any idea how much time it is taking now a days for getting AP approved. I efiled mine on Sep 15th and sent the photos/docs on 21st Sep. Still waiting for an approval.

I think CNN knows it very well and allowing it (if not encouraging it) because it helps their ratings. I don't think we have sufficient numbers to influence the rating of this program. I for one stopped watching it.
I don't remember exactly what the issue was , but we have written to CNN about their false propaganda and insufficient coverage of facts in the past, but if I remember correctly their response was some thing like, I am paraphrasing here, we don't give rats behind on what you think.
There was a segment on John Stewart's Daily Show on how CNN/Lou using scare tactics about immigration. Very funny and insightful at the same time. This segment was done by John Hodgman. It was re-run yesterday. I guess we can create some thing like that (Juxtapose his falsehood with facts) and post them on YouTube.

Are you sure, they are going to pay you less than in LCA? If yes take one check with lesser amount and complain to labor dept. Also move your H1B to another company. They can't complain against you. They breach the agrreement with you and labor dept for the salary, if they cut your pay. So you have a case against them.
If it is yearly rate, he can pay you $1 for each paystub after the amount mentioned in the LCA. He need to pay you for 12 months.

If you have an H1B sponsoring company offering you a job, you don't need to transfer H1B, file fresh H1B (this year quota is still available and will stay available for next few months).

My situation:
H1-B 5.5 years, I-140 approved 1.5 yrs, I-485 pending almost 2 yrs, priority date just got current (JUL2004). Got laid off and will have January check as last pay check. Spouse is on H1-B, whose job is relatively secure for the short term, whose I-140 approved as well but didn't submit I-485 (PD is about beginning of 2007).
1) EAD/AP expire at the end of March. Should I renew EAD/AP now? The company will not do it, if I apply it on my own will CIS notice this and send me an RFE? If they do send me RFE asking for employment verification letter can I fax back a letter (I believe my company still counts me as an employee now) without letting them know I got laid off?
If company won't revoke your I-140 & 485, go ahead and renew both your AP and EAD. You can do it yourself. No need of a lawyer. ( I have done this twice myself)
Find same or similar job matching your current position and use AC21 to change jobs.
2) Regarding H4 application: what's the best way to do it, apply on my own or use an attorney? Do I have enough time to do it in one month on my own?
If your I-140 & 485 won't be revoked by your company, continue in AOS status and look for a job. In worst case scenario, you can always go to your home country and get H4 stamped on your passport.
In AOS, one need not be working all the time. When your I-485 is about to be adjudicated, you should have a same or similar job offer. Clarify this point with an attorney.
3) If I find a new job quickly, given that I'm in my 6th year of H1-B, will the new employer be able to transfer my H1-B? Do I have to leave the states?
If you find same or similar job matching AC21, you can continue working on EAD for the new employer. ( In a bad job market, it is safer to be on EAD)
4) If my 485's approved but I don't get the card mailed to me at the time I start my new job (if any) is there a problem?
When you find a new job, have your own lawyer represent you. Ask him to represent you on your GC process by filling in appropriate forms. If you change your address, use AR11 form to change the address for your I-485. That way you won't miss your green card.

is this the first time you are applying for AP, if so you have to give the reason a letter if you will stating the need for AP otherwise you are good.
Please take a look at my blog, it has details on the cover letter and list of docs very similar to OP.
I have always used them for renewals, hope it helps.

Thanks for your blogs. I think drivers license copy is not needed if you are applying for an EAD extension. Copy of old EAD is enough. Only new filers need to send drivers license copy ( or some other form of ID).

No you do not have to maintain H1 status. Why don't you ask your lawyer, why in the world would you renew your EAD if the I485 would be denied if your H1 status went away.
Seriously man your company needs a more informed attorney.
PS: A lot of attorney's are trying to exploit the USCIS memo a few months back to create FUD amongst employers to force you to extend H1 instead of using EAD. Your lawyer is probably trying to get your company to file a new H1b for you. Please remember in such an event you will need to travel out of the country to get it stamped.

I just read the INA. Nowhere it mentions about chargeability based on Child. It only mentions Spouse. So CIS can argue that granting of GC to parents based on Minor childs country of birth is not part of the law. Lawmakers can add this clause if Obama wants with the help of CHC and enact. If only our famous Mr. King doesn't kill it with 100,000 amendments. But in the current law, it is not mentioned.

On #3, the H employer - by law - is required to notify USCIS if the employee moves on or never joined the company which will cancel the H-1b. In that case, if she intends to move back to H at any point, she will have to get a brand new one which means taking chances with the lottery.
Does the employer still need to notify USCIS if the employee worked on H1 for a month and changed to EAD.....I am assuming in this case since the employee worked on H1 for a month, he/she will not be counted in the quota if he/she plans to change to H1 status in the future...
