3. EADs � What should an applicant do when it has been more than 90 days from filing and he or she has not received an EAD receipt notice or the EAD itself? How will USCIS be able to issue all of these EADs when it is delayed in issuing the receipts?
* Response: We understand from USCIS that they intend to finish receipting and issuing all EADs by the end of October, if not before. I called USCIS and I was told that it may take another month or 2 for EAD card as they are heavily backlogged. I have also send email to Ombudsman.

Canada and US are two different countries with two very different procedures. One GC has no bearing to another - all that matters is, which one you will be able to maintain.
It appears that you can maintain ONLY one at a time. That makes sense. Help me out - what happens if you get Canadian GC first (which is more likely ...due to retrogression, etc)? Do you have to abandon US GC process? OR could you wait until US GC process is finished and decide which one to keep?

Folks,
I see many many approvals and which is really good....my concern was for those cases which got shuttled around and tossed among centers. My I-140 was approved in TSC and I-485 submitted in TSC but was sent to CSC for data entry and re-sent back to TSC...So I have a WAC receipt no...i know WAC stands for Wacky too and literally so....
I read in one of the threads that EAC folks are getting fingerprint notices post approval too. I have an infopass apt tomorrow in Mass. I need to know should I ask about biometrics data upload or not....I received online case approval but my wife didn't her case is still showing as Case transfered to the center that has jurisdiction over your case...since last one and half years...I had got RFE last year but not her....I hope her case didn't get sidelined or forgotten...it is quite important that she also gets the approval....she had opened an SR on Friday....and we have an infopass appt t'row...
Is it possible that the reason I didn't get CPO or welcome email but just an approval email is becoz of the biometrics problem with transfer cases...anyone on the same boat?
If you guys think anything particular to ask plz let me know....it is quite a drive and I don't want to waste it....

I actually made someone in my family do this when they changed houses as they had no idea about this (GC holder for 15 years). that person was so mad with all the rules WRT transit visas (travels extensively) that they decided to get their citizenship finally. :-))

As long as you are following laws and can justify reenter any time. My friend has made 3 trips of 3 months duration on B1 visa. I believe it should be fine unless you are asking them to reenter after every month

Hi,
Just trying to see if anyone is or was in the same boat as i am.
For GA license renew ,DMV officer had me go through the SAVE system as the EAD start date was in future.
Now the question is how long does this process actually take and did anyone face any issues with SAVE verification.

Why does diversity make sense for family based GC's only? Do I sense some arrogance in the implication of that statement, which would be that employment-based immigrants are raceless and bereft of some ethnicity? Do they come from one nation only? I don't think so!
The fact of the matter is that employment-based immigration does affect the demographic landscape of the nation. This is a very funademntal idea that is lost on some people in this forum. True, in EB GC's, you are not given permanent residence as in FB or in diversity-based categories, but everyone comes with a certain race and ethnicity (yes, even skilled professionals!) - that's part of evryone's baggage!
Imposing country quotas on H1-B1 visas is not (definitely not!) a solution, and in fact it would wreak havoc of a must surreal kind. If people are hurting because of the retrogression now, they'll be hurting even more trying to find jobs, if this crazy measure were to be adopted.
As for F-1 visas, no school gives out admission to any program worth its salt merely using the nationality of the applicant as the deciding metric. Just like business, these are merit-based decisions. One gets a job ostensibly because one demonstrates the right skills, the appropriate background and the right aptitude for the job.
A short-term "solution" to retrogression is capture of unusued numbers and transferring them to over-subscribed categories. Also, spouses and family members should not be taking up precious numbers of EB applicants.
Long-term solution: I have a feeling that no durable long-term solution will emerge untill after the dust settles from the elections this fall.

I mean guys sitting on the top of CIS are the one making the decisions and I dont beleive IV members will be paged by CIS when a decision is made. I also do not beleive that CIS is negotiating with any non government organization (i,e AILA, IV or anyone else). I doubt if anything is going to happen..after all but I sincerely hope I am proved wrong.

I believe she is right in deciphering that. AC21 is only while I-485 is pending. As I undertand, approval of I-485 changes your state from Pending AOS (if not wrong Conditional Resident) to Permanent Resident. And since, your green card is approved with whoever you filed as your employer on I-485 application (or last invoked AC21), you need to stay with them (may be different if AC21 was invoked).

