Trust me my friend, I have seen it happen all the time, from large Telecom firm to Govt., its always there, most of the consultants just doesn't come to know about it, but the cut for the managers is there in some form, almost always. Why do each manager has a specific vendor through whom they want to hire most of the time? What else is the reason for the client to pay the consulting company $180/hr but they won't give 'valueablehurdle' anything more than $50-60/hr?
On a different note, now that NSG approved the waiver, most desi uncles, some of them are also owners of desi consulting companies will claim that they are the father of Nuclear deal. These bastards (sorry for my french) always oppose any GC fix and they tell their favorite congressman/senator (each has atleast one favorite politician for whom they do fund raisers) that gc backlog is not an important issue for the community. India Abroad, Times of India, rediff and other desi portals/newspapers will write 'Oliver North' style stories about these desi uncles knowing well that companies like GE etc put their weight behind the deal as it will create commerce to commerce over $20 billion/yr. But desi uncles/orgs will not stop claiming to be the father of nuclear deal. The fact is, most of these desi uncles made noise not because they wanted to do something for their country of birth, they are doing it because they think that if the nuclear deal passes, they can play middle man for US companies to sell the technology/material to Indian companies/govt. Most of the so called 'united voice of Indian-Americans on the Hill' organization's goal is to make big bucks by playing 'middle man' for companies wanting to sell technology to India. And as always, just as 'valuablehurdle''s client (paying $180/hr) Indian govt. will pay double the cost. These desi companies have squeezed blood of people waiting for gc, but now they think its time to move on to play big game with the big boys. These desi uncles/orgs are going nuclear.... time for Rediff and India Abroad to play Oliver North. Sometimes the line between capitalism and cycle of corruption is extremely blur. The problem is, these desi uncles/orgs claim to be representatives of entire Indian-American community, sometimes the entire immigrant community. They don't know more than 100 people, but they claim to be the leaders of all 2.5 million indian americans. I think IV should compete openly with USINPAC which realistically doesnt have any grassroots support.

Someone with a EB3/ROW/PD 01/05/RD 06/05 (ie someone who got in right before retro hit) could well have received their GC in the last few months with the move in PD.
As opposed to my case, EB3/ROW/PD 04/04 RD 06/07 and havn't got my greencard :) Both cases became current in the last few months, but obviously the one with the earlier RD would get approved 1st.
There are ALWAYS exceptions to the case.
But back on topic. What to do now that your I485 is applied. Spare yourself the endless agony by obsessively looking at trackers, or figuring out how signed your application for Fedex.

Two years before you would have got a different reply because selling a house was easier than now. My priority date is Jan 06, EB3-I, but we bought a house because of our personal choice. We wanted to give our daughter a nice environment to grow with friends. Why should she suffer because of the delays in GC?
Not buying a house doesn't hold you up to a location, especially if you are in consulting but again if you want to settle down and travel less, with EAD, it is still OK to buy a house. As long as you have some saving to take you through just in case you have to go out of the country and come again, you should be OK. If you don't want to risk it and space is not a concern, renting is not bad at all. House in the US according to me is not an investment purely on dollar value but the quality of life is way better than renting. If you will lose sleep just because you made a major investment, then hold on for few more years.

Thats just too much bull for one day. Just when I thought that it was enough for 2008, you drop this bomb called "God's protection over this land" and made me read those illogical ideas. So this is what I have to say -
Can you prove the existance of God? Who is God? Where does he/she live?
You see, down the ages mankind have been told to think in a manner such that - anything that we cannot logically explain, we just come up with the rationale that "God did it". So for the things we can explain, we looks towards that knowledge, but for the things we cannot explain, we still try to explain to ourselves & others by saying - "God did this". And this is how the author is processing information, and this is everyone reading it will understand.
And this behavior is not a fault of anybody alive. We have inhereted these genes through thousands and millions of years. And those genes in us are designed to make us "blame or credit God" (whichever way you look at it) for everything we cannot explain. Now there will be some who will tell me that I am WRONG for saying "thousdand and millions of years" by arguing that Adam and Eve came just 2000 years back and earth was created in 6 days, and human beings were created some 2000 years old.
Human mind is extremely inferior. and for own inner sense of inferioirty, we want to tell everybody and our own ego that we know the reason for everything. And for the things we cannot explain, we explain such events to ourselves by using the argument "God is the reason behind those events". We cannot just accept "I don't know how/why it happened". Humans have to explain everything and a lot many times in a day, we explain events by telling ourselves - God did it.
One more thing, often times, unknowingly, we give more weightage to the writings from people who passed away as compared to the writings by folks who are still around. I think we should question everything told to us, everything feed to our brain - and we have that moral responsibility towards ourselves to question specially the things which are thrown at us with the message - "just accept it without qustioning", because religion and different version of the description of God cannot be questioned. It must be accepted the way it is.
I think that the greatness of America and its history is not because of the "Religion" or "God", but inspite of it. The fact that "Religion" or "God" is kept out of the Government is the only reason for the progress you see around. For millions of years religion was the center peice of every government, and so our ansestors lived in backwardness. Almost 99% of all inventions have been made in US, where State is "independent" of the "religion", although there are lot of nuts out there who wants to change this. As per the "religious folks" God will never protect a nation that intereferes with the work of religion, right? So why would "God" protect this land?
Anyways, I want to write for another 200 pages, but, I got to do this job and earn for my family, otherwise "God" will be angry with me.

