Yes, one of my colleague got fired. He was on 6th year of H1b with Labor pending for more than 365 days. With few paychecks first he changed his status to B1 and then it took 6 months for him to find a job and then he used pending labor to get 1 year H1b extension and now he is apply for GC via PERM etc.

be patient if few of them go GC doesnt mean USCIS is not processing randomly, u never know what criteria the processing is based on. And also why do you get inspired by movies (its just BS)

One of my colleague had applied for 485 more than 2 years back and around a year back he used his EAD to join other employer(B) after approval from current employer(A). few weeks back he had a query from USCIS to his old employer(A) asking the employer whether they can issue GC to ex-colleague.
Does anybody know why USCIS did this? On one hand it is saying after 180 days from receipt date one can change to similar job on the other hand it is asking ex-employer on whether they can issue GC to their ex-employee.
I am not puzzled and in dilemma on whether we really have a concrete option of switching employer using the EAD.
Any response to this query from the experts is greatly appreciated.

a lot has been said about non participation from the region nearby to DC.
but this post is about something very different. i would like to highlight the
very important role that our members and volunteers from tri state and the DC area played in the rally. they worked against all odds and deserve sincere thanks.
tri state: this is the most dedicated bunch there is...singhsa3, chanduv23, tnight, siravi, mpadapa, mbartosik, poonam and many others worked tirelessly against serious odds to cover the region with fliers and motivate rally goers and contributors. i'm sure i'm forgetting someone...very sorry...tell me and i'll edit :)
tikka whose commitment to iv is always without question made it to the rally despite serious work constraints and always set an example for others to follow. singhsa3 unfortunately could not and we were only too glad to stand in for him.
the two buses from tri state were arranged by singhsa3 and mpadapa and were superbly managed by laborchic and GreenGrass...sounds like everyone had a great time! we are all confident that the tri state chapter will build over time and will be a force to reckon with- how can it not- it has the most able leaders and volunteers there are....
i have to confess to bugging these folks on a constant basis about spreading the message, in retrospect it was not needed in the least...they walked the talk everyday, took time off work, posted and distributed fliers, called members and did everything one could ask and much more. please join me in thanking the tri state chapter for a lot of hard work and endless motivation to our common cause!
and then the local volunteer team from DC/MD/VA, superbly led by a tireless guy who had a full plate throughout - nixstor! i think many rally goers missed how much work was put in by the local folks, they ran a host program- picked up and dropped from airports and put people up. they were ready and willing to do all asked of them starting saturday itself, and on rally day they were responsible for the whole operation- marshals for the rally and ensuring that after everyone departed the two grounds we used were cleared and cleaned as needed. having been there myself i cannot begin to underestimate how much work remained even after the rally was over. i hesitate to name...arun, girdhar and samir- i know, but there were so many others that worked- that i will let the local team chime in here. a special word for sukh- the man is just incredible. from arranging hotels to buying stationary to arranging flowers and flagpoles to helping with the gurudwaras to running the uhaul and the van..and not least getting more than 800 placards ready for the rally- his work never stopped. we all owe a debt of gratitude to the DC area folks who made this rally possible.
let's stop complaining about what may have been for local attendance and instead celebrate the tri state and DC area chapters for what they did do and what they will...for sure ...in the future as well :)

USCIS cannot reject your petition just because the letter was not the exact format. The keypoints are "permanent" & "same/similar job". Looking at your email, the letter provided by your employer should be OK.
If you want, you can attach a letter mentioning the specific clause from AC21, and how you are proving each conditions on that, with your new employment, including the conditions in LC.
In my case, the employer has two separate types of employment categories: 1) Regular Fulltime and 2) Temporary Fulltime. I fall into the Regular Fulltime category. So, I believe the key point of "Permanent" will be satisfied with the wording "Regular Fulltime". This is the standard for my employer and they will only provide this standard letter. this bill is not yet dead guys. Dont think Kennedy and friends are going to give up on a potential 20million vote bank so easily. this will be back... Also, the final vote was apparently 46-50. So in the course of a few hours more than a dozen senators changed their vote! This can only be more encouraging for supporters of the bill, they are almost there...

I am ready to send a Flowers to CHC Per IV Core's Direction. Sending bouquets to CHC from 100 Ivians in enough to create Media awareness and expose their Selfish behavior. Of course other Senators and House reps would be giggling all day behind these Selfish CHC Members.

Someone on here mentioned that we over-use the Flowers campaign as a "final solution" to all our problems. Well this IS the time to pul out all the stops. Either that or wait 2-3 years till the next president decides to move it on this issue after the war is over and global warming is taken care of etc.

I lived in MD and applied PIO card for my son and sent original US passport to Indian embassy DC, they did not send me the PIO within the time frame and I wasted my time by calling and emailing leaving voice messages.Finally after reading a post in forum, I sent a fax stating that my son's us passport was sent to embassy and we need to travel out of the US so we need the passport even if PIO is not issued...within two days of sending this fax I received the passport with PIO card.
Your case is for Indian passport so they may not care as in my case it was PIO card on US passport.
But worth trying and sending them a nice fax..let us know if this works

Hi,
I got my EAD today and started applying for jobs. Do I need to apply for a SSN? If so how can I do it?

Congratulations on getting EAD. The process to apply for SSN is very simple. Go to the the nearest SSN office and fill an applcation form. You can either download it online or you can get it from the SSN office too. They will check your EAD card and passport and return it back to you.
After applying for SSN you should get it in mail in few weeks.
I applied for SSN one week after I got my EAD and got my SSN in less then two weeks.

It doesn't matter what the attorney is saying, because USCIS takes decisions based on their own regulations and memos, and not the advice given by Immigration attorneys to their clients based on their interpretations.
I have not come across any Memo, FAQ etc. from USCIS clarifying this point. It's a legal grey area just like whether a person can continue on H1 after using AP. Every attoney out there has his/her own opinion.
I'm not championing any view. I will be happy if AC21 could be invoked on RD. However, I would be interested in seeing the USCIS Memo, FAQ, or USCIS Field Manual for Adjudicators section clarifying this rule. Newsletter from an attoney will not do. I want to hear it from the horses' mouth.

I really like the idea of a comprehensive rally in all big cities on the same date as suggested by wonderlust. This can be planned at the end of this month which is about 2 weeks away and can be planned well. We have very good example of what worked and did not in San Jose. We will have all time to plan and attend.I am willing to give time and energy to co-ordinate this. maybe the Core team can look into this.

To all those who said I shld return back before the expiry of my current AP:
I had a 2nd opinion from a different lawyer and got the same feedback... that I dont need to come back before the expiry of my current AP. Per this lawyers understanding of Addedum V on http://www.uscis.gov/files/nativedocuments/AILA_2Apr08.pdf , there is possibility of AP abandonment happening if its pending..but since mine is already approved, I dont have to worry.
2ndly AP never has approval dates on it... it is ideally a future dated document ( issued from the date of expiry of the current AP)... so even if it would have been approved before I left US, it still wud have the same "date issued". So the argument that I shld waited for the approval to get thru doesnt hold good.
I guess we all are going with the wrong understanding of this addendum. Just wanted to let everyone know in case someone gets into same situation as mine ( hard pressed to remain outside the country).
