Hi all,
my company gave me receipt number of i 140 filing and I checked online it shows following message:
//Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER
Current Status: Case received and pending.
On May 16, 2007, we received this I140 IMMIGRANT PETITION FOR ALIEN WORKER................//
does it mean they applied my i140 on May 16 or before?
i sent them paper and money in feb only. but looks like they applied in May when i asked for reciept number. Am I right?

checked with my lawyer today... my application reached nsc at 7:55am on july 2nd but as of today checks havent been cashed, not receipt issued.
I self filed 485 and mine reached NSC on July 2nd at 7:55AM.
August 17-30 I am going out of town and was worrying that if they issue receipt notice soon then during late august I might get FP notice and in that case I willl miss it...
May be I am worrying too much...
Who will get receipt notice first... will it be FIFO??

Your Attorney is not correct. I am in exact same situation(AC21 new employer on EAD). My EAD card production was order last week and approval notice has been sent today.For immigration status select c(9) AOS Pending option if you efile.

As far as I know, you can always take leave without pay and studying is a very good reason. I'm right now on leave without pay and pursuing my master's for 7 months already, my attorney said it's not a problem at all (hope he is right).

Invitation letter is not at all mandatory. But since you insist so much, google "parents US visa invitation letter" and the very first link is your answer.
I assume you would at least modify that format to fit to your housewarming occasion.

DL depends a lot on states.
i have lived in MI, OH, CA and VA. Visit many other states often.
IV core - pls consider taking up this as a part of the problems faced by the community - changing jobs and relocating - a major detriment is getting a new multiple year Driver's License.
I remember walking_dude represented IV at a hearing about the driver license issue in Michigan. This is definitely a serious issue.

did any of you guys got the new pp frm sfo after a long wait..if yes pls reply on the duration.
I sent it on Jan 4th and they received it on 8th. I keep calling them every week and last Friday they said it'll be mailed out that day. They asked me to check back again on Monday. I will let you know the latest status EOD today.

Whether that is good or bad is certainly open to debate. But one of the unintended consequences of these changes is that many legal immigrants are having trouble getting drivers licenses either because the new laws are poorly written or because department of motor vehicle officials are not very knowledgeable about the immigration laws they are supposed to be interpreting. I don't have option, in fact my labor was ms + 2 years and my attorney filed I-140 under EB3.
check_rd is this a different position?
you cannot(risk of RFE and rejection) apply for EB2 if you have already applied for EB3 for same position and same company.

The risk is always there whether you are entering using AP or visas like H, B or F etc... In the above example, note that I-485 was denied while he was abroad.
So, while you are abroad and your I-485 is denied, you cannot enter the US using AP. Its as simple as that.

