Anybody else?
I am here in Montreal for H1B/H4 stamping for me, my wife and two sons and are stuck since 3/18/08. We got our H1/H4's stamped from Toronto in 2005 without any problem but tis time.. GOD only knows..A wait of more than 40 days.. after being 8 years in US..No criminal Record.. Paying taxes..motgages..SS Taxes.. and go through this hell to get GC..

Can a EAD holder claim for unemployment to the state unemployment commision, if he lost job . (Say the EAD holder is not the primary applicant and is the derived applicant).
Are EAD holders eligible to claim unemployment insurance if they lost job.
If they claim for this, will it impact their GC or citizenship process?

Friday the 13th was good for you. In most cases, however, the issue is lack of visa numbers and not of case papers getting lost. And the lack of visa numbers is because there is genuine unemployment in the country and the anti-immigration voice is very loud. Just to be realistic, its impossible to fight this out unless you can create jobs somehow. Sometimes lying low and waiting it out is the need of the hour. Creating a storm of controversies is not always the best option.

Okay here are my two cents ...
I was investigating something similar for another matter on my end i.e. if a criminal case is filed against an NRI who is in the US then he cannot be forced to return to India under any circumstances.
Per my research, one is completely safe in the US. The advice I got from attorneys was that one should not travel to India until such matters have been resolved however. Indian Courts or the Police cannot get you deported under a criminal case unless you have committed a serious offense (murder or of the sort, even that is not that easy...). But if one does go to India, given how corrupt the law system in India is, you can be forced to stay in India until the case is resolved and your passport can be taken away by the court if the opposing party has the right connections and bribes the right people. You do not want to be in that situation so it is best to avoid an India trip for the time being.
You should still consult attorneys here and in India for your particular situation. Do share what you find out especially if you get information that conflicts with what I have found out so far.

This is a property related matter and my Mom's step brother has been harrassing our family for a very long time but after my father passed away recently things have gone really bad, I am the only son and an here in US I have two married sisters and they are trying to help as much as they can.
Here are the facts of the situation:
- Property in Hyderabad had been gifted by my Grand Mother to my Mother, grand mother has passed away since.
- My mother had earlier decided to split the property half way and give my step brother his share.
- But due to property being in joint venture and development with builder there were delays before completion and in the meanwhile my Step Uncle started seriously harassing my mother by bringing goons over to my mothers house.
- We filed a civil suit against my uncle to keep him away from the premisis.
- In retaliation he has filed a criminal case and obtained non bailable warrents against my complete family (Mom, me, Sisters, Bs-I-L) claiming that we are a threat to his life (this is ludcrious because in reality he is a threat to my mother). However every one in my family has been able to get anticipatory bail except me as I am currently in the US.
Now he is threatening that he will contact the US embassy and some how make me come to india and then I will not be able to get back to the US. I suspect he will use the fact that there is a criminal case against me towards this.
Does the US embassy entertain these kinds of cases ?
Does any one know if this is possible?
Does any one know any one else in a similar situations?
Does any one know any good lawyers in Hyderabad to deal with this situation?
I am getting in touch with attorneys here in US to see what they have to say.

I always seem to send extra stuff, but i guess it wouldn't hurt.

Thanks for your blogs. I think drivers license copy is not needed if you are applying for an EAD extension. Copy of old EAD is enough. Only new filers need to send drivers license copy ( or some other form of ID).

Need some insight from the gurus...
Scenario:
I have applied LC/140/485 from company "a" now I have an EAD/AP.
But - I work for company "x" who holds my H1B.
Questions:
1. How long can I be with "x" company? I have heard I can be till I get ny GC is that correct and never join the abc company?
2. Can I do AC21 as it is over 180 days to say "Y" company and keep waiting for the GC?
Fear : Can I get a RFE or interview? Is anyone in same boat?

Have you ever worked for company "a" ? Do you have offer letter, pay stubs from company "a" ? In case of RFEs generated for AC21 filing first thing USCIS would ask for is latest pay stubs from "a". because "a" is the sponsorer. For your gC process "x" does not matter and will not matter. Virtually speaking if you have not worked for "a" (not having pay stubs) AND join "b" thinking using AC21 AND "a" has a problem with that then you will be screwed. BUt if "a" does not have any problem you joining "b" without even having one paystub from "a" then there should not be any problem (My Guess). But even in that condition I would sit quitely and would not send AC21 letter to USCIS. If RFE get generated then I would think about what to do. Anyway ask to the professional lawyer about this because you want to play with law and there lawyer can decided whether you can be playful with the law or not.

Applied at tsc on 2aug card prodn. ordered on 23rd oct. But I have received 3 lud's after that on 485 and 2 on 765, my 140 is still pending at TSC applied on 29 of july.

The 3rd point has always surprised me. How do they really know if you haven't travelled to a 3rd country within 30 days?
Yes, this is true provided,
1) You don't apply for a new Visa while in Canada
2) Return within 30 days.
3) don't travel to a 3rd country while in Canada
4) Have a valid passport.
5) Not from one of the 7 countries currently listed as sponsors of terrorism.
And please make sure that you do not surrender your I-94 when leaving the US

The number of visa USCIS returned to DOS =? The number of 485 filers received on July 2nd, or the total application received in the first week, or the total number in the first two weeks, or whole July.

Worst case scenario: Congress realizes that passage of mass amnesty is too controversial and therefore passes the Dream Act amnesty. That is even worse to us, because then we may be left out again in the queue and just watch kids of illegal folks and their parents get amnesty while we may get stuck even further in the queue.
Are nurses H visa quotas doing OK ? As we know there is no desperate demand for H1B for the high tech sector anymore. If H visa numbers for nurses are OK, then yes, we may need to be prepared to a looong ride.

It seems imiigration legislation is still a barking dog that never bites. We had a lots of hope in coming days i.e. early next year that something good is going to happen. But the way whole thing is being played, it does not look very promising. All of sudden immigration is not an important topic any more. If dems keep playing safe this way I doubt anything will happen, ever. I think it's time that we brace ourselves and get ready for the worst. Make decisions what we have to considering this is never going to happen. People like me lives on hope. Hope that someday it will all end well. I have started thinking about going back.

I did NOT find any figues on page 112 of the Economic Report of the PResident. Page 112 deals with US Taxation Policy in International perspective.
Chapter 2 of the report looks at Skills of US worker - makes a strong case for immigrants and thier contribution to US, especially in math, sciences and advanced degrees. But again could not find any numbers.
So, where are the numbers ???

I have my birth certificate with me - original - If I send a photocopy for my parents visa stamping would that work. Just curious to know Why consulate needs sponsors original birth certificate ?
