It was a great meeting. I was blown over by the enthusiasm of the folks. It was intended to be a casual get together, but beyond a point it became more serious:D We did have action items and we will communicate it through emails, we cannot post such things on public forum. We are working on the next event planning once we finalize the place and time we will get in touch with U.
Yeah there were few glitches we can rectify it in future.
laborchic, thanks for taking the lead and organizing this event. U'r IV handle certainly helped to pull some additional members to the meet:D:D
The party was mostly good. I only regret that sometimes, I could not hear what people on the other side of the table were talking about. The room was too dark and not quiet enough. It might have been better if we had a round table.
The most important thing is that we need to come up with an action plan after the meeting. We were not just having fun. We had some serious discussions on various issues.

Here is the "India Thing" again.
Please, if you really love your country go back home. I don't think America really cares if you leave.
There will always H1-B application every year.
I'm not from India.
The question is not whether America cares or not, its just about people (Indians) venting their frustration with the whole GC/retrogression issue.
I am surprised that you care enough to post in this thread, when you are not from India ;)

Any one has info on working and living in Australia.
I see in 12 months i can get Immigrant Visa... Cost is $1960 ..
Canada may be cold ..Australia has beautiful weather ..
But the cost to buy Australia would be slightly more expensive than for a small out of the way nation in Africa. (Anyway I am ROW from somewhere in Africa so it would be better to just go home)

Hopefully they might be waiting to approve both AP and 485 together. (I am thinking they might have taken the amount on AP already)
Take an info pass appointment to get more details if it is close to you.
I am in Mar first week PD and hence dont know whether my PD is current yet (Aug VB). Planning to wait for the first week of September before taking an infopass appointment.

Looks like everyone here is on the same boat (getting GC). Why are we wasting time on this when time is of the essence?
If everyone has so much time to reply to posts, I would really recommend that everyone instead give a phone call to one of the senators mentioned in the other thread and do something constructive. If you are done with that, call your friends and ask them to join. Help us find the emails of CEO/HRs of companies that depend on us!
If you still have time, PM me and I'll let you know what else you can do.
Please guys, understand the seriousness of the situation. We need all the help we can right now.

I'm surprised that everybody in this thread got so scared of the language in a stupid bill and stopped thinking how clever Indians are in finding loopholes. I hate when all the extra-ordinary people think in the same direction. To start with, is it possible that these jokers will pass anything agaist the will of big techs like microsoft, intel, csco, think again? even if they did to make average(stupid) Joe happy, they wil keep loopholes making the law irrelevent. e.g. H1 quota limited but L1 unlimited. businesses more than 50 emps can not have more than 50% H1Bs, what do u think big desi consulting cos are in trouble? they will simply 10 more companies each having 49 people.
Other direction: when i came to US in '99 from SEEPZ, my US salary(in Rupees) was 12 times my indian salary, now it's just 2 times. Indian salaries are increasing 10-20% every year, and Dollar is going down (down 20% in 6 years, 40% including indian inflation), very soon there will be no advantage in coming over here, and you are worrying about future H1s having trouble getting GC?
No matter how stupid and selfish politician look/sound they always think about their contries future, and folks these are US politicians. take it easy and take a walk outside, it's nice out there.

I heard from some of my friends that places like Detroit downtown,Arkansas,St.Louis,Tennessee, Louisiana are deadly dangerous. How far this is true?
my friend, pretty much every place in US in unsafe.
from the news: "The motive behind the killing is not known but Murthy, an official of the state-owned Bharast Sanchar Nigam Limited (BSNL), quoted Vishal's friends as saying that some African Americans shot him after an altercation. "
Not to disrespect the read, but people should realize what they are getting into before they get into arguments or brawl. This is not India.

Must an H-1B alien be working at all times?
As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.
http://www.nrilinks.com/Immigration/VisaTypes/h1bfaq.htm#q8
>> Must an H-1B alien be working at all times?
No, but he must be an employee. H-1 employee can avail vacation, sick days off, unpaid vacation days as are available to ALL OTHER employees. Employer needs to document such policies. There are complex issues involved here.
Like you said in post As long as the employer/employee relationship exists this is the key part. How to prove employee relation - mostly by pay stubs and employment letter. Also, I-9 Form date determines when employee really reported to start the employment.
Not a legal advice

I personally think that 6 month rule-of-thumb is nonsense.
AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?
I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.

IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).
This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.
Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.
Bottomline, do not underestimate America. They know what they do.

In fall 2003, an applicant filed a green card application, which remained pending due to FBI name checks until spring 2007. During the course of the adjudication, the applicant was fingerprinted and applied for interim benefits several times.
Although the applicant applied for most of the interim benefits in a timely manner, the filing of the last EAD was not timely, and the applicant had to end his employment. In correspondence to the Ombudsman in the winter of 2007, the applicant related that he is a cancer patient who no longer has income necessary to pay for treatments. (page 40)
A green card application filed in late spring 2003 with a service center remains pending. The applicant filed his fourth EAD in the fall of 2006. In January 2007, the applicant needed the EAD to continue employment, but had not yet received it more than 90 days after filing. As advised by USCIS, the applicant visited the USCIS field office to obtain an interim EAD. At the field office, USCIS told the applicant it no longer issues interim EADs. USCIS gave the applicant a form to request an interim EAD, which the applicant filed with the service center but received no response.28 The applicant contacted the Ombudsman in February 2007. The applicants green card application remains pending, while the interim EAD was approved late. (page 17)

I think you are wrong... Company A can revoke approved I-140, if employee leaves them..
No problem my friend. You are welcome. I am glad I was able to help you.
Company A CANNOT revoke approved I-140. I have checked this with 3 to 4 attorneys & also with Gurus on this forum. Only the USCIS has the authority to cancel the approved I-140, if it detects that it was obtained fraudulently.
One more suggestion, ask company B to file your H1 with Premium processing. Once you get H1 approval then submit resignation to Company A.
Enjoy the party Bud. Have a drink on me!:p;). Wishing You and Yours Happy New Year.
If you will be benefited by I-485 filing without current priority Date, please vote YES on the Poll.
Then please send an email to ivcoordinator@gmail.com with subject - "I485 filing without current PD - Impacted Member". Of the hundreds of thousands of July 07 filers, who paid a mere $325 for their I-485 application, do you think USCIS will devote the time/effort to constantly keep track of the applicant's eligibility of 485 over the next several years???? It will take atleast 4-5 years for several of us to finally get a visa number. Several of us will move/have address changes during these years.
It took them 2.5 years to process these...imagine the nightmare if they were to try doing subsequent rounds....
Keep in mind that 485 eligibility is not just tied to employment but also FBI name checks etc. Do you think USCIS will keep on doing name-checks every other year, or issue EVL's every other year if/when they see for instance, an address change?
Dude...USCIS is already on its way of bragging to the congress that it has pre-adjudicated all these 485 applications. I think if they touch these pre-adjudicated applications, then someone has to answer to someone of what is going on...why haven't you still worked on this? why are you devoting your time to these old 485 applications when there are new ones yet to be processed.
I think once the application is pre-adjudicated...that's it!! I don't believe USCIS will spend anymore time and resources to these applications again...until a visa number is available from DOS and they apply the number to the pre-adjudicated application....my 2 cents!
They don't have to do it for everybody. They can always pick a random sample to see how the process is working and do a check on them. As Chanduv23 mentioned if this is not public, they can change the process any time or add more restrictions to it.