House GOP to hold hearings on Senate immigration bill

Republican leaders in the House are organizing a series of committee hearings to examine Senate-passed legislation to restructure the country�s immigration laws.
The leaders clearly intend these hearings to increase their leverage on the brink of a tense bargaining session with the Senate. A procedural measure has stalled the bill indefinitely, preventing leaders from naming conferees.
Speaker Dennis Hastert (R-Ill.) convened a meeting in his conference room yesterday morning with most of his elected leadership and nine committee chairmen. None of the leaders or chairmen made an official announcement upon leaving the meeting but confirmed that committee hearings were in the works.
�We want to have hearings on this bill,� Hastert told reporters yesterday. �I�ve asked the various chairmen to go out and have hearings so we understand what the American people are saying.�
The immigration issue pits a majority of GOP lawmakers in the House against President Bush and a handful of Republicans in the Senate. Despite an uproar of opposition to the president�s guest-worker plan, the administration continues to pressure Republican lawmakers in both chambers to support comprehensive reform.
Bush has toured the border in recent weeks with congressional Republicans, and Commerce Secretary Carlos Gutierrez is touring parts of New Mexico and Texas this week to push the president�s comprehensive reform plan.
�We need to have comprehensive reform,� Gutierrez said in a phone interview from Odessa, Texas. �In order to secure our borders, we need to secure our interior and enforce employers.�
Gutierrez echoed Bush�s contention that border enforcement is the primary goal of any reform measure but that it is impossible to address enforcement realistically without accounting for the estimated 12 million illegal immigrants already in this country.
The commerce secretary said it is imperative for Congress to work together in resolving this complicated issue and find a workable solution on which all sides could agree.
�The fact that it is complicated is not a reason to delay,� Gutierrez said. �It needs to be resolved as soon as possible.�
The House hearings would begin in July and run through August, members said yesterday. The special sessions would be held both in Washington and throughout the country. House Majority Leader John Boehner (R-Ohio) said one goal of the hearings would be to address specific components of the Senate bill.
�We want to have a very clear idea of what is in the Senate bill and what some people think of some of the provisions in the Senate bill,� Boehner told reporters during one of his regular weekly press briefings.
He pointed to language in the Senate bill granting illegal immigrants the benefits of in-state tuition as one example of a Senate provision he objects to. A senior GOP leadership aide in the House said members also oppose provisions in the bill written by Sens. Edward Kennedy (D-Mass.) and John McCain (R-Ariz.) that would allow illegal immigrants to collect some Social Security benefits, as well as a provision that would require the undocumented workers to pay back taxes for just three of the five years leading up to their application for citizenship.
While a spokeswoman for Senate Majority Leader Bill Frist (R-Tenn.) welcomed further inspection of the Senate measure by various House panels, Kennedy was less than enthused that House lawmakers want to inspect the Senate bill any more.
�This is clearly a delay tactic by House Republicans who have been dead set against comprehensive reform from the beginning,� Kennedy said in a statement released by his office. �We face an immigration crisis, and we need prompt and comprehensive action to address it � not more hearings.�
In addition to Hastert and Boehner, other GOP leaders attending the hour-long meeting included Majority Whip Roy Blunt (Mo.); his chief deputy, Rep. Eric Cantor (Va.); Conference Chairwoman Deborah Pryce (Ohio); National Republican Congressional Committee Chairman Tom Reynolds (N.Y.); and Policy Committee Chairman Adam Putnam (Fla.).
Chairmen included the Judiciary Committee�s James Sensenbrenner (R-Wis.), who is expected to take the lead in the negotiations for Republicans in the House; Homeland Security�s Peter King (R-N.Y.); Ways and Means� Bill Thomas (R-Calif.); Government Reform�s Tom Davis (R-Va.); Resources� Richard Pombo (R-Calif.); Intelligence�s Peter Hoekstra (R-Mich.); and Administration�s Vernon Ehlers (R-Mich.).
Given the breadth of the committees involved in the discussions, neither the chairmen nor the leaders could give any details about which committees would handle the particular details.
�There are policy issues in the Senate bill that stretch across a wide array of committees,� Boehner said.
By holding a series of hearings in Washington and elsewhere during the August recess, Republican leaders in the House are hoping to feed dissatisfaction with the bill, which would, in turn, give them more leverage heading into negotiations with the Senate.
Republican leaders would like to pass a bill increasing enforcement along the border and in the workplace before addressing an expansion of the current guest-worker plan, and most GOP lawmakers in the House are adamantly opposed to any provision that would grant eventual citizenship to workers who came to the United States illegally.
�We�re feeling pressure from the Senate and the administration, but we don�t feel we should pass something that Americans are upset about,� Hastert spokesman Ron Bonjean said. �Our chairmen need to put this under a microscope.�
Although the hearings could prevent Congress from moving any bill, Hastert said he remains committed to passing something soon.
�I�m not putting any timeline on this thing, but I think we need to get this thing done right,� Hastert said yesterday. �I told that to the president the other day that we need to have that discussion.�

