i normally would stay away from rumor mongering - but one of my friend told me a guy from Citi holding h1 was not allowed to enter cause Citi has taken TARP money.
Can anyone from Citi confirm if this really happened (check with lawyers maybe?)?
Has the TARP officially come into effect for those retards to turn away Citi/BOA employees at the POE (even though its totally not their discretion to do the same, TARP doesnt mean NO h1B's its just means additional hurdles to hire them)?

Hi All,
The Murthy website has posted some really nice FAQs on AC21 with good mentions about the actual memos etc
Part one:
http://www.murthy.com/news/n_nuacp1.html
Part two:
http://www.murthy.com/news/n_nuacp2.html
If someone has posted these previously, I apologise.
(Far be it from me to actually praise any law firm but this is a good job according to me. No i am not a Murthy.com customer or the webadmin, not have I ever worked with them.)
This is definitely very helpful for folks who are thinking about a job change on AC21 :)

two years is the generally accepted threshold for WOM. Also, the US attorney's office handles immigration cases, not the DA's office.
If your visa numbers arent current, the US attorney will usually move to dismiss however it really depends on the relief you ask for.

The other my concern is if an employee may come back AFTER working for employer B.
another transfer application will be required since you have worked for the employer B.
btw, some people say you will also need 2 pay stubs from employer B to transfer next time, however it may be enough to have 1 stub from B and 1 stub from A to show you maintained H-1 in the past, but I am not sure about it.
applying for another H-1 for the period you work for B is not neccessary for A, unless he wants you to work on some project during that time. But for you to return he will have to amend both LCA and I-129 again. So there is no advantage unless A wants you to be envolved in projects part time.
this article - http://www.murthy.com/news/n_pth1re.html - discusses part-time H-1B questions. It also highlights possibility for part-time H-1B to have range of hours, such as 10-30 hours per week, and the rate must be per hour. The employer then must pay somewhat in between (i.e. falling into the range). They also state part-time H-1B is enough to stay in the USA.
actually, there is a benefit for your employer A to keep you on part time if he plans to employ you later on full time, as this http://www.immigration-visa-lawyer-blog.com/2009/01/h1b-visa-lawyer-on-part-time-h.html article say that changing hours (even from part-time to fulltime and vice-versa) is amended petition so the fee is only $320. while transfer application fees are the same as new application.
so you can actually go part-time with employer A and have employer B to file concurrent full-time H-1B which will be the same cost for him.

I just got my 3 years h1b extension approved based on my 140 approval (8th year to 10th year) and would like togo for stamping in Canada. As I live in NY, am wondering which is a consulate that people highly frequent. ie Tornoto or Montreal or Ottawa (east coast)
I work for a consulting company and do not have a US degree. So would also like to know if it even makes sense to go to Canada for stamping.

Gurus,
I left my GC sponsoring company this week for better opportunity. They sent me a letter stating that, they are going to notify USCIS about my resignation.
Here are my questions:
1) Should I file AC21 before they (GC sponsoring company) notify USCIS?
2) What will happen to my I-485 application once they notify USCIS about my resignation?
Thanks for your help and time!
1. It does not matter whether you file AC21 before or after your employer notifies USCIS. Since you are already working with a new employer, go ahead and file AC21 before your old employer notifies them.
2 USCIS can send an RFE/NOID on your I-485 asking for proof of full-time permanent employment in same/similar occupation.

Hello friends - I got a email updated from CRIS today stating that my Notice is mailed welcoming the new permanent resident. What does this mean? When will I get my approval of my 485 and when will I receive my physical GC?
Also I have done my FP on 31 July, 2007. Do I have to get a new FP done?
Any suggestion or feedback on my queries will be highly appreciated.
Thanks,
Rana

Buddy,
This is a very dumb advice to give anybody. Why dont you try and keep this to yourself. What the crap do you mean by this?
"If you try screw somebody before even they deserve, it may cost to us due to others stupid actions."
I'm sorry for you.
this is the result of whistle bowling...
I guess you were suggesting to whistle bowl to others , you might have whistle bowled.
But in this sucking consulting industry, we shd keep quiet till you get green card to hand, do not even think about any thing else like AC21. They are not safe .
Now it costed your green card.
AC21 is not law, if you go and check immigration-law.com Oh Matthew clearly mentioned taht these denials are meaningful.
So people...
Pls keep patience till you get GC w/o doing any damage to the onging process.
At the end of the day GC gives lot of peace & freedom to anybody.

I will keep quiet till i get my GC and i will show to employer once i get GC.
I hate it , but what else i shd do...Damage my processing.. No Way

If the USCIS does not adjudicate (approve or deny) the EAD application within 90 days (within 30 days for an asylum applicant), the applicant may request an interim EAD. The applicant may make the interim EAD request at a local USCIS office. The local office then will contact the Vermont Service Center (VSC). The VSC will review the application and try to adjudicate the initial EAD application, and avoid the need for an interim EAD. If they cannot complete the initial application, they can issue an interim EAD.
The alien applicant must go to the local USCIS district office with proof of identity and any documents that the USCIS has sent the applicant in regards to the employment authorization application.

Thats barely 2 days. It takes any where between 2 to 4 weeks.
In case of an extension of H1B by the same employer, does the employer has to pay any fee other than the 190$ fee? AFAIK, There is no need to pay either the 1500$/750$ . Can some one confirm?

Should be no problem invoking AC21 in your case.
