Do you guys have any positive experience with contacting ombudsmen? How long it typically takes to get a feedback?
So I will skip the Infopass then if it is gonna be the same as SR .....

I contacted Ombudsman last year around this time when I was Current. I just asked to have my case seen before those who filed after me, and whose PD was later than mine, as I was watching otherwise, and feared visas may exhaust soon. They forwarded it to TSC Texas. TSC waited until October to reply (I was not Current at that time), with a standard reply that my PD was not current (they even sent me a hardcopy of October08 VB). It appears they never looked at my complaint, or did not want to look at it, and waited until they could have a easy and convenient reply.
Ombudsman approach is not guaranteed either, but try, there is no cost to it. Replies mentioned above are standard replies to keep you away for at least 6 months. No one can question additional review, so they just mentioned that in it.

R u on H1/H4 status? If yes you qualify for that with a SS #. You should contact Fasfa directly and they will tell you if you qualify or not. I had to do the same for my son. My son missed a smester due to some visa situations and hence did not qualify for FASFA but you should be ok.. Try talking to them directly.

Thanks - I am on H1. I called FAFSA and they told me contact USCIS directly. I dont think one gets Federal aid in this situation. Unless my university is jerking me around.

I think you already know why it was returned from the combined answers and probably resubmitting with some ADDl. Docs will get you going.
But a new doubt came up just now - Why did you apply H1B extension when you had almost 6-7 months of H-Time still left ( you said DEC 07 ) ?? Isn't that a reason why they returned your case after opening on JUL 24th ? Generally we send H1B extension request at most 2-3 month in advance... Not more than that...

Tell your wife to simply leave for a better oppertunity. whats the use of getting green card if you still worry about these things?. I think people have become paranoid after such an ordeal. Do you still worry about these things even after getting citizenship?.
You cannot be scared for life! You have had your share of worries.Now just move on..! Your spouse gave 5 years to the firm!! I changed my job in about 2 mths after the approval e-mail.Just make sure she leaves with a lot of goodwill.

Done. Not helpful this (or anything) will help but I did it. Along with sending emails and actual letters to Chao, Specter and others. We are just stuck here for years to come I think.

I received mine in 10 working days. I had dropped my documents in the SFO Indian consulate and collected it in person too. But you do have the option of getting it in mail.

Lets say someone has an approved I 140 and 485 pending for more than 6 months, can we self port using AC21. If there is a potential query and ability to pay issue, since GC is for future employment can I respond to the query with a future offer letter from a different established company with a genuine offer?
I am EB3I and have no hopes of GC for atleast 2 more years.....:(
The irony is that "USCIS" expects that they be informed that you ported off. This is my interpretation based on the Aytes memo.

In my opinion, if the sponsering company withdraws a petition after 180 days of filing 485, USCIS must send an RFE and not an NOID or there has to be a mechanism to record the AC21 porting and avoid even an RFE.

The advantage with filing EAD is you can file AP also. I have done it separately also. Also e-filing is the best option. It is very easy, your EAD/AP application is sent immediately to Service Center online. But for EAD, you have to wait for Biometrics(don't remember code) notice. Once you get that, you need to go to ASC(Application Service Center) to give your photo and finger prints(not all). Then it will get take its good 2 or 3 months time to get the EAD card.
For AP, once you efile you need to send your photographs(2) along with Confirmation receipt, reason for AP and other related documents to the concerned Service Center separately by mail

I am Vijaya, work for Sioux Valley Clinic in Windom, SW part of MN.( 2hrs away from Minneapolis)
I'll try to encourage more physicians, that I know who are in same boat,to join IV.
I am sure there are many others in Minneapolis, as I heard that people of Indian ehnicity are the fastest growing immigrant group in twin cities.
We'll try to build up this base.

The reason why IRS let's you avail of deductions on the interest you pay on properties in the US is because this helps US businesses. The IRS gives you an incentive to buy a house so that more houses are sold, which in turn gives jobs to more people, so forth. Why would IRS let you deduct interest payment when the house you are buying in outside the US? By buying a house in India you are supporting Indian economy not US.
People might have tried it but if there is an audit I am sure IRS will not allow it. You should do a thorough research and maybe should speak with IRS before trying it. Also try reading the IRS regulation which talks about the deductions for the interest paid on purchase of property.

After EAD comes, it might be possible to do MBA full time. But make sure that you have future job offer ready from your sponsoring employer.
I am doing part time MBA ,maintaining my H1-B. I figured it was too risky to leave job and study full time. There are no guarantees that my employer will keep future job offer.

I may be missing something but why everyone feels its such a bad idea. I think it affects only a small fraction of people (those who need to apply I485 because of 245 AND get lot of RFE's in I140 stage). Basically the proposal is to implement premium processing for I140 where you are expected to get a decision in 15 days. This will speed up the I140 stage a lot - even if you get RFE's - we can always provide info and get decision after another 15 days.
The basic problem is retrogession - whether they allow us to file 140&485 at the same or at different times are not going to make much of a difference. Please correct me if my understanding is not right.
