2. Check the Processing times for that center.
3. If Processing Date > Receipt Date + 30 Then True
4. If true, call 800 # use the POJ method to talk to a rep and say you need to open a SR as you are outside the processing window.
5. If false, keep looking when the condition #3 is true.
Pardon me for being ignorant but How do you initiate a service request, all I get on NSC number is automated messages.

February will be too late for me....but still will be good as compare to more than 12 months at Nebraska.
I am thinking of going back to India before my visa expires on 01/12/08. I have 10 weeks vacation, which I think should be keeping for later. Labor was not files 12 months prior, hence don't have 1 yr extension.
Does anybody know whether I should be in USA to file I-140? I think I am needed for 485 only, right?

I got promoted with a hike and then demoted with pay cut. It is all because my attorney was not agreeing with it as per the law. So it not only depends on the company, but also with the attorney you have.
As per the law, you can get promoted to VP or CEO. But once your 485 is adjucated, you have to take up the role for which your LC is filed. I do not know how insane the person is who formed this law, but it is the reality.
Again, if the person stays with the same company where the labor is filed and if 485 is pending for more than 180 days, then there is no problem in promoting this person. This is again as per my attorney. So this entire stupid law messed up my career.
I asked my attorney about this (she is my attorney, not the company's). What she said was that once the labor is filed, most employers are willing to go along with continuing to send USCIS info about the OLD title and position.
Even though the whole employment based green card process is supposed to be for a future position, it is not realistic to assume that a good employee will NOT get promoted in the 3-8 years that the process usually takes. As an example, my cousin, who is in a Wall Street firm, has been promoted 3 times in the past 6 years and is now a vice president. His labor, filed in 2003 for an IT analyst position, is still stuck in the Philly BEC!
What it comes down to is this: you are at the mercy of the company when it comes to promotions.

My H1-B expires in Aug 2007. My I-140 Is filed in November 2006.
I can get my I-140 cleared through premium but lawyer is suggesting that this is waste of money as I-140 may be cleared by April/May 2006.

First off, try to be civil. No point in calling them names. I know you are frustrated. But try to learn from that experience and do not make the same mistake when you find another employer.
The resignation can be as simple as below. If you get a letter from them acknowledging your resignation, file it away. If not, keep the email electronic copy for your records.

Can i take "unpaid leave" without having any paystubs?
- My employer had given me an option - He will generate the psystubs but I have to pay 2000$/month.
seriously dude..i do not support doing this kind of illegal things where someone would run the paystub for you (when you are not working) and you will be paying them. We are high skilled people and at the minimum we should refrain from doing wrong things like this. I for one strongly suggest you not to do so. Sorry dude didnt mean to burst out on you, I just hate things like these, including the labour sub crap that happened couple of years ago, where anyone could purchase a labour certification and due to which you will see so many genuine people who are waiting even from 2001. This is just wrong.

My younger brother has a visa interview next week at Delhi consulate.
Some facts
-I am on h1b (came as a student in 2002)
-My Parents are currently in US. This is 3rd trip to US.
-My Sister and Brother in law are GC holder alongwith 1 GC holder kid and 1 USC kid.
-We are expecting :)
I am not sure how these facts will be seen @ visa interview by the officer as he can easily think that my younger brother is a potential immigrant.
There is one big supporting fact and that is my brother has an admit to IIM which he has to join in Jun last week. He just wants to come here for 1 month.
Anyone out here has any suggestion which might help for stamping? DS 156 I have clearly disclosed about my Sister having a GC and parents being here can be asked in interview.
Any suggestion will be highly appreciated.

Most of the schools will not let you use CPT or OPT in first semester. In some schools you have to wait until you complete 2nd semester.
Take this into account before you make your move.

Hi,
I have a question regarding Pending AOS status and Expiring I-94 and whether this is an issue. Last time when I entered USA using Advance parole, my I-94 was stamped with a validity of one year (which I think is normal) but now its expiring and my I-485 is still pending. I am working on EAD and I am EB3 ROW (priority date not current). Can anyone provide some details on whether expired I-94 will be an issue during pending AOS? Normally, I-94 determine the status but I am not sure while in pending AOS. I read lots of thread saying expiring I-94 is not an issue but have not seen any official note from USCIS or DOL saying so. My lawyer said this is gray area.
I know lots of people will be in this situation specially because of July 2007 fiasco. Please provide your experience. Do we need to do anything with expiring I-94 during pending AOS with EAD?

How could they close I-140 while I-485 is still pending approval. She took my case to her boss who also said they are helpless. My A# does not pull up my approved I-140. And like someone else suggested - we might have to call them up for attaching our biometrics too. This system is so screwed up. If we got to do everything, they might as well handover the entire process to us.