So far i have not come across any non-south asian person being stuck in the Additional/Mandatory Administrative Processing (AAP)/security clearance/background check. Is there a reason for this "fondness" with the South Asians or have the consulates unilaterally decided to cleanse the US of south asian H1B holders (remember many people end up losing their jobs and belongings due to extra-ordinarily long delays). Since when did India fall in the same group as state sponsors of terrorism or in the same group as Iran/Iraq/Syria etc. where people go through extensive checks before getting US visas. At the time of visa interviews, consulates/DOS like to abuse our intelligence by stating that our cases will be resolved in 2-3 weeks and only some cases may get "delayed longer". With this open ended "longer delay" provided in the Immigration Law, there is no reason to think that this provision will not be abused and that people will not suffer unjustly. Even people with multiple H1B stampings over the years (some as recent as last year) somehow become ineligible for a fresh visa stamp and are referred to security clearances. Who is at fault here, the previous visa officer at a different consulate or the current consulate? Many cases have come up where people who had been stuck last year or before have gotten stuck again (for as simple as common name...what in the Gods name is the problem with these guys). With these policies law-abiding high skilled workforce is being forced to never come out of the USA (some may prefer to be illegal that to willingly go out to maintain status and get targeted by the consulates). Imagine if a guy has to get married, has to meet his new born baby, has to see his ailing parents, or has to attend god-forbid a funeral in his family and he knows he has to get stamped before he returns after fulfilling his social responsibilities. How will he feel after reading all these horror stories. So much for US govts goals of protecting family values in the US society.
I feel sorry abt. you and PRAY GOD to help you soon. I was in the same situation for almost 2 months in Montreal with my wife and 2 kids. My elder son lost one full smester and I was poorer by almost 30 k in 2 months in lsot wages, boading and lodging, mortgage etc. and can really feel the pain and know how it feels to be in limbo. I will pray for you and hope you come out of this unwted mess for no fault of yours but due to a broken system.

NEW YORK: The United States may experience reverse brain drain as thousands of Indian IT professionals contemplate returning to India, according to a survey conducted by Corp-Corp.com, a US-based technology job portal.
The finding was based on a survey of more than 1,000 survey respondents of Indian origin, nearly half of which were IT professionals that plan to return to India.
About 50 per cent of the respondents have plans to return soon, while 6.4 per cent of them have already returned to their homeland.
Survey participants included permanent residents, US citizens and work visa holders.
Fifty-one per cent said their decision was based on wanting to rejoin family and 26 per cent cited better opportunities as the reason to return to their homeland.
Around 10 per cent are planning to return for they believe their kids will get a better education in India.
"The results are very important for American businesses because they may face challenges in filling the gap of these resources," said Prabakaran Murugaiah, CEO of Corp-Corp.com.
"Businesses cannot replace an experienced workforce overnight," he said.
The survey results show 69 per cent of visa holders and 57 per cent permanent residents or citizens intend to return.
These are some of the motivation to return to India: Nearly 51 per cent for the return is rejoining their family members in India; 26 per cent for better opportunities in India.
Only 3 per cent says they are returning due to job loss, which is consistent with low unemployment of around 6 per cent in the IT sector even though the generic unemployment is over 8 per cent.
Around 10 per cent are planning their return to provide better education to their kids in India.
There are about two million Indians living in US and many of them hold bachelor or higher degrees.
Indians share a large percentage in the numbers of PhD holders.
Among the Asian Indian population, around 60 per cent are in management or professional occupations.

Is the PD correct on your approval notice, July 2003?
Thought I will post an update on my case. I got my approval notice yesterday but my wife's application has not yet been approved. So I called the USCIS to try and find out what was happening and on my first attempt they said the application was sent to TSC for adjudication and they, NSC, had no further info. The person that I spoke to asked me to call again and pretend as if I had no receipt number and she said that way I will be able to speak to someone who will be able to direct my call and raise a service request.
That didn't go very far. The lady that I spoke to kept driving me around in circle and finally told me that there was no way they could help me. She kept insisting that I write directly to TSC and find out what was going on.
Frustrated I hung up and decided to call again and this I punched in the receipt #. Luckily I got hold of someone who was a more understanding and helpful. She sounded Latino (no racial judgment here, only glad that I got a chance to speak with someone who understood the pain). She was surprised that my wife application had been sent to TSC and not adjudicated at NSC. She said she was going request for both our files and ones she got that she was going to present that to the IO who approved my case and ask the officer why my wife�s wasn't adjudicated. She said at times it so happens that files get separated. She took down my phone number and said that she would get back to me in a weeks time.
Keeping my fingers crossed and hope that my wife's case is also approved soon.