Its a good move, I know that this initiative was started by an Officer from US Army whose interpreter was getting death threats for helping the US. When he saw that it was not an isolated incidence he started lobbying the state department to create a separate category. I have been following that story for a couple of months, but was not aware that a bill was passed to create a new category or visas. (i am sure, that USCIS cannot take a unilateral decision to add more visas or else why would we be begging for recapture bills)
Whcih categories do Political Asylees or Refugees get into?

A correspondence Masters from an ACCREDITED university is legit. As I said earlier, if a degree from a Accredited University is invalid than your degree is also invalid. There are tonns of legit US universities offering Online courses --- some examples are University of South Dakota, University of Massachusetts, Northeastern University etc.
I challenge you --- say in a public forum that degree earned through online courses from these universities are bogus . I will make sure to forward that link to these universities and you can spend more time defending a defamation law suit than anything else.
Looks like you are using online degree to support your case as well, that is why you are so pissed off. No matter how loud you shout or how many people you threaten about lawsuits and all that stuff, no one can deny the fact that an online degree does not have much of recognition.

I recently got an RFE to prove that my Master's degree is a three year course (and not a two year program) because the degree and the combined three year transcript don�t specifically state that it was a three year program.
I have three year of Bachelor�s (BSc) and three year of Master�s (MCA) education, which was used to qualify for EB-2. I also have more than 10 years of experience in a related field.
Unfortunately, I only have a combined three year transcript with a list of all the courses completed as part of program (Year 01, 02 and 03) and not three separate transcripts for each year of the program.
I also have an education evaluation to prove that it is equivalent to MS in USA, which was submitted with the original application.
I recently obtained a letter from the University stating that it was three year degree program with year of joining and completing the exam but my attorney strongly recommends on getting transcripts for all the years individually, which may not be feasible to obtain in a timely manner. She is not willing to do a fresh education evaluation and to respond the RFE without transcripts of each session/year.
I know lot of my friends have successfully got their I-140 approved with a combined three year transcript from same University.
What are my options? I need a second opinion and a possible representation, if required.

I have the same criteria, 3 years Bachelors in Comp + 2 years Masters in Comp + 6 years exp (prior to filing 140). My 140 was approved back in 2007. I strongly believe you should be fine. May be you should need to do education evaluation again and respond with the new evaluation. I wish you good luck.

Are you quite sure it is a logical creative thing ? There are a lot of words which are pronounced quite differently from the way they are spelled ... unless you know the word ( by cramming ) you would not be able to spell it.

Obviously this is hard work but to what end. How is knowing the spelling of every word in the planet going to help her or anyone for that matter.
Better be a good writer who writes on interesting topics , stories or novels than to be the proof reader for the writer. Who do you think would have a good career - the writer or the proof reader.
Learning how to spell would have taken thousands and thousands of hours . Wouldn't that time be better spent in learning maths or science or arts or a musical instrument or sports or anything that will help her in the future or be personally gratifying for life. I am not sure she will remember half the words 10 years from now just like a engineer doing java programming for 10-15 years would practically remember nothing he learned in college.

If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?
The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.

Plus there is politics of vote bank: Moment the CIR comes, the sheer stampede of illegal lobby like the bulls of Spain, H1B folks get crushed. Last time, moment the CIR came, H1B people started opposing it because it literally made illegals ahead in line line with more points in the point based system.
That's why I am skeptical of CIR as of now. H1bs don't have much chance in front
of the madness of illegal lobby vote bank. Based on my observations of how the
US politics works I don't see promise in CIR (one of main reasons I left for Canada)
Not to mention, a lot of antis are not that against EB reform but moment CIR comes
all anti-s get united in opposition. The illegal bobby hold H1Bs as hostage unless they get what they want. It is such a deadlock that I just don't see how it can be fixed.
Unless there is another super powerful lobby helping us like US industry (supreme powerful lord in US politics) which currently wants the existing H1B system I don't see headway.
PS: In 2002 Canada passed IRPA where they delegated the rule decision making to the executive branch unlike US where any change has to be legislated.

There has been established a way to deal with backlogs at Dallas and Philly, and these officials at PBEC and DBEC have been given a deadline of Sept 2007 to clear everything. So someting is and will be done in this regard. Not much more can be done here with PBEC or DBEC, and the real test is to get solutions for the retrogression.
Once the laws are passed on the immigration reforms, its a done deal my friend, and then it does not matter how much we try after this to address retrogression. This is our only chance.
BUT realize that there have been delays in PBEC and DBEC only because of lack of resources, which can be added or taken off...and this will speed up or slow down DBEC or PBEC. This can be controlled outside legislation.
BUT THAT IS NOT THE CASE WITH RETROGRESSION. NO VISA NUMBERS = NO PROGRESS TOWARDS FINAL GREEN CARD. DONE DEAL.

Now that we have you, i am sure you would help in this effort by sending out emails yourself and also other members can join you to contact media. I wish we can all send multiple emails to every newspaper, every tv station and radio station in this country and apprise them of our cause. such letters urging news orgs to cover our issue will help us get much needed media attention and then something will DEFNITELY happen in the coming months.
LOoks like the AILA link does not provide email addresses for every listing. I have sent emails to 4 media outlets in my area in Colorado.
