Hi,
I'm E-filing my ead newal. My status is
I'm on H1B with wife being on H4. We both are July'07 filers and received EAD and AP last year.
We both went to India and used AP's while we came back as we had no Visa stampings on our passports. After returned to US, I'm back on H1 and never used EAD.
Our H visas will expire on 07/30.
While filling the I-765 application, I thought we both should put in 'PAROLEE-PAR' for Question(14) 'Manner of Last entry' AND H1(or H4) for Question(15) 'Current immigration status'.
My attorney mentioned that I should chose PAROLEE-PAR for both questions as we didn't file for H extensions after returned to US using AP. Is this right.

The 32 million will get insurance coverage only from 2014 from a govt created pool of private insurance companies, since the govt will subsidize 60% of that amount, dont think that the insurance will get much money from the govt.
Moreover when these companies have to accomodate pre existing conditions , a person can get insurance before going to see a doctor.So essentially the patient can rake a 20k bill to the insurance comp just by paying premiuim for that year.Just imagine if a company pays more to doctors than it gets from people???it will fall.
If a person can get insurance across state lines our insurance prem wud be lower and more ppl wud buy it instead of forcing people to buy from 2014.

The main idea of the Obama plan is to bring the insurance companies down slowly and to create a govt single payer system.

I-485 applicant (employment based) MUST have permanent job offer AT ALL TIMES until I-485 is approved.
This could be unfair to the I-485 applicant, but that's the law.

We are also one of the few who didnt receive any FP notices from last July I 485 filings.
Opened 2 -3 SRs , tried Infopass and several calls .No help so far .
Called the National Srevice center, they said that background check and namecheck will be initiated only after the biometrics. And the 6 month rul might aply from then.
If this is true, then we cannot even expect an LUD o our case as the biometrics are still pending .

pardon my language but I hate these mean a$$h0le (mostly desi) employers who do not give a copy of approved I-140 to their employees. Like the previous poster suggested, it would be best to move to new company only after proper checks and balances in place - get a copy of I-140, get H1b approval by premium processing. Best wishes and good luck to you. BTW dont share ur plans for employer change with anybody in your current company !

You talk about salary increase and they say you can leave the company, at the stage when you have your 140 approved and you are in your 5th / 6th year.

I think if your friend who came back to US on H4 even when her H1 was approved is in trouble.
Her H1 status was activated when her H1 was approved.If she came back on H4 it means that she invalidated the H1 and again activated her H4 status.
Currently if she is working somewhere then my advice to her would be to immdiately stop working as her current status is H4.

1) If I were you, I would do a H-1 transfer to new employer rather than use my EAD, assuming you have enough time on your H-1. You may or may not let USCIS know that you are porting off. If you dont let them know, I believe, right before they approve your 485, they will send a RFE asking for employment verification. At that time you can send employment letter from your new employer.
2) Filing AC-21 does not require any sponsorship. All the new employer will have to do is a) H-1 transfer b) use same ONet code as your L.C., check your LC and you will find this code. c) willing to provide employment verification, as and when USCIS needs it. d) basically support you at least until you get your GC. f) Oh the pay should not be outrageously high or low

As I have well passed 6 months limit, I am planning to change my employer. I am getting an offer for a full time position job with a new employer and my job profile is similar to what it was while I applied for Labor approval. I am planning to use EAD for new employment, as my new employer does not sponsor H1B. Here are my queries.
1. Is it safe to start working on EAD? I can submit AC21 for change of employer.
2. Does filing AC21 require any kind of sponsorship from my new employer? Can I do it my self without any involvement from new employer (except offer letter and pay stubs from new employer)?
3. Do I need to hire a lawyer for filing AC21 or I can do it my own personally?
4. Is there any time limit within that I need to submit AC21 after joining new employer?
5. As my H1B status will go off as soon as I use EAD and my wife and son will also loose H4 status. For my wife she can be on EAD but what about my son as I think any child below 18 years cannot have EAD? On which status he will be?

However, this separation can take place only if the filing fees for the I-140 and the I-485 were submitted as separate checks. If there was only one check for the entire filing, then the entire package will be rejected. For this reason, we at the Murthy Law Firm always require our clients to issue separate checks for each form to avoid rejection of the entire package, whenever possible. Even in the I-485 package, we recommend including separate checks for the I-485, the I-765, and the I-131 to avoid a problem with one form affecting the entire filing.
There are many who are still trying to figure out what to do about the fact that the U.S. Department of State (DOS) raised their hopes and then both the DOS and the USCIS dashed those hopes by announcing the "unavailability" of visa numbers and rejection of I-485s in July 2007. There is much concern over whether the unavailability of visa numbers by the USCIS issuing approvals is valid or illegal, since there are many irregularities in the procedures that were followed. Our firm has become aware of older I-485s (filed well before June / July 2007) that were approved in error in June and at the very beginning of July, when there were no visa numbers available for those applicants in either month! Another problem likely to be mentioned in the lawsuit is that the USCIS counted, or allocated, a visa number for those I-485s that were pending security checks for several months, or years, without issuing the I-485 approvals! This also violates the law and regulations, as visa numbers are not supposed to be "reserved" for cases. They are to be assigned with a case approval.

Somehow the imbeciles at USCIS have forgotten that pay will increase based on prior experience and performances!! They have forgotten the concept of "EXPERIENCE". There should be NO upper salary limit beyond the prevailing wage for adjucating AC21 - I-485 based on salary provided the job has same or similar duties!

I need to tie my laces...should i bend down or sit down on a chair and cross my leg?

It is good to be skeptical. But I doubt it is anything but the card (hope I am right, for your sake), because the status says 'Document production or Oath'.
