    I agree with sargon.

    From my lawyer: If you have filed I-485 and its past six months, your I-140 is approved, and your employer isn't going to to revoke I-140 filing AC21 document might be needed. Otherwise file AC21.

    At least from my research AC21 provides us with option of switching employers without having to restart our GC process. USCIS or DOS have't issued document or template for filing of AC21. Various lawyers have come up with their own document and filing procedure.

    You can go to B-School on EAD. But as a primary applicant for the I-485, you need to keep working in a similar job until 485 gets approved.

    If you stop working, your 485 may still get approved. But if there is any inquiries, you need to prove you were working in a similar job. The whole point of giving a person the Green Card is lost if the person does not intend to work in the same job category.

    I traveled to India earlier this year and entered back to the US on AP while my H1B Renewal was pending. I had inquired with a couple of Attorneys before my trip. Both of them said that my H1B status will not be affected if I am working with the same company after coming back to the US. However, the following article on Murthy.com suggests that my H1B status is probably terminated as I had used AP while entering the US.

    The article also mentions that I do not require to use my EAD and continue to work with the same employer as an H1B visa holder. Now since I have an approved H1B for next three years which I received after I came back to the US, I could get it stamped on my passport whenever I go outside the US and get back on H1B status again. Oh well...

    I am in a similar situation, My company (A) was acquired by Company (B) in early 2006. I had my I-140 approved before that. Company (A) did not change its name till Jan 1st 2007.

    Unfortunately for me, my attorney did not tell me that I needed to file a new I-140 (my first 140 was approved). I was doing nothing till July 2007. Once I got ready to file 485, thats when the company attorney informed me that I need to file 140 also.

    My first 140 was with Nebraska Service center, and the new (concurrent with 485) was transferred to Texas service center. I believe since the 485 is linked to new 140, I would have to get it cleared before I can invoke AC21.

    Some lawyers quote like you mention but in such a case the lawyer should know the full law and give you the full notice when you go for stamping. Fight to make your point, you will need this notice in its entirety for stamping..

    Hi, My employer is not giving me the original H1 approval notice (i-797A) because it states on the notice on the 2nd paragraph

    "The petitioner should keep the upper portion of the notice. The lower portion should be given to the worker"

    The lower portion is the new i-94.

    What is this? Can they do this? How can I get the visa stamped without the original notice? Gurus please help.

    OK, I stacked 9 Bags in my mini Van ( which offcourse were not mine. Luckily I got hold of a guy who was also doing a second entry and was looking to manage his luggage). I helped him and it indirectly helped me.

    On the Border..I told I am doing to immigrant landing.
    What about my car..I told I wont do it as its under finance and he ack . yes you cannot bring it...
    How much funds...I told I have 50K on paper....
    So he gave me a yellow slip and told me to go to immigration..
    The immigration guy was cool.. after handing over the pp and copr he just asked are you guys still married? :-) we Ack yes.. Funds 50K..I attempted to show the statement and he said its OK. He told he will need some time to enter things in the system. and will call us back.After 5-8 minutes he called us and we signed the COPR paper.. after signing we again had to sit for 5-10 minutes...After that he handed over the PP and a copy of COPR. He told us to go to customs for goods to declare and goods to come..
    At customs i gave my pp and I had a printed copy of items to come and items to follow with price tag... She was a rookie and was taking help from an associate.....that helped me..instead of writing each item on the form..the helping officer suggested to just staple the copy of printouts.
    Thats it.. on my way to my car some lady officer asked me to handover the yellow paper...and we were all set....

    While coming from Detriot Tunnel...for some reason there was a 1 hr delay for traffic.. the officer took my pp and scanned my expired visa? not sure then he scanned my wife' as well as sons visa which had valid visa stamp. He kept aside the pp and h1/h4 and came out of the cabin..saying..whats the purpose of visit.. i told i leave and work in Michigan...next question...why/where we had beeen to Canada.. I told Toronto and I had some paper work to do for Canadian immigration purpose...He asked when did we go.. I told on Thursday...and we were back today Sunday :-)

    Thats it... that ends my story.. I understand everyone's concerns as I had the same... still you have questions let me know.

    Did you apply for the SSN equivalent in Canada?
    Did you open a bank account?
    Did you apply for the medical card?

    I think these are all necessary for you to show that you have established or in the process of establishing residency in canada. I know that from then you have 3 yrs to enter and reside in Canada.

    Anyway we recently got the GC here so we will most probably junk the canadian GC.

    Thanks for the replies. What I meant by "not following process" is that new company declined to represent me for my pending I485 process or the attorney's didn't file a G28 on my behalf. They are only doing H1B which is great.

    Yes I did change employers thinking AC21 but I haven't sent the AC21 papers to USCIS.

    What about your current attorney? Since (s)he has been representing you, you can just stick with him/her, if possible. You don't have to send any communication to the USCIS at this point anyways, just in case of an RFE.

    few things will never change..

    I am 10 days into my interview and I havent got required original docs from employer

    we asked for empl.letter and no response to emails or phones..(We didnt had one from 485 filing as they didnt gave it to us)..

    Why am I not surprised or not concerned. :confused:

    We will attend interview without it and rest will be history if I get screwed. :cool:

    Thanks for your suggestions! But the issue here is the Vendor is not paying us even after so many times trying to reach them - email, Text Messages and Phone calls. For everything we have a record. Also the vendor broke the breach of contract between my Employer(Net 30 Aggrement: Means pay the due within 30 days of invoicing the bill). Net 30 became Net 120 and still counting. So on what legal point of view can the vendor sue us in court since its the Vendor is the one who breached the contract we have written.

    I have received an RFE asking for 5 different things. one of them is asking for evidence of work status since the day I came to US first time. Now, while going through my H1 approvals, i came across something that seems a little wierd, but i have emails from those days to tell me that i was in clear legal territory. however, given that i have this rfe, i want to run this by you gurus...

    i was with one of the big indian IT firms when i came to US. my first h1 approval expired on Jun 2004 and the next one from the same company was valid from the very next day to nov 2006. However, I applied for H1 transfer in nov 2004 (got receipt notice in nov2004) and then started working for a desi consulting company in Dec 2004. The H1 transfer approval came along in Feb 2005 with "approved from" date as Feb 14 2005. So for the period between Dec 13 2004 and Feb 14 2005 when I was working with the desi consulting company based on a H1-Transfer receipt notice, what is my legal status? I know for sure and have emails from the employer confirming that it was ok to work on a receipt notice without actual approval in hand... but my memory fails me for now... so, how is this supposed to work? any ideas?
