NIW vs Labor: one more advantage- NIW has much more portability being a self petition. You can file an EB1 and also file NIW using the same documentation- it will cost you filing fees and offer you a second chance- a backup.
You are right on - That's exactly what I did - For the EB2-NIW it is always good though to provide a detailed description of the work you have done and address the specific points that required to be fulfilled for the NIW individually.

I think you can ask your lawyer to draft an attidavit with the pertinent details as best your wife remember. Then your wife signs and notarizes the attidavit. Remeber, USCIS has all the records. They are just "too busy" to look through the old files in storage. You can also file a Freedom of Information Act requrest for a copy of the file, but it will take forever.
Talk to your lawyer and I believe you will find a way out.

I did the same that we got a new passport from Indian cosulate for my wife with her last name changed to my first name. But her US Visa and I-94 had her old names. When I went to CO DMV office they said that the passport's name and I-94 name should match. Luckily, for us in the same time frame my H-1B was up for renewal. We applied my eife H4 under her new name; got the I-797 with the new name and I-797 also had a I-94.
I took that to DMV office. All they saw was the names were matching in the current I-94 (in I-797 approval notice) and the passport. She did not bother to worry how she got this last name. Thats none of her job.
So, try to get a new I-94 and try in some other DMV office.

If you have approved I-140 then that PD is yours. They cannot take your PD.
I like to know when an employee is laid off and employer withdraws the approved LC and approved I-140 as the ex employee is more current employee. Does the ex employee retain PD.

They are slow beyond belief. I first applied by mail, using the form they sent. With mu license almost expired, no response. Called them and after long waits, finally spoke to someone who told me I was not even in the system. Next I walked into the local DMV and waited in line for an agent. There, they looked at my EAD and made a copy. Gave me an extension document and told me that I would get my license in the routine time. In a few weeks, it arrived.
If you have not gone to the local DMV, please do it. They will verify the EAD there and you will be in the regular process. The mail system is worthless.

Even my Lawyer did not file for EAD/AP along with the 485. I have sent all my applications along with my 485 to the Attorney and they chose not to file the EAD/AP along with 485 during the fiasco. Later yesterdsy they filed my EAD and AP .They said if you have proof of delivery of 485 (Tracking number signature of FEDEX :PDF file) is enough as a proof of delivery.
I wud suggest that you ask them for Tracking number of your application and send it.
If they insist on not giving it to you , Then wait until u receive the 485 receipt and file it on your own. Do not disclose that you intent to file for EAD /AP . You can do it on your own.

Due to a sudden demise of my wife's grandmother, my wife had to go to India last week. She is planning to come back by Nov. 15. I received the receipt notices for my wife's I-485, I-131 and I-765. My question is if the fingerprinting notice comes before she arrives and also if it is scheduled prior to her arrival date on Nov. 15; what are the options of rescheduling and can we get the date of our choice after Nov. 15. Also, I would be extremely grateful, if someone could upload a sample fingerprinting notice from USCIS. I couldn't find any where on the site.

As I see VB after VB with only 15 days movement at best for EB3 - I am not sure if I have to cry, laugh or give up!
I get it. I have to be active. What should I do? Please guide me and anyone else who are interested in solving EB3 problems.
Let's start from a clean slate, what should we do? What should our goals be to get the relief?
Join the State Chapter (joined)
Meet with Legislative Offices every month. (I have met once, but not repeatedly)
Please list anything else that needs to be done.
One person doing this in one district will not solve the issue. Second, the state chapter I am in - nothing happens. How can we change that? I want solutions, I want fixes, I cannot continue to be a spectator of VB anymore.
IV members who want to join this effort, please post here.....

We have started to see this issue. The USCIS trying to deny I-485s due to LCA failures. The reason the LCAs aren't proper, usually, is that the employer relocated the person w/o doing a new LCA. The employee usually has no idea, since the LCA is the employer's filing and there used to be a lot less attention/awareness about LCA issues.
We have developed a number of arguments regarding this matter....including the "no fault of your own" concept and arguments regarding status violations vs LCA violations etc. This is a new development.
The reason why it is important is that it is necessary to be in status when filing the I-485. Prior status violations exceeding 180 days prior to or after filing the I-485 are grounds for I-485 denials.
It is a complicated topic. If the USCIS persists in this matter, there are going to be a lot of cases with this type of problem.
