There is a story: when seeing a bottle filled half with water, optimistic people would say it's "half full", pessimistic people would say it's "half empty". I think this problem is also just people's perspective. Retrogression is still there, it will not be any better or worse with/without the July event. Some people see that retrogression is still there so they are pessimistic, some people see that at least you get something from this even, so they are optimistic.
I see this prediction every now and then. Why don't you guys get your facts straight. Retrogression will remain the SAME. The pace at which they process GC's is not going to change. It's just applications moved from your home queue to the USCIS queue. Why would that make retrogression worse?? Think before you talk!!

Lunch is supposed to be taken at cafeteria not at cubicles.It doesnt matter whether it's curry or burger.Both smell bad.
The project where I worked in the past does not have a cafeteria at all. All my friends/colleagues used to eat at their cubicles only. Is there some kind of unofficial rule that you have to eat at a cafeteria. I feel most small companies do not have a cafeteria. I've seen in different projects that I worked, most employees whether desi or somebody else ate at their cubicles only.

EB3 ROW PD is back to 2002, as mentioned in this thread, however this case (like my own) highlights that you don't have to have PD current at time of GC approval. What makes this extra surprising is that this is a JULY filer (I was June).

2. I think you DO need PD to be current for GC approval. In best case scenario, GC could be approved in matter of 10-15 days, so for July filers there were some GC numbers available, and few lucky ones got their approvals. This is how I see it... please correct me if I'm wrong.

Seems like we missed a golden opportunity in this bill. Is this the must pass budget bill? or related to troops in Iraq? I am suprised to see that this went completely under radar. I will write to my senators to thank them for the support (though it failed its nice to see their support).

Or for that matter can you legally proove that not applying for US GC is the barometer of patriotism towards India for an Indian?

Anyone got their AP renewal approved? How long it is taking these days?
I applied for EAD and AP renewals concurrently on May 28th and sent following support docs for AP.
1. 2 photos.
2. old AP copy
3. I-485 copy
4. Passport biometric pages
5. EAD copy
FP appnt on June 23rd.
AP Approved e-mail on June 23rd.
My wife's Receipt was just 10 nos difference but she hasn't got it yet.

I have been a big fan of IV and have been a visitor to IV for a while. I now plan to become a volunteer and join my state chapter and also contribute in all possible ways to IV because I think IV is the best thing to happen to this community.
Dear gurus - here is my issue and I need some real concrete help.
I was working for a New Jersey based consulting company on a percentage basis ie 80/20 and all costs towards GC and h1b were by me. I found my own projects and negotiated my own billing rate.
I worked for this company for 3 years and filed for 485 in July 2007. I am EB2 India with a priority date of March 2nd, 2006. My 140 was approved in June, 2006.
In March, 2008 my project got over and I started looking for new projects. Market conditions forced me to take up a fulltime job using my EAD and I had to move into a fulltime job.
As it is safe past 180 days, I used AC21 portability and moved.
I had been having excellent relationship with my desi employer and in fact also payed up some money to the employer because the client did not pay for last 2 months of my project and my desi employer held me responsible as it was me who negotiated with the client and said it is my issue - for which I agreed.
I already sent a AC21 letter to USCIS through my Attorney - I am not sure if my file got updated.
My desi employer wants to withdraw the 140 petition now. He says, he cannot keep 140 petitions of employees who leave the organization and not on w2 and he will have "ability to pay issue"
I have heard horror stories of USCIS issuing denials and NOID because AC21 letter never reached the file even though it was sent in time and I guess this is exactly what my desi employer thinks - teach lesson by withdrawing 140.
I spoke to my Attorney and she says "your file may not be updated but we will keep a record that we sent" useful in case we want to respond to NOID or RFE.
Folks - please post your AC21 success/horror stories when previous employer withdrew the 140 petition.
What are my options to avoid a NOID or denial

I pleaded them not revoke the I-140 but they said they have to withdraw it as they do not want any liability. My company has about 30,000 employees. I also have the same question as to how I should avoid NOID or denial.
I have seen lot of people switch using AC21 but most of their employers do not revoke I-140. I have yet to see cases where a person's I-140 was actually revoked after 180 days and they were still safe and got their GC approved.

The immigration issues revolve around the DOL, UCCIS and DOS etc. They should grow and mature, showing efficiency and productivity. For that a new mindset is needed fortified with human resources and budget appropriations. My labor clearance was stuck in SWAs and backlog centers for 3 years. I talked to the SWA officer in charge in my state of CO. He said, this is federal work and there is no money appropriated.
Here is the showcase of how the USCIS works on legal ALIENS(from reliable Ombudsman report):
FBI Namecheck status (pg. 37 of the report)
As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year. While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year � over a 44 percent increase in the number of cases pending more than 33 months.
It is easy to see how border fence, employment verification, Border Control, DOL, FBI, USCIS will TOTALLY fail when you bring in 12 to 20 mil. I see no hope, eihter for anybody. No wonder, many are shouting at the top of their voices voicing strong objection.

1) Find solution to employment based greed card retrogression
2) Labor delay in the backlog centers.
All the members of this non-profit organization are facing severe problems due to these issues. We have started the awareness drive and professional strategic help (lobbying) efforts have started for the new Comprehensive immigration reform bill due on the floor of the Senate and House in Spring of-06. To make a difference and to have the new law passed in the way the current visa retrogression & Backlog center delays cane be addresssed with the new bill, I would request you to please spread this message or forward the email to as many people as possible.

To make an impact, we need in the order of 50,000 to 100,000 letters with their personal US address on it. Anything less doesn't hold any water..
From what I remember, when we wrote to President Bush, only 5000 letters were sent.
I dont think a number like 50,000 could ever be reached.

i do wonder if the poll results from earlier polls if used to compare with the current one would help get an idea of the trend - kind of overlaying the snapshots in different points in time and then determining what the situation was and what is and then extrapolating based on data that is already known/ published by uscis applied to the trend. question is if we have the poll data from earlier polls?

This question has been bugging the HECK out of me as well. I mean the only way this makes sense is if 245(i) + EB3 for India >> 245(i) for Mexico. Now from all that i have read/heard/seen, it seems like 245(i) is the major hurdle. Then how is it that EB3 India is stuck and everyone else is moving? The above equation must mean that there is a SIGNIFICANT number of 245(i) cases from India as well. Any thoughts anyone? :confused:
There is a general assumption that there not many 245(i) cases from Indian nationals. In reality, there are many people from India working in Grocery stores to Gas pumps applied for 245(i) during that period.
