My PD is september 2006, I140 approved, DS230 approved, 3 packet approwed or not ( I am not sure, accordig to the last reply from the attorney my case could be even in the consulate), Before the retro began my case used to be a subject for schedule "A"( nurse), now I am in EB3...
The question is - will I receive my appointment to the interview soon(next month), because all forms have been accepted already, or I have to wait for all cases with PD older then mine to pass before my case???
One more question.
I am not in the US. Should I try to go to the US, and then(after 2 months) apply for I485, before the retro will start again in september??? Is it necessary to have I485 approved in order to receive legal status or it just have to be filled and applied? Will I lose my place in the consular processing after applying for the adjastment of status?
I know , too much questions, sorry for that but I am realy confused, and badly need your help and advice!

i really appreciate and applaud what you and other members of immigration voice and other pro-imigration groups have done but for personal reasons i believe that fighting the congress is a losing battle and i sincerely doubt if we'll have any pro-immigration bill passed before the 2008 presidential election and when the new president comes this will fall att the bottom of his/her agenda. Look at Bush's tenure he's promised pro-immigration measures since 2004 and squat has happened. The issue is that there a lot of anti- legal and illegal immigration activists and congress members who will make sure nothing goes thru the senate or the house.

Same scenario in our case. I got my EAD very soon but my wife didn't. We called USCIS and got the stupid response "Wait for 60 days". That 60 days was after we had already waited for 90 days.
We took the infopass appointment and found out that post-mail containing my wife' EAD was returned by post office (USPS). They said they would send again in 10 days.
The reason I found that in our apartment mail box, only my name was written. So after the infopass appointment I wrote my wife's name too. We got it within 10 days.
I think that happened because the USCIS envelop has wordings : "return services requested..."
And I think the main reason is my and my wife last name are different.

I-94 form does not have any such thing.. But DS-156 and 157 might have.. so if the guy goes and does not apply for a visa he shud be fine i think...

Can you tell me the procedure to apply for FOIA and also how long did it take you to get the copy of labor . Did you use an Lawyer to fet this info ?

Even my 140 was filed with CP. My PD was current last month. I filed my 485 (AOS) last week. As per my attorney if CP is specified in your 140, you have 2 options. You can file CP or AOS. You can just file for AOS. No need to convert. But AOS is speicifed in your 140 and want to convert to CP. Thank you need to file some form.

I hate to disappoint you but there have been several instances of highly qualified IT professionals living in the US for a number of years who decide to jump the bandwagon and migrate to Canada due to the GC limbo. What happened to them ? Well some of them struggled to get the right jobs for a number of years before giving up, returning to India and finally taking up highly paid and respected IT middle or senior management positions.
Three of my friends went through such "stressful" experiences and now are happily working back in India. They still regret the decision to put their valuable $$$ into migrating to Canada, living in limbo for a few years while trying to get a compatible job in India and finally going back to India.
It is very unfortunate that people equate job opportunities to the population of the country. If that were the case then India and China would have the most job opportunities in the world because they account for one third of the world population but that's not really the case otherwise we all would't be here in the first place.
Opportunities are defined and provided by the economy. When you compare Canada to US, you might say that it's a smaller economy but remember Canada is a G8 country with such a strong economy that most other countries in the world can only dream of. US is the richest country in the world with the strongest economy so obviously other countries don't offer quite the same opportunities but Canada offers things that has become a dream for many of us... to be a citizen of the country where to permanently reside. Canada offers stability, certainty, hope for the future, and and an opportunity for everyone in your family to realilze their dreams as opposed to sitting at home for years doing nothing hoping that one day that EAD will come. Canada respects immigrants and welcomes them with an open arm quite contrary to policies in US where you are allowed to work but your family is not and even you are kept on the state of limbo for years and years wondering what your future holds in years to come. And better yet, you abide by the laws, pay taxes, do everything by the book yet the guy who just walked across the border has much better chances of becoming a permanent resident than you. Where is the respect and fairness for law abiding folks? That my friend is what is different with Canada. You get treated with respect and dignity and you get to decide what your future holds and not the US government.

Look, the H1 quota was not sufficient even when it was set at 115,000 pre-2000. It was only when it was set to 195,000 in 2001 that the quota exceeded demand. Now thanks to the report by USCIS last year, we know that about 20% of the H applications had fraud or technical violations. Even if you assume that the USCIS does a perfect job and catches this 20%, the quota that will be freed up won't be enough for the rest of the applicants.
The issues we face have less to do with fraud and more to do with the anti-immigration forces who dislike the 1965 immigration law. Claiming fraud, cheap labor, harm to the environment from increased population are just convenient means to couch opposition to permanent immigration in.
actually pre 2000 the visa's were available all year long , then there was a crunch due to the y2K and then when the bubble burst it shrank again.

and again 20% was just taken from a sample space of about 260 or so
if USCIS were to count every case where a body-shopper has a guy on bench with no pay , h1b procured when no project available that 20% will double up atleast.
the Anti-immigrant lobby will always be present whatever year/century it is , its human nature , so that fight will always be there , in boom time or recession or whatever

I have seen lots of posts about pre-adjudication..how do we know if any case has been pre-adjudicated or not?...recently i got an RFE on my spouse case for Marriage Certificate and Birth certificate bonafide..there is no RFE on my case and had an FP done on 08/11/2009 second time and noticed soft LUD on my case on the day of FP...dose this means they are working on my case...:confused::confused:
