaya hai (Your visa has been approved).
thanks to everyone on this forum.

Hello ,
Was looking at this thread and observed the concern and apprehension in getting stamped in Indian Consulate , wanted to add that my experiences with Delhi Consulate was very smooth and without event, I went for stamping 5 times in Delhi (one last June) and not once did the VO ask for any other document other than the 797 , no W2, paystubs, LCA,client, contract or employment letter etc etc. Some of my trips to India was less than 2 weeks and never was there any sort of delay at Delhi.
No harm in carrying those but Delhi Consulate rarely asks for these. Not sure abt Chennai and Hyderabad. I do not think there is any mandatory administrative processing in Delhi for renewal cases. In fact, all these times the VO did not ask any question related to pay or client etc. I volunteered myself to tell about my place of work. Incidentally,I work for a company which has less than 25 employees.
So, in summary, I do not think there are any significant isues or delays at Delhi.
I don't want to scare you or discourage going to India.. but you should keep some sufficient buffers between the time you take for appointments and return back to US. So you should have an appointment immediate after reaching India. These days USCIS is putting all renewal cases to "Administrative Processing" even if you carry all documents and paperwork. This has become a standard procedure for them and probably an underhand tactics (probably following some memo distrubuted by DOL/DOS.. who knows) to dicourage people returning back on H1. Officially they state that administrative processing can take at least 2 weeks to 90 days depending on case. Obviosuly, they are not rejecting cases outright. So far, I know of one instance where a close friend of mine went to Mexico for stamping the renewal of visa. He got slapped with the administrative processing nightmare. He went back to India. He owns a house over here. Fortunately he has Canadian PR and got a job in Toronto. Its already now more than 3 weeks since the admin processing started. He is now planning to withdraw the H1B admin processing and apply for visitor visa so that he can close and settle all his tangible assets here in US and leave US for good. Yes, he was working in a consulting compnay, but he had the client letter.
I would like to see some positive experiences on visa renewals in India, before trying visa renewals in India. Yes your id(cantleaveamerica) sounds funny.. but its ironic and true.

Let me explain personal experience. exit with old ap and get into new AP.
In 2008 My wife left to India with old AP. and came back with new AP(it was approved when she is in India). Nobody questioned on this. I think they will see only AP is valid or not. Thats it.
Don't worry. Just enjoy your vacation.

I filed concurrently in July 2007, and got I-140 approved in April. I know personally atleast 6 other cases. People 'make theories' on their own frustrations and fears. If you check it in you can see that there are cases still pending from 2006 to be approved but there are cases from 2008 got approved also.
So what is ur theory based on becuase you don't have any frustration or fear. IV is built on frustration. Becuase you have a lucky ass you pretend you don't have any frustration or fear. Get lost if you don't want to contribute on other peoples frustrations

Mine was filed in the first week of Feb and I don't have any updates too...
Can someone else who got their AP approved recently from TX USCIS please share how much time it took to get it. I'm trying to plan my trip and it would be helpful to know what the current approval timeline looks like. Thanks!
