I have a valid H1B (years 4-6) though I have not renewed the stamp in my passport. I am currently working on my H1B at my sponsoring employer. I have used the EAD to do some freelance work.

Since you have used EAD to do freelance work, you are effectively on EAD. Your H1b is gone even if it is valid.

Folks,
A lot of folks , who filled I-485 on July 2nd onwards, will have their independence day (with fine prints) starting next week on 12/29/2007. Several us including myself are planning to use AC-21 and I wish all of them all the best.
Also , the next week we have Christmas and several of us are going to take time off to spend time with their families. So I would like to wish a happy holidays to all of you.

Please help me. I need some advice from you guys. Currently, I am staying in US on H4 visa and recently I got admission in one of the US universities with full funding and so I want to convert my visa status from H4 to F1. Now regarding this I have the following questions:
1. It seems that visa COS from H4 to F1 takes anywhere from 2 months to 6 months, so my chances are 50/50 of getting it approved for Fall 2008. So, is it advisable to seek an F1 visa from India?
2. If I go to India and try to get F1 visa from there, what are my chances of approval considering that my husband is working in US on H1B visa (potential immigrant and all) as he also came on F1 visa and now working here (we have not filed for green card yet).
3. In case my F1 visa got denied in India, can I come back to US on my existing H4 visa and then apply for COS from here or will they revoke my H4 visa in India?
Your timely response is much appreciated.

OK, I would advise not to leave the US, because they may NOT give you F1 visa. In addition, they may cancel your H4 too. H4 is a dual intent visa and as far as I know you are OK to study on it. In fact, recently I helped someone to get into college on H4 and she received in-state tuition. So, I would suggest remain in H4. This is a good status. F1 is purely non-immigrant status and that's why they would not give stamp to you. They will know your husband is working on H1 and that most likely he is being sponsored. Don't take such risks. H4 does not disallow to study in the US. If you decide to change to F1, remember you will need to stay here until you receive GC. If you leave after receiving F1, they may not allow you back on your H-4 stamp due to your previous F-1 status. Be careful.

Most people do not understand immigration beyond amnesty. They simply are not aware of the time and effort it takes to become a permanent resident.
More over once they start to get a feel of the backlog issues, it is easy to navigate to the economic impacts - buying house, starting small business etc.
I strongly urge our members to visit our elected officials. This can make a huge difference than most of us think.

We have sent the response to our RFE, and the case status has changed to resumed processing, and it also states ' You should expect to receive a written decision or written update within 60 days of the date we received your response' .
Does this mean they can approve the case even if the dates are not current?
I know this is kind of vague, but thought of posting my doubt to see if i could get any help with answer/information.

If I have seen anything work for us, it's only lobbying. Be it behind-the-scenes lobbying during July VB reversal which got IV a seat at the discussion table, or the executive lobying for Admin fixes which gave us 2 year EAD/APs. Surely our other efforts such as Rallies, letters and others supplemented the lobbying and made it successful. Without lobbying and getting a seat at the discussion table, all other efforts would've been for naught. Having seen the lawmakers discuss horses before the legal skilled immigrants, I am convinced - more than ever before -we need to do more lobbying in the coming days to succeed.
Building a strong IV war chest is our only chance of making our voices heard amidst the heated discussions of CIR 2009. We definitely need to do better for our voices to be heard over the cacophony of Legalization vs Border Security. I for one don't want to see the resurrection of dreadful CIR 2007 with reduction in EB visas to 90,000. Do you? Instead of trying to lock the stables after the horses have bolted (sarcasm intended), we need to start strengthening IV... NOW. That is if we wish to see our issues given more preference to the horses next year. And the only way to do this is contribute to the lobbying funds as much as we can.
I don't believe in just preaching. I have taken the initiative and donated $100 to IV on the anniversary of our DC rally. I urge every one to donate whatever you can.

I think this is a really bad idea. Green Card is fine.. but remember, we are first Indian, Chinese.. we are citizens of our countries..and owe allegiance to it....atleast till the time you get your american citizenship.

I was kind of popular for Photoshop myself. But I was mostly popular for knowing as much about web design as I did.
My school made me do their website. It is actually finally up again... http://www.nehs.phila.k12.pa.us/
Now keep in mind that isn't my best work. For free, for school, i got to work on it from 8am to 9am, and I had to start from scratch and I had to go around get all the info on my own (well one other person helped gather info), leaving me little time to worry about design and such.
The school loved it (and compared to their last one, which was last updated in 1999, I did too) and that is all that mattered to me.
Oh yeah I was also editor, photographer, and well everything else. So that is why it looks so bad. I had about 5-10 minutes a day to work on the actual look, the rest was inputting info and getting info.

maybe you are right, but if the bill passes as it is then what will happen to all current consultants? I have a advanced US degree and is working as a consultant. I don't want to but I have to ....unfotunately. The new law says that a company cannot place H1B consultants on client site. Which means you cannot be a consultant on h1b status. I can offcourse switch over to an big american conulting company(have an offer too) with a h1 transfer but still there will be no difference if CIR passes in its current form. what do you guys think???

I talked to an officer at the IRS as soon as I received my SSN and he told me it is NOT compulsory to report it to them becos when I do use my SSN if I get a job..the info will automatically go to them.

I applied for renewal last Oct 2008 and never got a fingerprint renewal notice. My new card arrived January 2009 for 2 years.
Did you read my post before posting yours? If you paper-filed you will NOT get a notice for biometrics appointment BUT you will be finger-printed and photographed if you submit your application online. So the relevant question: Did you e-filed or submitted paper form?

O Ya! It will screw your GC process. Once your Canada immigration is done, Canadians will put a stamp on both cheeks of your buttock...saying..."immigrated to Canada"!
Coming back to US GC, before issuing GC, US immigration officer will ask you to come to local USCIS office and they will have a good look on your buttock! If you find that Canadians stamped your buttock then you will have to take shower with either LUX or HAMAAM soap to get rid of that stamp right at USCIS office.

if u live in dc area take personal 30 min/1 hr consultation personally with mrs. murthy of murthy.com. second choice is rajiv khanna from immigration.com.
If u are not near dc u can take a phone consultation and fax ur rfe ahead of time to the lawyers. Money u spent might be totally worth.
