Two more points:
4. The INA says that visa number needs to be available when application is filed (8 USC 1255). The USCIS manuals also prescribe reserving the number at the time of filing. However, the USCIS does not do that.
5. The visas number were lost due to USCIS inefficiency. Nothing in the INA precludes USCIS from recapturing those numbers. Lawsuit can be filed to force the USCIS to re-use those numbers. Read these court orders

Stourmi,

The "forced focus" button is under your right thumb as you are shooting, right next to the auto white balance. it looks like three horizontal dots. You can use the button to toggle through auto, left, center and right focus points.

White balance button, point at something white, press WB button with thumb and press trigger. A little awkward, but I got used to it.

in the end when you think ..it is just a card that they can print and give ..esp to those who are in the queue for more than 5 years with US born kids ..the advantages are huge for US ..as people once their status is permanent, they will invest more in homes, cars etc ... such a simple concept :)

Thats the best post i have seen for some time... But common sense aint so common.. The system is broken and India-EB3 are just a small sub set who are affected NO ONE else is affected so it's going to status quo for some time unless there is a change of law..

Make sure that your I140 is not revoked for atleast another 6 more months so that you can file AC21.This is very critical.
Coming to AC21 rules the job must be similar. For ex if LCA mentions Architect - Storage the person can go on doing Architect - J2EE or Content Management or RFID Solutions but not Product Manager. The job can have little variations but not much room for improvement. A Architect can file AC21 as Sr Architect but not like Pricipal Architect or Chief Architect :) which is considered a total change in job responsibilities.

Please make sure you have healthy relationship and frequently talk with the company officials from time to time. Your best bet of survival is totally on I140.

I am sorry if I offended you. Didn't mean to at all. Just low salary compared to my project and work is really frustrating. But because of current economy, company is not willing to adjust the salary. Calls from other employers for job are also frustrating because I know they want me and will pay me lot more. But GC is too close to do anything stupid.

After all the replies, I think I am going to stay put here until I file 485. Moreover I will try to find consulting agencies like you suggested in case something bad happens.

My wife got an RFE last week too saying that they do not have the Medicals. Quite obviously we had done the medicals and sent it during the July 2007 fiasco. At first I thought her lawyer may have screwed up, but seems like many people are getting RFEs for medical even though they had sent them in.
Looks like USCIS in their hurry to meet their numbers prior to some deadline wants to atleast send out RFEs so that they can officially claim that the cases are on hold pending eveidence from the applicant. Sounds like we all have to suck it up and do the medicals again.
