My wife received email that administrative processing is complete and to submit her passport, yellow form, copy of email and envelope. We submitted the information on Friday afternoon. We have still not received her passport. How long it takes from the date of submission. Does this email means that her passport will be H-1B stamped and there would no more questions.

Hi everybody,
our 140 is approved in 2006. in july 2007 we applied for 485. eb3 priority date 2005 india. right now i am on h1 only. its going to expire in march. we got ead for 2 more years.
Right now i am in a confused state that shall i apply for h1 extension or shall i change to ead with out extending of h1 that is my question. my dependents also dont have any h1.
what are the - ve points if i dont extend my h1 visa and staying on ead . what are the benifits staying on h1 . please let me know .
may be some threads is there regarding this but i dont understand how to search .
my mother and father in law are going for visitors visa stamping soon using my status. is that ok sending them using my ead for stamping.
please direct me in a correct path. thank you.

Has anyone used Brelje & Associates, PLC (based in Arizona). I am thinking of changing jobs and though I would like to keep Shusterman's firm, this new practice has some contract with this group.

I went to the CBP office at airport and inquired about this issue (Visa expiring but have a longer petition). He just asked me if my new H1 is with same company. When I confirmed it is same company , he said you are all set. No issues.

I have more than 10 years of IT experience. I work for an American company. They are going to file my green card but not in EB-2 ,in EB-3. When is ent an email to AVP requesting to file my green card in EB2, HR/Recruiting manager has sent the following email in response. I need your suggestions how to proceed on this.
Hello there. Thanks for the email and inquiry. The EB-2 classification is for individuals with Master's degrees or Bachelor's degrees plus five years of progressive experience. Not only does the employee need to possess these qualifications, but the employer must require them for the position. Thus, unless ****** [company name] can attest that it has only ever hired individuals with Master's degrees or Bachelor's degrees plus five years of progressive experience for the same or similar positions and that it will continue to do so indefinitely (and also explain why it is required), EB-2 will not be available for the position.
*********** [Employee name] is correct that the processing times are currently shorter for individuals in the EB-2 category (a two-year difference for Indian nationals). However, these processing times are always subject to change. ****** [company name] will be able to petition for H-1B status for *********** [Employee name] beyond the six-year maximum as long as it filed the labor certification 365 days before his H-1B status expires.

They seem too by-the-book, but you might be able to work something out here: if you are a software-engineer now, and expect to be a senior-software-engineer in an year, see if they can do the GC for that position instead of your current one.
Ask them what title or recent job postings in your company have qualified for EB2, see if your current job fits one of those or if you can move to one of those groups, or if your manager can get a requisition for a position like that and you can move into it. Some wheels at big companies move slowly, you need to push real hard.

thanks again guys. so is it ok for me to find another job inthe same field and move on - if i can find one quickly. so a move does not affect my future citizenship application ? is that a fair statement. or does it all boil down to luck at the end. some people say u can leave the company in less than 6 months and some say it is not ok. is there some kind of law governing this - can some one pointme to it. i have waited for 10 years to get my GC and would hate to put it in jeopardy. i guess dignity does not hold when it comes to the point of GC revocation. god - this sucks. do i have to please the company, my boss, my self or the uscis. it sucks to know that u put ur mind and soul into the job and at the end this is how they pay off loyalty. anyways no complaints,. wondering how i can get out of this situation without jeopardizing my green card. any sugegstions and pointers. i can really use some now.

3. Did the canadian immigration officer know that you'll returning to US soon after landing? THEY DIDNT ASKED ME.IMAGINE A FULL VAN WITH LUGGAGE AND 50K. I agree that the reason to get your H1 extended as backup plan is to be prepared in a worst case scenario.
But still I don't understnd the need to get the visa stamped. Getting the visa stamped is just for the purpose of letting you in (this doesn't give you additional status, don't know if this is required/help for DL in some state). AP serves that purpose 100%. Once you are in you can work on your EAD/H1 as long it is valid, irrespective of what is stamped in your passport in the form of visa/I94.
As long as you plan to keep your AP extended on time (just for travel purposes) there is no need of getting visa stamped. I had this detailed discussion with couple of immigration attorneys who are doing this for years. And this what I learned....
Once you file you I485
1) Keep your AP renewed promptly. This will make sure you have no travel restrictions.
2) Get your EAD renewed promptly. This will help you in case you have switch job to an employer who does not want to sponsor H1B.
3) Get your H1B renewed to be prepared for the worst case ("Secondary insurance" term referred by my company attorney).
4) Don't bother getting your H1B stamped. Enter using AP. This was a big message from our attorney. This way you can save $300 - 500 and couple of days of your vaccation back home and avoid all the hassle at consulate.
