how many foreign national are working and in what statuses. particularly H1. These details USCIS /INS /DOL is collecting for the last 3 years. Don't know if it is mandatory, but my guess it is voluntary.
So, when you submit I-9, it is good for the employer. He will state that there are fewer employees on H1, as working on EAD is working on GC. Now that the new amendment (no more that 50 % employees should be on H1) is definitely going to come in the next CIR.
Sure it does not go to the CIS/DoL records, but it surely means that you were on EAD on and as specified on the I-9. If you want to be truthful and records to be straight and consistent and avoid a mess, then that is one definite way of "utilizing" EAD.

LoungeAct's is the way to go as far as I'm concerned. When I read the rules of the battle (unfortunately when it was too late for me to enter, however) what came to my mind was something similar to what LoungAct has done - but with the typography actually evolving rather than the image at the bottom.
My problem with the other two is that while they are beautiful and exciting, the aren't legible. When it comes to typography, the ability to read and understand what you're looking at is immensely important as far as I'm concerned.
MarioFan's work definitely captured the idea of "Evolve" but the word was almost completely indiscernable. Had I not known what the word was in the first place, I don't know if I could have figured out what it was just by looking at his piece :evil:

This could also mean that USCIS is expecting that you will get your GC in 1 year. Can happen you know. In Jan there is some admin/legal fix that makes everyone current.
EB backlogs does not benefit anyone.

I think if you switch from H1 to an F1 and then want to get back to an H1, you will be counted towards the 65K cap.
It will be a brand new H1 application, so it has to be under the cap. So think twice about switching to F1, it's not easy to just switch back and forth.
Make sure you get confirmation from an attorney though, don't assume everything on a forum as perfect legal advice.

If they are forcing onto you, as per me, you can give the AC21 Paper and G-28. After a couple of months sent a new G-28 from the old/current lawyer with whom you want to go. They will not know about it. This is just my opinion but may be wron as well.

Dear friends, did anyone visit Hawaii? I am trying to find out if you need to have passport/visa to visit Hawaii. I know it is an outlying territory of US and so can you travel with valid ID/drivers license instead of carrying passport? I don't have a H1 stamped in my passport.
I went to hawaii. Its like going to continental US. no passport required. Only ID required as with any domestic air travel

I have question here:
I accepted new offer recently and my H1B is valid till Sep 2010. I used AP Nov 2008. I dont want to inform USCIS about new employment. I am planning to continue on H1B, so i ask new company to transfer my H1B as i am not interested to switch to EAD.
Is that Ok? Coz, i used AP, and if do H1 transfer, i will get new I-94 with
H1B status. Will this be a issue for 485 ie will my 485 gets screwed up due from "AP status" to "H1B Status"?
Does it impliest that, If i do H1B transfer, this means that i am invoking AC21 automatically?

Some backlog center victims who posted messages rejoicing the Unavailable bulletin think that immigration benefits are a zero sum game.
This is the "zero sum game" mentality where very often people believe that one man's loss is another man's benefit. Its true in case of finite physical resources (like gold, where there is finite amount on planet earth and it cannot be created anymore. Or land, which is also finite and mostly in fixed quantity other than volcanic eruptions)
However, greencards are man-made paperwork created in quantities controlled by man (not nature) and therefore one man's loss is not neccesarily another man's gain. So is EAD. And AP. Its friggin paperwork after all and doesnt have to be finite for which one man's loss is neccesary for another man's benefit.
All it takes for more green cards is one kind of paper work (congressional action) to create a million more of them. And how would any backlog center victim directly lose by having another guy in the next cubicle with PD of 2005 get EAD ? How is that a loss for BEC victim ? The green cards are issued based on PD. Regardless of who applies first for 485, approvals are done based on PD.
And even if sometimes the system unfairly rewards late starters first, get used it. That is life. After you get your green cards, there are many many long years of life still to live where there will be unfairness ALL AROUND YOU. And it will have nothing to do with USCIS or even any government. Just plain dumb luck. Life is not FIFO. In fact, nothing in life is FIFO.
There are millions who settle in life a lot faster despite being less capable and eligible. There are millions who earn their first one million dollars a lot sooner than others that are more hardworking and capable.
However, the attitude of "Zero sum game" where people assume that EVERYTHING is in finite quantity and one man's loss is another man's benefit will not take you very far in life after green card. That's because it will prohibit your creativity - a very important quality when trying to be wealthy and successful.

few folks whose PD is 2001 are stuck on NC process. NC process has been very efficent recently. You can call or take a appointment to local USCIS they will tell you.
My assumption is there are enough applicants whose NC is cleared to fill this years quote. Count to LC Subs also in this list
There may be people who have LC Sub of as old as 2000 or less.
Blame everyone. Blame you employeer too if they have given or sold some of their old labor to anyone.
BTW i used a LC Sub as i have a typical condition. L1 maxing our the L1 limit. Could not manage to get H1B on Lottery.

