Agreed the statement "Indian Americans are brilliant" is too much generalisation, but Many of the immigrants from India and China are here because they are highly educated, so they put a lot of emphasis on academics, as a sports star might on his/her children in sports, likewise a movie star.
Its better to be guided by aspirations than to be misguided by carelessness.
This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.

Renewal of License or a New one for H1 or H4 or related visa... is fully based on I797... this rule has been applied since last 3years.. who all arrived in PA before 2002 or so... are safe they get the license renewed for more than 5 years but who are after that gets only renewed as per the I797 expiry date.. the problem lies what our I797 gets delayed, we cant drive ... sit home ... does anyone have a work around or dealt with such situation

i was thinking...
500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)
if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?
Average cost of house nowadays is 200k.

I hope that this holds good for existing GC applicants too. When perm was introduced the existing applications was pushed to the BEC black hole. Many of us had to wait for a couple of years while watching the newer perm applications getting approved.

I personally think that 6 month rule-of-thumb is nonsense.
AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?
I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.
Refer http://www.murthy.com/pr_thngs.html and search for the following
"It is also important to understand that the green card approval will be reviewed at the time of the naturalization interview. For employment-based cases, this means inquiries into how long the individual worked for the employer after obtaining the green card. If the period is extremely short, there may be questions about the bona fide nature of the green card process."
As "a_yaja" said, "AC21 applies only if your GC has not been approved. You cannont invoke AC21 after your GC has been approved."

Thanks but were you able to trade in Indian shares using that account after you came to USA ? I heard it's illegal to trade using the normal demat account in you are NRI from USA.
Yes I did do quite a bit of trading, sometimes on phone from here...It all stopped when they suspended my account for lack of PAN information.

I agree that asking for complicated changes is a pain. But after meeting the lawmakers, I realized that this is the BEST way. Even the lawmakers agree and attest to this.
You are doing a reality check without even being there. Which, let's face it, is not really a reality check. It is more of your opinion and assumption.
Lets also not confuse facts vs opinions. The fact is that meeting lawmakers and educating them about our point of view is the key to this whole GC mess.
Let me ask you a simple question. What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?
Bringing attention to lawmakers about our plight. Bringing the issue right up to the Capitol. Bringing the issue up for even discussion in the various immigration meetings that are held every other day. Are these benefits not important enough for you?
appreciate your comments - but as i said in my post clearly that I accept the probability that my views are wrong.....
""on the other hand if one day it so transpires that this rally was the historic starting point of major immigration reforms triggered by a group of pioneering individuals - i would have no choice but to eat my words and hang my head in shame that i did not attend.............""
But look at it this way......i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me....if people who are waiting saw the utility of the rally....there would have been more than 2,000 in DC.........but clearly they did not.......i was willing to give it a shot - but unfortunately could not and did not want to specifically postpone something else to make it to DC.......
People have been quoting Gandhi and his South Africa protests.........those were different times and different issues.........colonialism, racial discrimination etc.......if the american govt is non-responsive to the demand from 60% of its own citizens to withdraw from Iraq - how can we realistically expect it to react with super haste to our requests....besides gandhi had the courage to stand up to police brutality, get arrested etc.....in today's days and age - as white collared professionals - do we have the guts and will to do that? For example - we cannot even strike (non cooperation/ civil disobedience movement)....because we get paid by our respective private sector employers.....and our grudge is against the Govt - who do we strike against......?? and if we do strike or court arrest or adopt other forms of civil protest and by chance run up a police record in the process.......who would employ us in the future...in Gandhi's days - they did not have electronic background checks......!!
Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.
another point people have been harping on (apologies for bringing this up but this is my only pet peeve amongst all the other wise great things that happen on this forum).......america's competitiveness and risk of reverse brain drain........personally - i think most people dont care two hoots about these issues - these messages and slogans are not out of a new found love for america but to create a nice "politically correct shield" for people's own private agendas (and the collective agenda of all of us) - to get a GC. Are we here to improve america's competitiveness (if that was the primary purpose of our coming here - shame on us for not staying back and improving our respective motherlands' competitiveness) or our own future - if the latter - lets call a spade a spade.........
so - whats the "so what" from my post? is it to critique what IV is doing - no! The "so what" is - unless there are drastic and dramatic measures - concrete changes are not possible........small procedural victories - maybe........drastic change.....no way!
just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......
pl think about what i wrote objectively......and dont jump on me just because i am playing devil's advocate

