Hi all
My I - 140 is going to be approved 9 under EB3 ) soon. After the approval comes I would like to switch employers but NOT loose my PD ( dec 2003 ) .... is this even possible ?? .. if it is then do both cos need to be in aggrement that cos A ( old cos ) will be willing to give up my I-140 petition and cos B (new cos ) is willing to transfer this I-140 to their cos under my name ????? ..... if someone has faced similar situation , let me know.

Ok well this discussion is not going anywhere. The whole point of the flowers campaign is to make the CHC realize that they can help the illegals without damaging provisions for legal immigrants right now. The illegals issue will take a LOT more thought than the issues faced by the legals. THAT is the point we are trying to drive home via the flowers campaign.
However if the IV core thinks this is a bad idea, then there is no point in doing this now.
If the flower campaign is getting old, let us do a "Fruits of our Labour" campaign on Labour Day.
On a lighter note:
Now I had suggested the IV DC Rally back in March of 2006 and it was termed by the Core/Legal counsel as a bad idea. Guess what happend after a year and half? The DC rally in Sep 2007. Let's hope the same thing doesnt happen for this flower campaign.
Or we can send a card thay says "Please help the legals too" or something that does not provoke them but makes them help us .... Like a "Thank you Card" will be very sarcastic and may drive them nuts.

Just take the Original Approved EAD Notice to SS department and fill up the forms. They will give it to you. I did it for my son last year who was 9 years and got his SS card with in 10 days.
You can not apply on line as they need to verify the original approved EAD notice.

I got EAD but no FP notice till now, same boat :(, any insights on what is happening?
In the case of myself and my other 3 friends/relatives cases have been filed in NSC and we all got our FP notices within 2 weeks of the date of First LUD of EAD. Small sample base but thought to note down.

Answer: A person cannot continue the GC processing with a change of employers even though, in some circumstances, the person is allowed to retain the earlier PD if the earlier I-140 petition is approved and not revoked by the earlier employer. The new employer has to start the LC/PERM process from scratch, and until the earlier I-140 petition has not been revoked, that person is allowed to retain the earlier PD.Jan-29-2007.

If a 485 is approved for a LC, then the LC can not be substituted for any one else. It is not true for approved I-140.

AC21 is fairly simple. The legal framework is one paragraph in the INA (8 U.S.C. 1154(j)):
(j) Job flexibility for long delayed applicants for adjustment of status to permanent residence
A petition under subsection (a)(1)(D) of this section for an individual whose application for adjustment of status pursuant to section 1255 of this title has been filed and remained unadjudicated for 180 days or more shall remain valid with respect to a new job if the individual changes jobs or employers if the new job is in the same or a similar occupational classification as the job for which the petition was filed.
That's it. The INS/USCIS has never implemented regulations to work out the details. So as long as your new job is "in the same or a similar occupational classification as the job for which the petition was filed" (petition is your I-140), you are fine. No need to worry about job location, salary or filing new G-28 form or even notifying the USCIS about the new job as it is NOT required by law.
Department of Labor has a database of occupational codes.

Check it and just make sure your new job falls under the same category. I firmly believe that as long as the job falls under the same high-level group, there is no need to worry. Even if it does not, there is a good chance the USCIS will never ask you about a job change.

Also H-1B extensions beyond six years are not possible for people stuck in BEC/PERM centers. They will have to leave after six years just because they could not apply for I-140.
The crazy part about this bill is atmosphere in the senate is not allowing any favorable amendments for us to fix these glaring problems. It is better that this bill dies.

Hello,
As most of EB2-India I-485 filers are already aware that I-485 processing dates follow Receipt Dates, but not Priority dates. Most of us missed filing on July 2nd 2007 because of filp-flop of USCIS decision. But now after an year later whoever could filed on that date (not honouring USCIS decision) are gettings approvals eventhough their priority dates are as early as Jun 2006.
But whoever honored the USCIS decision and filed after USCIS confirmation are not getting approvals eventhough they have earlier priority dates.
Is not this an occasion to remind USCIS that take correct decisions by sending some flowers?;););)