An Irish activist group that has been lobbying for immigration changes is heading back to Washington. This time, it is focusing on the House of Representatives.
On June 28, the New York-based Irish Lobby for Immigration Reform will go to the capital to bolster support for immigration changes in the House. A Senate bill, known as the Kennedy-McCain bill, passed last month.
Organizers said they would try to meet with several congressmen � namely Reps. Pete King, R-Long Island; Tom Tancredo, R-Colo.; and F. James Sensenbrenner, R-Wis.; and Majority Leader John Boehner, R-Ohio, � who now do not support the Senate's version.
"We're hopefully going to change their views and hopefully they'll realize this is the best way to fix a broken immigration system," said Matt Reilly, a Blauvelt man who has been active in the immigration movement. "We're going to talk to them and persuade them to support the Kennedy-McCain bill."
The lobby group expected Sen. Edward Kennedy, D-Mass., to join them. The Senate bill was introduced last year by Kennedy and Sen. John McCain, R-Ariz.
It called for a guest-worker program that would admit up to 200,000 people per year; hiring of more Border Patrol agents; building hundreds of miles of fencing on the border; and allowing illegal immigrants who have been in the country for at least five years to remain, pay $2,000 in fines and settle back taxes, among other provisions.
It is estimated that the number of illegal immigrants ranges from 6 million to 11 million and that there are between 40,000 and 50,000 from Ireland in the United States.
In March, thousands from the Lower Hudson Valley, the Bronx Queens, Stamford, Conn., Boston and Philadelphia marched on the capital to lobby senators. A month later, McCain visited the Bronx as part of a town hall meeting sponsored by the Irish Lobby for Immigration Reform.
Kelly Fincham, director of the immigration group, said the trip in March that focused on the Senate was a success and she expected similar numbers for this trip.
"We're prepared to knock on all 531 doors," she said. "We would hope to be changing some minds in the House."
Leaders who oppose the Senate's version have raised concerns about potentially granting amnesty to immigrants.
King, for example, has said cracking down on illegal immigration was paramount in the post-Sept. 11 world. His approach called for stricter immigration laws that pay particular attention to border controls and enforcement. He has also proposed making it a crime to be in this country illegally.
That has many in the Irish community concerned, but Fincham hoped the trip might change King's mind.
"There's still room for him to be a friend of the Irish," she said.

The wording of the law is ambiguous, and can be interpreted to suit one's need.
The conventional wisdom so far is that you don't file AC21 unless you really have to. What it means is that if your ex-employer is about to revoke your I-140, whether approved or pending, then you will be on the safe side by preempting the ex-employer and filing an AC21.
However, if your ex-employer is being a sport and not planning to revoke I-140, then it is better not to file AC21. It saves a lot of hassles about RFEs.
So it really depends on each case.

Its quite hopeful to think that NSC is approving/working on cases and just not updating the system. But if that was the case, why would practically everyone calling them be told that their case has not yet been assigned to an IO?
I think they are trying to exhaust all possible EB2-ROW they can before they touch I/C cases. Take a look at , EB2-ROW with RDs way after the processing dates are getting their GCs.

Both the above cases have been approved on Aug 5th and Aug 6th. So maybe they were actually approved before Aug 1st based on the History we discussed. Since EB2 ROW was always current, they might have processed the applications irrespective of Processing Dates (May be because they have finished processing all the applications until July 31st for ROW EB2 and started to look for others even outside the processing dates). Since EB2 I/C became current only on Aug 1st, they may have not touched applications of EB2 I/C
We will wait and see another 2-3 days. Will see if this is the trend.....

Receipt Date has other important implications; it is the date from which you can count your 180 days for AC21. It is also the date from which your "Adjustee" status becomes active. I think the fact that a certain RD is printed on your I-485 receipt has its own importance, regardless of how the USCIS wants to treat it internally.
