You should mention YES ( if u applied) for AOS applied question. That is suggested to be no risk factor for H1 applicants as they are dual intent.

what's the implication after you port the priority date if the I-140 under Eb2 gets rejected ? Can you still proceed with I-140 EB3 ?

Notifying the USCIS is not necessary, but is recommended in case the I-140 is revoked.
If I-140 is revoked, you must notify the USCIS about your new job, otherwise I-485 will be denied. NOID usually follows I-140 withdrawal/revocation.

From my lawyer: If you have filed I-485 and its past six months, your I-140 is approved, and your employer isn't going to to revoke I-140 filing AC21 document might be needed. Otherwise file AC21.
At least from my research AC21 provides us with option of switching employers without having to restart our GC process. USCIS or DOS have't issued document or template for filing of AC21. Various lawyers have come up with their own document and filing procedure.

As long as you are getting employment verification letter; you will be fine and make sure your previous employer not revoke I-140.
I dont think revoking of the 140 by his previous employer will have a major effect as he has already ported his employment once.

You can still get denied, you can still get RFEs when the officer re-opens your file to adjudicate, they reserve the right to go over the case with any new interpretations of the laws they may come up with in the future if they wish to make things more restrictionary. Basically "pre-adjuducation" is fools gold.
I have had my 485 pending since Aug 2005. Over the years, my PD has been current on two separate occasions since then, once for 2 months and once for 3 months. I have had 2 RFEs on 485, and one on EAD over the years(I am on my 5th). I am still waiting. Presumably I have been "pre-adjudicated" a few times already. Hell, the amount of times they would have seen my 485 file, it probably has dog ears by now!
Absent a sustained visa date movement past your PD, which basically means visa recapture. We will all be waiting for years. In this time a job loss, an injury that renders you unable to be employed, anything that makes you fall out of status, restrictionary local laws(eg Drivers license) basically anything can affect you. Usually what will hit you will be something unexpected, as otherwise, presumably you would take mitigating action. We are being asked to aim for a moving target.
The single most important thing for those of us at the 485 stage is visa recapture. Absent that, not much else will help in the near term IMHO.

I today e-filed my and wife's AP and at the end of it I got a receipt number and instructions telling me the address where to send the documents. The address was of Texas Service center with a p.o. box for e-filed I-131.
I hope to get the AP approved fast!

Does anyone have a link to a USCIS doc that discusses how soon one is "supposed to" and "required to" return to US while on AP ?
I recently heard (may be a roumor) that an indian woman (dependant) was told at the airport that being out of US for so long (3-4 months) means she has abandoned the GC process. she then requested to talk to the supervisor who reviewed all the docs and allowed her into US.
This may very well be a roumor, but I am wondering if there is any USCIS memo or doc that talks about this, even if just a guideline and not a rule.:rolleyes:

When I returned after 3 weeks, I had a discussion with the IO at AP room about the length of time one can stay away. He said one needs to return before the AP expires and there is no sub time limit within the usual 1 year validity period of AP.

It's been quite a ride for this GC, unfortunately. Could have been easier.

Friend... same thing had happened to my wife, TB test positive then Xray not conclusive, I had 3 days left to respond to RFE, so I asked the doc. about the options and one of them was CT of Chest, I got the same day appointment for CT (no contrast) and requested the radiologist for the priority (told the story that we are short of time for immigration medicals submission) she put the report on priority and the report was faxed to my doctor next day at noon... Yeah, CT came negative and got all clear within 24 hours.
If you are in time crunch then ask the doctor for CT Chest with No Contrast prescription. Make sure that No Contrast is written on the prescription otherwise you will be send back by the radiologist. I dont know how much bill I am going to get but I was able to get it done on time.

My TST test showed 10mm induration. Subsequently I took a chest x-ray, a while back the clinic called me saying they are looking at the results and they are not conclusive. Apprently radiologists have recommended a CT scan. The doctor says he would not want to take a CT scan, he would rather recommend me to the local county health clinic for confirmation.
1. I have only one week to respond to the RFE. What should I do if I do not get the response from country health clinic in time?
2. What if they recommend further tests, whose results would be known after the RFE response date. What should I do then?
Pls advise, I am confused
