To my knowledge, AP helps in getting back into the country even if H1/H4 renewals are rejected at the Consulate for some reason. But not having AP along with I-485 should not impact your H-1B renewal as long as you never used EAD (or your spouse/children never used their EAD).

We now know that Immigration, especially illegal immigration is a big part of the American Health care debate. President Obama's prime-time address to Congress and the nation on health care prompted a Republican congressman to shout "you lie!" when the president covered Health coverage for illegal Immigrants.
The President said that his proposal would not cover illegal immigrants, a remark that prompted Republican Rep. Joe Wilson of South Carolina to shout "You lie!"
The president is correct: The House bill contains a section (Sec. 246) titled "NO FEDERAL PAYMENT FOR UNDOCUMENTED ALIENS," which states: "Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States."
However, conservative critics object to a lack of specific enforcement measures in the bill. They argue that the lack of a specific verification mechanism constitutes a loophole that would allow illegal immigrants to get benefits despite the legal prohibition. Republican Rep. Dean Heller of Nevada proposed an amendment to the bill that would have required the use of the Systematic Alien Verification for Entitlements program to check the citizenship of anyone applying for federal coverage or affordability credits. SAVE is the program used by Medicaid and similar entitlement programs. That amendment was voted down along party lines by the House Ways and Means Committee.
Republicans have a point here: More could be done to enforce the ban. But it's worth remembering that, as a spokesperson for the American Immigration Lawyers Association told NewsWeek, attempting to get a health care credit would have legal repercussions.
"Making a fraudulent claim to an entitlement program when you're not actually entitled to it would have serious consequences for any person," the spokesperson told Newsweek, "but especially if it's considered a false claim to citizenship, that would have serious immigration consequences that could ultimately lead to deportation." Moreover, if an illegal immigrant lies and obtain public assistance benefit such as the new health care coverage, such person may never be able to Immigrate or get residency. One of the questions on the Green Card application is exactly that - Have you ever received public assistance or benefits form the State? A yes answer may result in a denial. Finally, any person who is not a US citizen and claim to be falsey in order to secure a benefit, may be barred for life from becoming a legal resident in the future. So the protection mechanism is already set in our immigration system. Most illegals live with the hope of becoming legal one day, I am sure that not many will risk it just to get coverage.

We should plan to meet before xMas and the devise a plan.
Lets decide where we can meet and when we should meet.
I am assuming meeting is to inform/ educate legislatures about Immigrant and Non-Immigrant Visa issues.

Other Option is to come up with a separate legal immigrants BILL immediately.

I thought taking fingerprints for all visa applicants (with those age exception) is already in place. Looks like this new rule is only increasing the visa fees. Other procedures like whether to do a namecheck or not for a non-immigrant visa applicant is still the same. Is that right?

Guys Gurus,
I have send an email to US embassy in Islamabad Pakistan asking them about the document requirements for my wife to get her h4 visa revalidated.They responded me back with the following email below. Its seems to be a pretty lose response to me. I infer from this is that my wife can take the same package as she did the first time to get her visa stamped. When she went first time in 2003 I did not have visa stamped on my passport and only thing they have asked her is about my origional notice of action 1-797. Since she is planning to travel and I dont have my visa stamped but my h1 is extended till 2008 I am thinking she would be fine when she go for her visa to revalidate. I appriciate your comments and suggestions.

If it is not illegal, then why are you so concerned. Also, 19 years old is an adult, in US and in India. And If a 53 year old American has married a 19 yeard old American woman, and the guy is a cop, it is not illegal (definitely is twisted and makes one feel like throwing up, but not illegal, per US law). Why? because the 19 year old is NOT this 53 year old guy's neice or related to him in any other way, AND they are not engaged in Immigration fraud.

Hi.
Does anyone know how to renew the Driver's License in CA without EAD. My Wife's license is about to expire and she doesn't have EAD. H-4 is expired on Passport.
I see that I can mail the renewal application and its not asking any document but I m not sure if that will work.
Please reply if anyone has any information regarding this.

If your address is current, you will get a renewal notice and you can renew it online for another 5 yrs.
But if you don't get the renewal notice walk into your nearest DMV and get it renewed as anybody else who is GC holder or citizen. For renewal they are not checking any documents in CA. I renewed my license this path 2 months ago, since my address on file with DMV was not updated somehow.

This is true. I just got this confirmed with my lawer. You can get un limited 3 yr extensions on H1 till 485 is pending. I also asked him the question whitecollarslave has raised. I will update you with his response.

Hey Friends,
What's the scope of H1-B sponsorship for jobs related to MBA in finance these days. One of my relatives is finishing his MBA from a decent school (not top 50) and in all the campus interviews the employers want US citizens. He got selected in 2 great companies and the offer was withdrawn because he is not a US citizen or GC holder.
What are the options in terms of H1 sponsorship for an MBA in finance. Any small and good consulting firms who are still sponsoring H1s? Would love to hear from recent or current MBA grads. Thanks.

I bought a home in India using most money from my home equity line of credit taken against my home here in the US. This way I can easily deduct interest and the interest rates are 50% of the rates in India at this time.
