No.. the probationary period is granted for you to either complete 2 years of college or serve 2 years in the armed forces. Since I already completed my college degree there would be no probationary period. The implementation measures for this bill would have to be worked out 180 days after passage according to the text in the bill itself.
You are right that the current immigration laws are unfair to international students. But, EB-2 is completely clear for ROW.. the only backlog is India and China.. and frankly thats just government regulation interfering with market conditions. The fact is, there are simply too many applicants from those two countries and the government has to step in to bring it back to normal distribution. There are a number of factors why India is so backlogged.. good and bad..
Let's hope for something to happen, because whatever it is, it will certainly be better than what we have now.

Not true.
As per my lawyer.
As long as dependent's I-94 is valid they are not out-of status. If they wish to travel out of US (AGAIN ONLY IF THEY WISH TO TRAVEL OUT OF US) , then they need either of following to come back
1. Visa stamped in the passport ( based on the H1 from new employer)
2. Or H4 extension approval notice based on the H1 from new employer, along with a Valid H4 stamp in the passport (this stamp can be based on the H1from old employer, It should not have expired though.)
Above is not required if dependents do not wish to travel out of US and come back.
But one needs to apply for extension when the I-94 is about to expire, if one is not planing to go out and get a stamp on the passport.
I was in the same boat. I applied for extension of H4 based on the H1 from my new employer around 8 months after i changed the job, i had to do that as the VA DMV need second proof of identity for license for my wife and Approval notice is accepted in VA DMV as second proof of identity.

The priority date for ROW EB2 was at August 2002 for months through until May of this year. So those still pending must be from the end of 2002 like myself whose date is November 2002.
Month --- Visa Bulletin Cutoff date
April-07 --- 01-Aug-02
May-07 --- 01-Aug-03
June-07 --- 01-Jun-05
July-07 --- Current
So from May through July for 3 months, "Aug 2003 cutoff date" was current, and June through July "Jun 2005 cutoff date" was current and in July ofcause everybody was current. I guess it is safe to assume that every one who had their cases (I-485/CP) approved got their GC during this time (part of the 60K that USCIS processed during July/Aug).
So cases that were approved since the July fiasco are the ones that are waiting in the pipeline for Dec Visa numbers, that shouldn't be that many.
That is why I think that in Dec it should move to somewhere in Mid 2003 or even beyond.

Irrespective of whether you are on H1B, it is a good idea to be on EAD.
Switching to H4 was the only choice before you applied for your GC. Now you have 2 choices.
Being on EAD, you won't accrue any status violation as far as USCIS is concerned. ( Of course that is true for H4 status also).However it is easier for employers to hire you on EAD as they don't have to do much of paper work. If you are on H4, you have to go through the pain of switching back to H1 when you find a job. It is an additional headache for employers too.
If I were you, I would remain on EAD.
I think you are concerned about going out of status. When you are on AOS(485 pending), it allows you to stay in US even if you don't have a job. ( Though it is not advisable for long term). There is no chance of accruing "out of status" on EAD.

But the result in case 2 is more severe b/c I have to go back to home country and apply for H4 if I don't have a job or H1 if I do and risk being denied visa, right? In case 1 I could stay in the states and file a motion to reopen.

I belive democrats will sneek in some law's like remove quota per contry etc similar to prior to 2005, that itself will benifit us or a skill bill etc , a H1B hick will be first symptom of things to come

I entered US within 2 days of my expiry of my visa. The officer in the port of entry was a kind person, and he gave me a one month extn on the spot, so that will give some time for me to do the paperwork for the extn. But again this is a rare case, and it can differ from an officer to an officer. So, your guess is as good as mine.

We (parents) had applied for family based concurrent AOS in Aug, 2008 while we were on
tourist visas. We are now in India on Advance Parole(valid till Aug. 2009) that we received
after filing AOS.
Today(Feb, 2009) production of green card has been ordered for my wife and will soon be
received in USA. My case is still pending but we expect it processed soon. Thanks for all

My questions is

I agree with this interpretation. If your date is before what is shown on the processing times page, then your application has already been looked at. It does'nt mean that applications after that date have not been looked at.
In my case, I filed I-140 in Nov 2007 and received the approval last week. But, the I-140 processing date shown for TSC is only July 19, 2007. So, obviously they are working on applications way later than what is shown in the processing times page.

My PERM is still pending as of now as it was filed in first week of Feb'2010, once I get PERM approval I'll make sure that we file 140 within the timeframe.

I had a question for you your I140 was applied in 2007, so was it pending for so long or it was approved and then they denied the I140 & I485. If the latter is true then potentially they are re-verifying everything before approving the 485 application (This is a alarming situation as with the wait times things can change from what was originally stated).

I don't understand what r they upto and what r we upto. Our parents are not given the visitor visas, we are being charged fee to renew APs and EADs every year which is going to be increased manifold now, our spouses can't work, we find it difficult to travel when the AOS application is under process, we are made to contribute to the social security fund without even knowing if we will ever get that amount back, we are paying heavy taxes and in the end we are hoping for the CIR which is not in sight yet and which mostly talks about Illegals. Shame on them......

just an alternate approach based on what my parents and in-laws have experienced........
they have just said to the consul that our son (daughter) and his (her) family lives in US and we visit them from time to time to meet them and spend time with grandchild......hence we request a tourist visa.......we have the following ties to India and here is our financial position snapshot
this has also worked......no specific occassion (birthday, graduation, housewarming etc) asked for...

Tancrado will not win in primaries. But how much support gets from People may have an impact on immigration. People are completely divided as congress. It is not just congress is divided. Infact people also divided that is main reason congress is divided and it is emotional issue. If H1B is increased so much and unemployment increases in americans we may see backlash in distance fiuture. Now Desi company is more than H1b Cap and waiting for April to file H1B. I am sure Skil bill will destroy the hot job market as it happened on 2000. Of course increase in gc will not have big impact on job market as it will not increase new immigrants

i too had a same problem.Try to call nearest CBP office & explain them quitely.They will correct the date on to your I-94 white card.
For their reference you need to carry all the I-797 original copy,I-94,passports.
For me they escorted to their office & asked about the problem.Initally i was worried as two officers escorted me.But nothing to worry.Everything was fine at the end.
