    But can the employee pay for H1 extension? If so, can the employee pay all the fees or are only certain types of fees can be paid by the employee?

    I have a Job offer for Database Administrator and I am looking to do a feasibility study to see if this job belongs to a "same or similar" category to use AC-21. My I-140 was filed based on a job title of Progammer Analyst. I would like to pick some ideas from everyone to see if I can coincide this job duties to prove the similarity between the jobs.     The ideal candidate would be someone who had development background in his career with SQL Server experience, who understands how to troubleshoot and support ASP.NET applications, an individual who has the urge to learn technology on his own and welcome the opportunity to learn new ones. He/she will be reporting to engineering manager and working closely with the team. This position is required to work closely with developers, customer service and other parties. He/she will need to have full understanding of our database schema and any new changes to it.
    Responsibilities:
    - Support day to day operations of SQL databases
    - Deployment SQL changes to QA and production environments
    - Work closely with developers and other parties to locate and resolve application bugs
    - Generate and maintain SQL Analytic reports for various departments of the company
    - Create and maintain maintenance plan for tuning and backup of SQL databases.
    Environment:
    - Microsoft Windows 2003 Servers
    - SQL 2005 Clustered with Replication
    - SQL Server Analysis Service
    - Applications are developed in ASP.NET with SQL 2005 backend running on IIS
    Nice to have but not requied:
    - Windows Clustering
    - SQL Replication experience
    - SQL Logging shipping
    - LAMP

    � Convert designs and specifications into code, and compile code into programs and analyze code to find errors and enter code into system to correct programs;

    � Revise program for corrections, enhancements or system environment changes; coordinate corrections with other programmers;
    � Administer and configure SQL database;

    The position offered to Mr. XX requires the services of an individual possessing at least a Bachelors degree in Computer Science plus 6 months experience in computer technical support as well as six months experience with C++, ASP, SQL, RDMS operating on Windows and LINUX based platforms.

    As long as you are following laws and can justify reenter any time. My friend has made 3 trips of 3 months duration on B1 visa. I believe it should be fine unless you are asking them to reenter after every month

    I wonder if this can be addressed in the same manner the F-1 OPT relief was addressed - not needing a congressional vote.
    I think the biggest thing is to have the freedom to work and study, obviously one can study on H4 but there are drawbacks and disadvantages when compared to an F1.
    I am fully aware that there will by naysayers who will argue that this circumvents the H1b and the F1. But for a country that prides itself on freedom and justice, hopefully people will see beyond this.

    Main concerns:
    Ability to work: If this is an H1b equivalent job, let the applicant go through the H1b process, not subject to cap.
    Ability to study: let the H4 holder have equal privelges as an F1.
    benefits: H4s are your future immigrants, by investing in their future, there is no doubt that they will be more productive in the future.

    I wonder if this can be accomplished via executive order as opposed to a congressional vote?

    Thats the first thing I tried O wise and learned master! But the Swift 3D movie is gone as far as I can tell, yet it's remnants remain. Mystery to me. Try it yourself, but first rename your movie so you don't ruin a good one. then import the swift 3d movie, publish, and then try to get that sucker out of there. I even tried throwing holy water on the frames thinking that that would help. Didn't. Any more suggestions? I am all ears, Massa.

    I got promoted with a hike and then demoted with pay cut. It is all because my attorney was not agreeing with it as per the law. So it not only depends on the company, but also with the attorney you have.

    As per the law, you can get promoted to VP or CEO. But once your 485 is adjucated, you have to take up the role for which your LC is filed. I do not know how insane the person is who formed this law, but it is the reality.

    Again, if the person stays with the same company where the labor is filed and if 485 is pending for more than 180 days, then there is no problem in promoting this person. This is again as per my attorney. So this entire stupid law messed up my career.

    I asked my attorney about this (she is my attorney, not the company's). What she said was that once the labor is filed, most employers are willing to go along with continuing to send USCIS info about the OLD title and position.

    Even though the whole employment based green card process is supposed to be for a future position, it is not realistic to assume that a good employee will NOT get promoted in the 3-8 years that the process usually takes. As an example, my cousin, who is in a Wall Street firm, has been promoted 3 times in the past 6 years and is now a vice president. His labor, filed in 2003 for an IT analyst position, is still stuck in the Philly BEC!

    What it comes down to is this: you are at the mercy of the company when it comes to promotions.

    :mad: Sorry to hear about he denial, you need to add more details in your message, eg. what is specified in column 14 and 15 of your labor, this informtion holds the key. You can apply labor in EB3 category with just 2 years experience, or experience + training or eduaction etc there are so many combination, and all this is specified in ETA form column 14 and 15 of your labor and you have to prove that while filing I140 but looks like in your labor educational requirement specific degree is required like computer science (just guessing). Ask your attorney for a copy and post the details here.

    I don't think you need anything from your employer for COBRA. Its your option to use COBRA or not.

    There are many individual insurance comapnies you can use. It depends on the state. http://www.anthem.com/ plan HMO is the only one I know which covers maternity. You would need to pay $1500/year/member for hospital admissions such as maternity.

    I did E-File for both me and my wife on June 15. We did bio on July 12. My wife's EAD got approved on July 23.

    I got RFE for missing or wrong pose for photos on August 4th. I sent photos and received on August 7th.

    Still waiting.