I am surprised...why IV is not raising this.. The fundamental issues of EB immigration wont' be solved until CIR happens and that could take forever. No one cares about immigration right now.. The only thing that can provide immediate relief for EB immigrants is if we express our desire to buy houses(unable to do so becoz of lack of GC).
Wakup IV!..where art thou'
We already ran a campaign http://immigrationvoice.org/forum/showthread.php?t=21665
How many of you took part in it?
There was a funding drive recently and also in the last quarter of 2008. Total contributions in the last 6 months have been too little to engage in a full fledged lobbying effort on any issue. Despite that we pushed through.
Before we start blaming IV core, let us see if we are all ready to take part in IV action items. If people do not take part in any action item and support IV en masse then success will be hard to come by.

Gurus,
Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the Court Disposition Document which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?
2. What are the possible chances that visa officer may not let me into the USA?
3. Do I need to carry any letters from my criminal attorney explaining the situation?
4. Any one in similar situation, please update me on this?
5. Please list of documents I need to carry during my travel
Please reply and post your valuable opinions/suggestions/advices.
Appreciate all your inputs.
Have a nice day!!!
Thank you,
Sahaayam.

Federal law does allow H-1Bs to purchase firearms if they have lived in the US (Same residence, if you move, the clock is reset) continuously (if you leave the country, the clock is again reset) for 90 days and fall under one of the 4 exceptions listed below.
- Possess a valid (unexpired) hunting license issued by any state in the US
- Are a Law enforcement officer from a foreign nation, here on official duty
- in the US to participate in a shooting sports competition
- get a waiver from the Attorney General
The easiest of these 4 exceptions is the Hunting license exception.
Once you meet the above mentioned criteria, you are okay, per federal law to possess a firearm. Doesn't matter what non-immigrant visa you are on (H-1B, F-1, AOS).
Next step is to check whether your state has additional restrictions. I don't think any states completely bars non-citizens from possessing firearms (atleast none of the states that I have lived in do), although some states have restrictions on the type of firearms non citizens can buy. e.g. in MA, non-citizens (including GC holders) can't buy handguns or high powered semi auto rifles (ARs, AKs) but they can buy non-large capacity rifles and shotguns.
As someone pointed out, trying out guns at a public range which has rentals is a great way to introduce oneself to the sport, learn basic firearm operation and safety, and to try a wide variety of guns and calibers.

Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best It is worth to try this next immigration bill. Any money spent on this is worth it Can not you guys see it? More and more years on this black hole!! More years paying our lawyers for H1B renewal, more years for renewal of our driving licenses, more years for our wives to wait, more years for our employers exploiting us This next immigration bill could be our last chance in many years to get our unfair and sad situation known and probably solved. We would at least raise enough concern about the absurd situation of the legal immigrants It could be a new Quixote tale, I do not care A good part of my next paycheck will go to immigrationvoice Whatever Keep America growing America is not just them. It is all of us It has always been It is what America is made of
Keep it up
Cheers.

Hi Dilip,
Where did you find the updated Renewal Form, I saw an update in Murthy.com, we need to use the latest for for I765
and How much was the fee(Check you sent)
Thanks,
-Raj.
My EAD is set to expire Oct 8th 2008.
So I applied for renewal on Jun 16th via USPS express overnight mail to Texas.
I live in Pennsylvania so had to post it to TEXAS.
USCIS already cashed the check and sent me a receipt notice!
Seriously that was ultra fast.
Since they recently announced about 2 year EADs which will be issued from Jun 30 onwards, I am concerned that the fact that they cashed the check so fast, do you think they will also give me a EAD fast, that too before Jun 30th ? If they do will that be valid for one year or 2 years? If they wait for issuing, and if that happens after Jun 30, will that be a 2 year or a 1 year one?
Feel free to comment.
