Some of the members were asking for more info on this issue.
The following YouTube video fired up the controversy few weeks back and Sen. Grassley has now written to the Law firm asking them to explain their actions.
http://www.youtube.com/watch?v=TCbFEgFajGU
although the video is now posted by Programmers Guild, the original video was posted by the Law firm themselves to promote their services. Since the move backfired they have removed all of the videos.
Senator Grassley wrote the following letters to DOL and the Law firm asking them to explain their actions.

I hate to admit but they have a pretty good case here and this could snowball if the big media picks it up

I really don't know what their exact income is. But if they can get insurance for $200 I'm sure they'll go for it. So if you know insurance providers in that range I can pass on the message.

I posted 2 messages under 'Members in Ohio' thread asking for contact information to join IV members from Columbus, Ohio but nobody has responded so far. Does the IV administrators' group maintain some kind of contact info and planned meeting dates for the state chapters that a new IV volunteer can look up and make efforts to join? I am eager to know what are the current activities led by our local chapter so that I can volunteer to do as much as possible by me.
I will greatly appreciate it if someone can reply back and direct new IV members to the correct contacts. If there is no active state chapter in our area, I am willing to work to initiate such a process in our local area.
Please reply back.
Thanks!

IOs are like robots. They use a Manual that looks like a procedure in structural programming with different sub-procedures. All they do is follow them step by step.
The July fiasco and AC21 was not interjected into the procedures so the reason why we see some of these errors.

I second that. When CIR will come along, it will drag on and I am sure they will spend considerable time on it before it gets passed. So we really need some "interim relief" like SKILL bill.

I think to a first order, it is 1 applicant and 1 dependent for EB. 2004 numbers bore that out.
No, Raj, that is one of our biggest problems -- dependents eat into the annual quota. The 140,000 EB annual quota does not mean that 140,000 primary applicants get green cards -- it includes the partner and kids.
Similarly when they say 271,000 EB I-485s are pending that includes primary applicant plus dependents.
There are different estimates for the average family size- the range is from 2.07 to 2.5, which means that there are about 108,400 to 130,917 primary applicant I-485s pending.

Just asking if it was going to be covered on CSPAN and also if the moderators were going to post updates on an ongoing basis like for the previous bills thats all :)
The reason i am asking if it is going to be covered on IV is, that I havent seen any moderated threads today saying "Lame Duck session 11/13/2006" like we used to for the bills before this one.
I never meant to say that this bill was any different from the other. If anything I hope it IS different and our provisions actually go through this time ;)
Hello eb3_nepa,
Today is the first day of Senate after elections. There are no bills in the Senate or House that refers to immigration, directly or indirectly. That is why there is no thread providing up to the minute information about the developments on the senate/house floor.
We all understand each other's pain for having to wait for long years for green card. At the same time we must say and request to all members to manage our expectations. The elections results have increased the chances for an immigration bill. But the type/form of the immigration bill and whether our provisions would be considered in the base bill is still not decided. That is why it is all that more important for all of us to actively participate in IV. The current situation is more conducive for our provisions but it may take sometime for an immigration bill to mature and pass. As pappu mentioned in another thread, House and Senate Republican leadership had a conference about the issues in the lame duck session last Thursday. Immigration was not mentioned/discussed in that conference meeting. We all want something to happen sooner rather than later. But it is very unlikely that a bill of the size/type of CIR to be considered in the lame duck session, especially when the majority in the Congress has changed.
Thanks,
WaldenPond

i thought the max. no of days u can stay on visitor visa is: 6 months?
how did she stay for 9 months???
can u clarify.. does ur MIL have a GC?
My in-laws were with me during 2008 (mother-in-law for 9 months, father in law for 3 months)
In order for me to claim them on my tax returns as dependant, I need to fill w-7 and mail my tax documents to Austin Texas.
My CPA says, i addition to w-7 and passport as attachment, my CPA says that their passporta need to be notarized when they were here.
They already left and there is no way I can notarize from here now.
Indian gazette sign is invalid it seems.
What do I do now? Is it mandatory that we should take notary signature on their passports when they were here.
if anybody has done it differently, pls advise. thanks in advance.

Would many multiple lawsuits by committed people help the community at large ? what do you guys think ?
I mean, we can all discuss here, many will get busy and everything, some will lose interest, many will procrastinate and have the "let others do it" attitude...but the few who want to make a difference, I am ready for it if people agree ?
If you google for "uscis legal settlement notices" you will find that lawsuits can be helpful.
The regulation cited above applies to I-140/EAD/AP/H1B petitions as well. However in I-140/H1b case the lawsuit has to be brought by employer, which is not always easy to accomplish.

Actually there will be very little or no forward movement for EB2-I for Oct Bulletin. It may actually retrogress also. Although chances of retrogression is less likely. There were lot of applications filed just before and in March 2005 (pre-perm) to avoid hassles of unknown perm at that time. So getting through this March 2005 date will be a big challenge.
If at all date moves forward, it will be a crawl. Maybe by a month or two.
We can all make guesses about Oct. Bulletin.
But precise prophecy can be done by VDL Rao only.
I also believe that it may retrogress or stay at Jan 05 for EB2I.
Lets call upon Guru to predict next bulletin.
I had a dream early morning today and was blessed to have Sakshaat Darshan of VDL Rao predicting solid movement in EB2I and EB3I in October Bulletin.
Jai Ho VDL Rao!!

Hi, I posted on a new thread about the similar situation I am in without seeing your post. I spoke to a USCIS Rep and asked him to put in a request for a new FP notice/schedule to be sent to my new address. He did so. I also asked him if it would help going along with my husband for his appointment and requesting them to FP me that time, he said I could try that. Do let me know if you have any other updates.
YES TRY THAT. GO with ur husband but tell them the original date and time of apotinemnt. they can look in the system. Also it is easier if you take ur attorneys copy with u..

Hi,
I was a approved labor and I-140 with PD of 06/02/2002 (India) under EB3 category. Even after 8 yrs of filing i don't see any clear sign of EB3 moving to June 2002 . I am considering the following options and want the guru's advice here.
a) If i apply for new application under EB2 category , i just have around 5 yrs experience before joining this company and i did not include the experience of one company in my previous EB3 application (7 months exp) because it was an apprentice job (non-permanent job) will it cause any problem in the labor application because of newly added experience?
b) Say the labor gets approved and i filed I-140 and ported my EB3 PD of 2002 and if the I-140 get's denied can i still continue with my previous EB-3 I-485 application. I have my EAD, AP and H1 extension based on the EB-3 Application.
I do not know how much future long i need to wait on EB-3 so want to consider the risk factors if I-140 EB2 get's denied If i can continue with EB-3 application.
Please advice.
Thanks.

That's not quite accurate. N-400 asks the applicant to specify the employment/study history for the last 5 years.
I stand corrected, since I haven't got to that stage. That's cutting it close though - considering you have to wait, what, 5 years before you can even apply for citizenship?
I should have termed the statement more along the lines of "as far as I know, employment based on initial greencard sponsor employer is not a requirement for naturalization" http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=12e596981298d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=96719c7755cb9010VgnVCM10000045f3d6a1 RCRD

Roseball, thanks very much for your reply.
Guys
Can somebody please help me with more replies, for me the above reply doesn't seem to be more convincing.
Yes i am on EAD, my 7th year h1 is pending from 1 year no rfe till now, i am already due for applying 8th year,
My EAD is valid till oct 2010, at this point since i have applied for 140 appeal, can we not apply an MTR on 485 stating 140 appeal has been applied , so requesting to open 485?
Thanks
Please cool down, everything will be alright..
I dont think 485 or EAD/AP can be appealed/MTR'd based on I-140 appeal. To my knowledge, they will remain in denied status as long as 140 is in MTR/appeal. And once 140 gets cleared, they can be reinstated. Also I guess H1 can be extended in one year exttensions based on 140 appeal pending state. I may be wrong, please check with attorneys or more experienced guys here.