Guys
Despite all but one reasons to the contrary, we decided to use BA. That one reason was price (no surprises here).
We bought the tickets in January and waited till May for the date to come current, so we may travel on GC rather than DATV. As we all know, the date actually went back.
After a little bit of procrastination from both and some reckless assuming from my spouse, we reached a stage where we had a full Wednesday, a full Thursday and a bit of Friday left to apply for the DATV for my spouse from scratch and to get our kid's passport and post-biometrics documentation to the UK consulate and get back both their passports with DATVs.
The reckless assumption was that an approved but unstamped H1B (basically just the I-797 Notice of Action) was good enough to not require a DATV for my spouse.
Besides, we did not read the instructions on the DATV paperwork carefully enough to note that we actually had to Fedex the docs and passport to the consulate. My spouse just went by what the staff at the biometrics center advised, which was that you are done and good to go and basically wait for the visa (even with the kid's passport in our possession)! Yes, that was way dumb on our part.
So we woke up to this in the afternoon of Tuesday and soon had friends sending us information and offers of logistical help. My spouse applied for DATV online that afternoon and secured a Friday appointment for biometrics. That was the earliest available and was also the date of their flight!
Taking a chance, my spouse went to the biometrics center Wednesday morning and managed to get the fingerprinting done by 0815. Then we drove to the UK consulate, hoping they would entertain our case as an emergency.
We might as well have hoped for a date with Rapunzel. It was not ivory but it was a tower alright. My best people skills succeeded in persuading the lone security official downstairs in calling upstairs. However, as per his prediction, all that came down was just another security official who said absolutely nothing different, which in essence was: You are not allowed to go upstairs. They will not entertain ANYone (obviously excludes the President, the Queen and other such people) unless there has been a death (their accent made it sound like the word 'deaf') in your family (and we couldn't think of misusing that for our case). The window opens for visa agents between 0830 and 0930 and since it was already 1030, even a visa agent couldn't do squat that day. Applying directly is only possible through mail and it will take a minimum of 5-10 business days to get the visas. However, here is a list of visa agents with their contact info who might be able to help you get the visas quicker
Meanwhile, a lone visa agent was interacting with my spouse in the same lobby. He was in the printed list given to us and since he was already talking with us, we decided to go with him. He said he was going to charge us $100 per DATV for his fees. We were free to leave our papers and passports with him right then or we could show up at 0830 the next morning for him to take the papers in. We elected to do the former.
This guy then applied for our DATVs on Thursday morning and asked us to come collect them Friday morning (day of the flight), which we did. All went well thereafter and a little bit of carelessness cost us $200, loss of sleep, loss of work-hours but also reassured us that we have some great friends around us.
Here is the whopper though. Noblinkingbody ever ever asked to see these DATVs all the way from US till India! Is this then just a sham for law-abiders? Just emblazon some logicless words in some officious location and amuse yourself watching these worker bees make a line carrying them out at some undeserved expense to themselves?
You know what though! I asked myself if I would still apply for a DATV if required and with all this information in my mind, my answer was an unwavering yes. That's how I fear a lot of us might be made, which is why we continue doing the lawful and the right thing while accepting the step-parental treatment here in this country.

You were probably lucky to not get checked. Several years back I took the German transit visa for Frankfurt and they never checked anything , not even in Dulles airport, they just looked at the boarding pass and let me in(it was never checked at the small airport where I started the journey). However, I know a friend who bought a ticket on Virgin Atlantic from Boston and at the gate they denied boarding to him for lack of transit visa, but they refunded his credit card immediately and he had to call his agent from the airport to get a KLM ticket at much higher price. I think better be safe than sorry.
Despite all but one reasons to the contrary, we decided to use BA. That one reason was price (no surprises here).
We bought the tickets in January and waited till May for the date to come current, so we may travel on GC rather than DATV. As we all know, the date actually went back.
After a little bit of procrastination from both and some reckless assuming from my spouse, we reached a stage where we had a full Wednesday, a full Thursday and a bit of Friday left to apply for the DATV for my spouse from scratch and to get our kid's passport and post-biometrics documentation to the UK consulate and get back both their passports with DATVs.
The reckless assumption was that an approved but unstamped H1B (basically just the I-797 Notice of Action) was good enough to not require a DATV for my spouse.
Besides, we did not read the instructions on the DATV paperwork carefully enough to note that we actually had to Fedex the docs and passport to the consulate. My spouse just went by what the staff at the biometrics center advised, which was that you are done and good to go and basically wait for the visa (even with the kid's passport in our possession)! Yes, that was way dumb on our part.
So we woke up to this in the afternoon of Tuesday and soon had friends sending us information and offers of logistical help. My spouse applied for DATV online that afternoon and secured a Friday appointment for biometrics. That was the earliest available and was also the date of their flight!
Taking a chance, my spouse went to the biometrics center Wednesday morning and managed to get the fingerprinting done by 0815. Then we drove to the UK consulate, hoping they would entertain our case as an emergency.
We might as well have hoped for a date with Rapunzel. It was not ivory but it was a tower alright. My best people skills succeeded in persuading the lone security official downstairs in calling upstairs. However, as per his prediction, all that came down was just another security official who said absolutely nothing different, which in essence was: You are not allowed to go upstairs. They will not entertain ANYone (obviously excludes the President, the Queen and other such people) unless there has been a death (their accent made it sound like the word 'deaf') in your family (and we couldn't think of misusing that for our case). The window opens for visa agents between 0830 and 0930 and since it was already 1030, even a visa agent couldn't do squat that day. Applying directly is only possible through mail and it will take a minimum of 5-10 business days to get the visas. However, here is a list of visa agents with their contact info who might be able to help you get the visas quicker

My lawyers sent a copy of of my 140 receipt and a letter explaining why they should upgrade my 140 petition to premium. Fingers crossed.

We don't know what USCIS is doing these days. I heard something weird scenario with one of my friend's case. He got a NOID asking for ability to the pay of the Petitioner. But my friend already left the petitioner company and joined other, using AC21. Later his petitioner company went out of business. The same thing his attorney replied to the NOID and to my surprise, last week USCIS sent a notice canceling his I140, stating that his petitioner is no longer in business. This is totally weird and unfair.
Guys... i have the exact same problem. Moved to new company and filed AC21. Got Notice of Intent to Revoke on i140 because older petitioner company went out of business (it was still in business when i moved). Lawyer replied to it but i140 was revoked and i485 was also denied after a week of i140 revocation by USCIS. Can you tell me how your friend handled this. It would help me a lot....
